Hello sir, I am on H1B, a new company is hiring me and they have little knowledge about h1b issues, my h1b transfer is not filed yet, they are 100% sure that they r gonna hire me, but I haven't decided whther to work with them or not, the other day I went to their office to fillout the application for background check but they made me fill out all the forms that a candidate has to fill during the hiring process, they went ahead and filled my I-9 and w-4 forms too. I was thinking that it's all a process of pre-hiring,but after coming home I did a little research and found out that I-9 has to be filled after they transfer my h1b, do you think is it gonna be a problem?I e-mailed them not to put me in the system, did I violate any law by getting hired by them before even my visa transfer process is started?ofcourse I didn't start my work and I am not going to start until my visa tranfer is done. The employment is at will and I didn't sign any contract with them, do you think they will create any problems for me in future(if they want to)?b'cos I haven't decided to work wth them yet and I may tell them that I am not gonna join them. Please advice me I am really tensed.

Trust me. I was under the impression that it will be 3-4 years before I see green, but the reality is almost true for me now. Similarly, EB3 folks would get some news by next year. Who knows, the government will change and we have seen how keenly Obama wants a change ;). May be recapturing visas provision will be considered next year and everyone until 2006(EB3) may see some green. We never know. It's all magic and lets hope for the best. :D

Currently, there are about 400K EB AOS (including EB2 and EB3 and all countries) pending with USCIS. If USCIS works efficiently and doesn't waste any numbers then this backlog can be cleared in 3 years assuming demand for EB2-ROW remains the same.

nope. The august bulletin which gets released mid july didn't get into our arguements at all. We were specifially talking about july filers and july month.

Hi All,
I currently have an EB3 March 2003 priority date labor I140 approved with my company. Recently, I wanted to move to consulting, sothat I can get my GC converted to EB2 as the dates are only 2 months apart. I have asked my company if they are willing to take me as a contractor once I am out of the company and go to a consulting company. They said that it should be fine, but they said if GC is the only purpose, they can try to do something about converting my existing labor to EB2. It's a very big fortune 500 company and they do all their labors in EB3. My question is:
1. Can I re-apply another labor in EB2 for a position that qualifies in the same company and can port the existing EB3 priority date? Has anyone done this in the past?
2. Can I use any prior priority date approved labor in the same company, even though my EB3 I140 is approved with the same company.
3. Can I move to consulting company and reapply in EB2 with existing priority date and work for the same company that has my current labor.
The company legal counsel said that they would come back to me with some answers this week, but I want to get second opinion from all of you in this regard. I have my Masters in 2000 and MBA in 2004 with 8 years experience and so EB2 qualification shouldn't be a problem

Looks like this issue is finally getting some attention in both the lobbysphere and in the legislature. I was pleasantly surprised to see this on the yahoo techticker.
It is actually a very sensible partial solution. I hope it will be a part of a multipronged strategy to solve this. I am under no illusion that we alone can solve this, but we can help.
We are already an integral part of this economy but being prevented from contributing fully to it, by purchasing homes and investing into it. It hardly seems a radical approach to integrate us fully by giving green cards if we buy homes. Those who have secure jobs and rare skills are the ones who will buy. Those immigrants will help near and longer term.

You people have no respect for your own motherland and always think everything American is good than your own country. Learn to stand up for your motherland. Just because you want your greencard does not mean you forget your roots. Anti-Immigrants (read racists) of this country will still call you slumdogs even if you are a citizen of this country. But your own country people will never forget you and will accept you as their own even if you have lived here for 50 years.

However, this story has nothing to do about standing up for our own country/motherland. Every person who has a common name with terrorist names has had troubles at POE since 9/11. So who cares if he is SRK or anyone for that matter. When Colin Powell was the chief of security under Bush administration he had to go through airport security just like any other common person. The TSA here in US treats everyone the same. Do you think ministers or celebrities in India follow any security procedures ? Every now and then you hear of ministers and celebrities involved in smuggling scandals.
There are good and bad things about every nation. IMHO, security procedures in US are the far better than India and apply the same way to everyone unlike in India. (3) 3/ except as provided in subsection (a)(5), the proportion of the visa numbers made available under each of paragraphs (1) through (5) of section 203(b) is equal to the ratio of the total number of visas made available under the respective paragraph to the total number of visas made available under section 203(b).

August 2003 is a good PD if it were EB2 and you could have stayed with your company. I heard in this forum from someone that, if the person is Masters graduate and worked in related for three years they are exempt from cap even though they applied in EB3 category. If this is true, it is good for you to stay in your current company and not try substitution. If this is not true and if I were you I would have gone for substitution.
What ever you do, do it with good terms with your current employer, so you can come back and join them and be able to use the 2003 PD, if some thing goes wrong with your substitution. If you leave the company and join something else, if you think that you cannot join them back, then it may not worth it. Again, it depends on your personal situation, if you don't have a spouse who is waiting for EAD to work, you should not be risking this.
