Hello.
I have the same problem.
My brother is a US citizen who has filed an I-130 for me and my family in May, 2008. We've traveled to the US on B1/B2 visas in February, 2009. The thing about it is that in the DS-156 form point "36. Has Anyone Ever Filed an Immigrant Visa Petition on Your Behalf?" we've answered "No". I've had no idea at that time that it was referring to the petition for alien relative. Anyways, we've returned back home in time.
The question is: "Is this possible to prove that I did'n know about the petition?" And how do I prove that the wrong answer is not "willfull misrepresentation of material fact"?

Sometimes I think that rather than writing to these politicians ,we should write to USCIS.This retrogression is caused by them.They didn't wait for any bill to be passed for this retrogression.There is no use of talking to politicians,they don't care.
I know that USCIS will not care either but USCIS did it out of nowhere ,till sep2005,everything was fine for them and suddenly in oct 2005,they put us in backward direction.Now after a year and a half ,we are at the same spot,waiting for the visa bulletin and staying depressed for a day or two after seeing it.
I don't know .I am so mad at everybody.
Sorry for the ranting.
Btw,i have already sent emails to USCIS and chicago tribune regarding this .

Democrats want to win Presidential election and increase their numbers in congress based on Iraq and Immigration. They are thinking that if CIR is passed they can project that it is Democratic congress which passed CIR. If they fail they will blame that Republicans voted against and they will make this as election issue. They are thinking in that way. But it will not work. People are against big immigration numbers but they will not oppose moderate immigration increase. But American people are divided when it comes to illegal immigration. If any other issue is burning then immigration will become non issue and democrats will not get any extra votes because of CIR. But liberal immigration is not good for Labor unions(we know democrats are pro-labor also) so that may work against Democrats. Right now it is not sure whether parties are really dedicated to pass CIR or Just for making immigration alive to get political mileage.
it seems democrats are making this bill so liberal that even liberal republican will have tough time to support it.... in that case democrats can say republican are not in favor of immigrants and Bush is not able to manage any support from his party.... We can't say anything for sure...but a very liberal bill will have really tough time to go through.....

Here is my situation:
I-140 approved - PD: May '06
I-485 filed - July 30 '07 (India)
EAD cards - Received
APs - Received
Due to a slowdown in their business, my employer is laying me off in Dec '07. I'm still short of 1 month to complete my 180 days of I-485 filling. However, they said they will not withdraw my I-140 and, to help me, will in fact keep me on their payroll until Jan '08, with my Jan '08 salary as my severance and my official status as on "paid leave". So far, so good.
I also have a job offer, and my new employer wants me to join them in Dec '07, on EAD. My question is: Can I be on officially on the payroll of two companies simultaneously on H-1B and/or EAD? If yes, do I need to inform the USCIS of my status (new employer; AC21)? My other option is to say No to the new (attractive) job offer (or to try to convince them to wait until Feb '08, which they'll likely not agree to), and and take up another job in Feb '08, on EAD / H-1B transfer, using AC21. Please advise whether I'm fine with using the first option!!

Looks like they have few set of replies and randomly selecting and sending those replied.
SOP - Tell your congressman you got approved with the same day as your spouse and there are people who got approved in the later dates as well. Ask them to follow up with USCIS with the same. If not since USCIS has sent this info in written, tell them you will take legal action, if this is the reason.

Sorry, forgot to mention the MTR. If your I-485 AND MTR is rejected, my point still stands.

I am in a similar situation. My lawyer prepared the following letter which seems much simpler than what you had mentioned. I hope, its helpful. However, my company HR is not willing to even sign on this one. they omitted the word 'permanent' and also, removed the last sentence mentioning that i will continue as full time employee after receiving the green card. I regret joining a big company now. But, we are where we are and have to deal with it.

I also reached this conclusion that....GC perm apps right now in the first 9 immigration calendar months is at an all time low and if this is indicator for future then huge ROW numbers would be going waste and by law they then will percolate to retrogressed countries like India and China and I also foresee huge PD moving in 2009-2010 calendar yr starting Oct 1 2010. I think they will increase quarter by quarter rather than month by month and by this time next year many people might get their GCs.
Yes this is a serious plus point and ofcourse yes having jobs intact during this period would be the key...so given that is OK then GCs should start coming...I agree with beautiful mind
