mallu is right. H1B status expires immediately when a person stops working. An employer is required by law to notify the USCIS about a lay off and the USCIS revokes H1B as of that date. There is no grace period, so the only chance to preserve H1 status is to find a new job and file H1B transfer BEFORE the lay off. Preserving I-485 is a different story and you are in a good shape regarding GC. Just find a new job, use EAD and stop worrying about H1 status. It does not worth the hassle and you may not get any benefits from H1.

I reuquested my employer to file appeal for 140 denial, but they are not doing it and saying they didn't the denial notice by mail i.e. papaer copy.
We called USCIS several times and they have mailed copies several times.
Looks like my employer might have got it, but saying not received.
So I lost hopes on this and moved on to a different employer.
I have another backup labor (PD-Dec'2004) and filed 140 last year ~ Feb.
Now I moved to a different employer with this backup 140 and it is EB3 still pending with USCIS. Even though this is EB3, it has the Bachelors mentioned in the qualifications. So I am just doubtful on this one too.

I got my stamping till 2010 based on my I-140. I did that to save another visit to embassy when I go out of country and its costing me dearly. The visa stamp clearly mentions the effective dates from both 797s. So the officer asked for both 797s and stamped the end date from the current one. As he sounded positive that I can update it at my local USCIS, I didn't persuade him much. Maybe I should've done that!!!
Why did you show him the previous 797 anyways? Doesn't the previous 797 get invalidated the moment you get a new 797?

Hello friends,
Of late everybody is talking about bad economy. I mean its all over the TV and newspapers. Apparently we are in a recession since past one year (since Dec 2007).
However, odd it may though sound, I don't see any real economic slowdown in IT sector. I mean all my friends and acquaintances in IT industry in the US and India are retaining their jobs. I recently talked to my IT recruiter and she told me that as far as she is concerned this year has been like any other years. Bit sluggish at the year end, but loads of requirements lined up for January next year.
Am I the only one who is feeling this way, or others also sensing the same thing. Maybe the real jolts are still lying in the future, in the coming year. Or may be its just a hoax. I would love to know other people's observation on this strange anomaly between what is being reported in the media, and what is being observed on the ground.

From what I read from the above thread -
1. Does it make sense to fill an I-9 form with the same employer and start working on EAD, instead of burning my remaining period in H1?
2. That way even if for some reason my I-485 gets rejected, I can continue working by switching to H1?

I know this topic has been discussed in other threads as well and those threads got buried over the Period of time but this is getting beyond limit now - let me know if anyone has any good idea or if we can do anything together......
My PD is EB3 Mar 2005 and my 140 is applied in EB3 May 2007. at NSC (Nebraska) Its been 13 months and no signs of movement and no one is helping . Here what I did on a personal level and here is what i heard.
a) Contacted USCIS - they said contact employer/lawyer because they are the beneficiary.
b) Contacted Lawyer - they said 'Pls wait for some more time' & then ask employer.
c) Contacted Employer - they said that we can't push lawyers unless your case is passed 2 months from Processing Date update.
d) Contacted Local Congressman - Told them that the Processing Date update is a farce and USCIS (NSC) moves them back n forth just to save their Face. This is really unfair for a certain category of peoples. They took my case no. and inquired and then said that since you have a parallel H1B and a job - we would wait. If your existence in US comes on the Line then we will Jump in and help you. We are sorry but we can't really expedite unless a emergency comes.
Now tell me folks what other options we all have - NSC is just messing with EB3 140. Whatever is the workload this can not happen. Do we still have some options to work on (apart from sitting idle and pray) ?

My college got his I140 approved just in 2 months with normal processing. He filed in EB2-I. Mine was also approved last year in 2 months in EB2-I. Does the location from where are you applying affect processing time?
Not necessarily , But it does depends on what is load of work at a given time at given location. TCS was ahead of NSC last year but they shifted workload from NSC to TCS so now TCS is little behind. But once TCS cleans up all files it can go ahead. Processing dates are nothing but indication for when to open a Service Request at local office. If your case is behind that date you can open SR.For straight forward cases approvals comes fast. For those who are stuck they should monitor Processing time and see if their app is lagging behind proc time. They should contact USCIS.

ok so when would EB2 come back to its old status of Jan 2003(it was so for past 1.5 yrs atleast b4 jumping to june 2004 and again retogating)...would it be in this current fiscal yr..i.e b4 sept 2008 or it will take whole of nxt fiscal yr to come to that kind of dates?
I believe once it gets past Jan 2003 PD's, dates will move steadily.

On the I-485, the question regarding any memberships or affiliations I had was left blank.
My PD is oct 18,2001 which will be current from April 1.
Im expecting that they are working on my case now :)

I similarly applied online on Dec 20th and haven't heard anything at all. I applied online and the documents were sent to the Neb office. Can you please share your details on I765 extension filing?
well, honestly speaking, it wasn't an extension. i am still on h1b, however it expires soon, so, i filed at texas service center, taking the 120 day period as the processing period.
what i mean by not an extension is that, i once applied for 765 when i filed by 485 during july 2007 fiasco, but later, i never bothered to renew it.

I was just thinking, the wastage of visa numbers we see, is that basically due to the per country quota. The rule that no country can have more than X% of GC's in a year, would mean that even though there are visa's available, they cannot be alloted due to that per country limit.
Anyway the smaller number of application is good news.

thats not true...ac21 is under suspension because eb3 row is retrogressed...once its not, the ac21 trickle down of visa numbers applies.
