Unless it was a felony that requires certain jail-time or something it's not always counted against you.. remember .. purpose is not to exclude shop-lifters.. they got plenty of those in Canada but rather identify and filter out security hazards.. you might need in person interview.. but it should be alright.. I know even US immigration allows folks like that.. so can't imagine Canada being more stringent..

GCPlease - I am also in the same boat! RFE not yet received but looks like it could be for the photos. Its been over 8 days now. I did not get a notice for biometrics. It could be because we did our 485 biometrics just 8 months ago. Perhaps they will just use that.
Should I just send the photos in and see what happens without waiting for the actual RFE? Where did you send the photos? Same address as the docs that you sent?

There is a 15 day rule. if you call earlier, they are not gonna entertain you. I got my RFE after 3 days I opened the SR.
But call immediately after the 15 days because the time limit for you to send the rfe is 33 days and this clock starts from the time they say they have sent you the rfe (which you may have recived in an email notification or the online status). They did not extend this time period for me due to non-delivey.
The RFE they sent had the address we need to send the response. I think it was a different address.
The above said information is based on my experience. It may be be different with each case. you know how uscis is. just use it as a guideline.

Guysssssss N Gals , I got it (I-485 approval) 10 minutes ago!!!!!!!!!!! NO RFE. Recent Luds were on I-140 / I-129 / I-131 ( Luds occered on 10/29 & 11/4) . Been in USA (F1, H1) since Aug 1997.

Same thing happened to mine. USCIS will pick up the packages from the USPS the next day so don't panic. Check for another status update tonight or Monday night, I'm 100% sure it'll say "delivered" then.

Anyone who had good knowledge of AC21 same/similar, please reply.
My original labor has an annual salary of 50,000. My current salary is 95,000. I got an RFE to provide EVL. My job duties are mostly similar to that of the original labor. However job title is different.
is this a problem? My attorney is saying the salary differenence will cause an issue. He is asking me to convince my HR to add a range 50,000 - 95,000 as my salary, which i am sure my HR would be against doing that as it is a big company. I don't even want to ask them since they might think i am trying to do some kind of fraud and raise a red flag.

No matter how many years you are on H1B, 2 or 10..., you are out of status as soon as your employment ends. Unlike what many H1Bs think, there is no grace period. You have 10 days to pack your bags and leave. However to verify your employment USCIS uses paystubs, so if you immediately find another job and file for a new H1B before your current employer reports to the USCIS that you are no longer working you should be OK.
So first thing you need to keep in mind is do not fight with your current employer. He can screw you in more than one way.
Second, get a three year extension if you can.
Third, find a stable employer... I know many people here hate consultancy companies, but that is the safest option for you.
If you read the transcripts of the Q&A with lawyers, posted on the front page of this site, you will find answers to question about changing jobs when you have I-140 approved etc.

Same here...We received same FP fees rejected notice but checks are cashed. Our lawyer mailed the proof of cashed checks for 325 + 70. But to our surprise even before that we received appointment for FP.
I think this is common error on USCIS system. Most probably they will send you FP appointment notice. So relax..
I talked to my lawyer and they said the checks has been encashed. I talked to an IO, and he said that they did receive the $70. But I asked them why the status saying FP fee rejected. TO that he replied I dont see that. But since we have mailed you a notice, you go acheck the contect of the notice after you receive it.
But my lawyer send an info from AILA, which says that the USCIS is erroneously rejecting the cases inspite of sending the correct fees.
I dont know what to do ?

I am in a similiar situation. My 485 was approved and my wife got her physical GC but I did not get mine. I took Infopass and the IO raised a SR. My case is from CSC to NSC. I got a response to the SR that my GC was sent and it might have got lost in mail and to file I-90. I called uscis customer rep, talked to 2nd level IO who mentioned that my card was never created and he will raise a SR mentioning the same.
Today I got 2nd FP notice mentioning that I did not give FP for the first one (I gave FP ahead of the scheduled date and verified with FBI if my prints were uploaded or not) and to appear for FP on Jan 11th, 2011. I spoke with a IO on the day this FP notice was sent and IO asked me the date I gave FP and he mumbled some numbers and checked something in the system. He said he had fixed the issue and ignore the 2nd FP. He mentioned his name to me. I should have taken his extension as well. I hope I get the card now or else I need to take Infopass. I emailed nsscfollowup with the scanned copy of the first biometrics notice which has the stamp from the ASC last week only.
I have n't contacted senators and congressmen yet and did not email the scopsscata yet

You can apply for extension. Fees are not applicable for extension of status. If it involves status transfer e.g H4 to H1, then you need to pay the fees. I extended my wife, and daughters status just by filing the paper work and got the new I-94.
So if I m extending my H1 or H4, I dont need to pay any fees ? Can you explain exactly what extension you got with out paying the fee .

Completely agreee with hari_baby22. Couple of days back I posted that immigration voice could get a lot more donations if they publish there earnings/expenses report online and make everything transparent. Well here is what I have thought of doing if I get into your shoes when I140, US GC looks dicey. (I already have Canadian PR till August 2010).
I would take a three/four week vacation and go and live there. Prepare for a job and get first hand ground feeling of what it feels like living in Canada, make a living and raise a family. After all making a living to able to support yourself is a important corner stone thing. You can't live of fresh air.
Can you compare your situation ? No. You are not the same nature, skills, personality, intelligence and willingness as others and most of all your own Luck. You know yourself best and the only way you can tell that the place will work out for you is when you go get a sample for yourself and your gut feeling. I went to Vancouver and just loved the place. My wife saw the clouds and gloom and hates the place (spoilt by southern california). You will be your best judge.
Take the harshest sample: Winter is tough in Canada. Go now and take a feel of what you will be expecting and set your expectation.
Info: Approx 90% of the Canadian population lives within 100-200 miles north of the US border.
Down the road: Make a plan and see whats your options down the road. Looking back is no good way of planning for the future. 3 years + few months, you can be Canadian Citizen. You have then the option of using TN and come right back into the USA, if you even have the need. Looking back now I feel I should have started this journey 2 years back. In the next year or so I would be a Canadian and could have come right back without the 140 and 485 headache. After two years I am still holding my breath for 140. Rightfully, Heaven is where I feel at peace. US has made me feel miserable and bitter after 9 years of rough rollercoaster and no end in sight. Can't buy a house, can't live freely, always on the edge and mercy of the Boss and H1B.
Having Canadian PR in hand is like having a bird in your Hand, and US GC is like two birds in the bush (I feel the birds are in Bush in Texas :) and its going to eat me, rather than I eating it) You don't even have the US Bird in sight and the story is getting tougher....

Its been more than 30 days since i mailed my application and checks are not cashed yet.
I called the uscis support center last week and was told to wait.

My wife worked as a consultant for first half of 2008 with a desi employer as an employee (on W-2). After many calls and emails we received W-2 Thursday that has income and taxes of only first two months. Now he says that he showed remaining 4 months as his profit so he can only send 1099. Please advise if I can take any legal action against this employer.

Just tell him you are going to inform about this to IRS and see his reaction. If nothing happening call IRS and report. You can amend your Tax written for extension. So you wll get time till Oct 15h.

This is exactly what I said in my previous posts. EB2 India may become unavailable towards the end of September as most of the visas will be used in August itself and we will see a flood of approvals starting August 1st itself. I think most of the approvable cases are already processed by USCIS after it gave the data to DOS on July 8th. I think most of the straight forward and less complicated cases during 2004 - 2006 period will be approved soon.
I do not want to spoil the party fun but somewhere in my mind there is a lingering doubt. I read Ron Gotcher's post about August 2008 bulletin.

Lot of big law firms filed 485's around August 1st because the date for filing 485's was extended to August 17th. So I think these 485's are still unadjudicated. Once they get adjudicated there would be retrogression. Analysts analyze. However the silver lining would be removal of concurrent processing of I-140 and I-485 which may give some additional EB 2 numbers next year.

Mani, the advise given to you is to be on the safe side. Do not risk your GC process for just a few weeks of inconvenience.
Anyone EB AOS applicant can look for a job/take job BEFORE 180 days however you run a risk of your I-140 being revoked by the previous employer and USCIS will automatically deny your petition. If you are sure that the current employer will not revoke the I-140 petition, then you can do it before 180 days.
However, make sure that you inform USCIS that you're invoking AC21 and changing employer. You need to do that AFTER 180 days.
