Hi everybody,
I fail to understand how L1's are getting Green cards in 6-8 months. I have done my masters here and am waiting forever for my GC and here I met someone who has come here as a BPO devlpt manager for an Indian company and in 1 year after coming to the US gets his GC after 6 months of application. He is just a BCOM from India. On top of it he told me many of his friends in the same company and other Indian companies have got GC's in less than 6 months. I dont get it. On top of it his wife can work here on L2. How can they file under EB1 - isnt that meant for doctors and Phds? He is not even intelligent which is the saddest part. Here we are with education and exp and contributed much more to the govt here than they have and we wait for bulletins every month hoping it would move at least 15 days, getting our h1's extended everytime and dreading to go to India because of visa stamping each year. This is such a sad situation. Should not the DOL do something about this.

Im trying frantically to post this as a new thread but in vain . I would be ogliged if any1 of u can guide me through the process . Also not wasting further time i would like some info which is purely based on my discretion , but suggestion is well appreciated from u end .I would like to know wat r the things to be followed in h1 . Currently im facing issue with my h1 ie , my h1 was approved from this year lottery and it had a query which i have sent a letter to ins through my consultant , in aug but i have not recd any update so far . In short that forum story as follows :
On 6th Nov 2008....
He thought because of unemployment application, Two(2) Immigration Officers + One(1) State Police Officer came to my house a 6.00am in the morning questioning my �Legal Status� in this country.
But that found wrong reason as per his latest reply on 3rd Mar 2009....Immigration Officera turned to his door due to his Employer informed USCIS about his firing while revoking H1B.

I wonder why your lawyer is asking you to change the number of years. your hiring manager should be the one comming up with Job Description and Justification. May be he already has one and all you need to do is send it over to your lawyer

He would recommend either 2 year or 0 year work experience for this position with M.S. degree. Accordingly, we come down to 2 years with M.S. degree. After receiving the audit letter, my lawyer said I should have put 0 year instead of 2 years. I was also told by my lawyer to give him the answer about the following questions:
1. Why does the company require 2 years of work experience?
2. Why does the company require M.S. degree for this position?
3. Why does all skills and programs require for this position?
4. How long it take to obtain those skills and programs?

I do have a D70 as well as other AF and non-AF cameras and never had such problems before. I have backfocus-problems with all lenses on the D70. I ran some simple testing that confirmed this. In practice, this will only be a problem shoting faces wide open - but here, it's quite bad.

I am working in IT field. Technology or field does not matter. I have seen people who did MS in US also got 221g.
My only understanding is If it's a big company, then they are issuing visa, But not guranteed ...
But for small companies / consultants, There will be a definite query / admin process is waiting for you.
My case is very genuine... I am working for this company since 2005 and I am the only one H1B employee.
I got my eb-3 140 approved from this employer only ...
And my wage is always above the determineed wages in Labor / LCA ...No gap in paychecks ...
Compnay also in profit mode always ...
So they approved my h1 extn 2 times in the past and approved my 140 also. Now what the heck they got doubt in the employer ...

Hey Everyone,
My brother is a US citizen who has filed an I-130 for me and my family in May, 2008. We've traveled to the US on B1/B2 visas in February, 2009. The thing about it is that in the DS-156 form point "36. Has Anyone Ever Filed an Immigrant Visa Petition on Your Behalf?" we've answered "No". I've had no idea at that time that it was referring to the petition for alien relative. Anyways, we've returned back home in time. Also, I've had 3 visas before (2 tourist and 1 student) and never violated any immigration laws.
Then in December, 2009 we've applied for F-1 visa and got denied. This time it was a DS-160 form that we filled out which replaced the old DS-156 form. It didn't have that question about the petition anymore. I think they've decided to exclude it because a lot of people were confused by it. Anyways, the consulate officer didn't like the fact that I haven't transferred my credits from 2 courses of University that I've completed in my home country. Plus my major differed from my previous education course.
So my question is. Is it ok to apply for F-1 visa while I-130 is pending? I mean we've been issued B1/B2 visas before. Even though we've answered "No" to that question, they saw that I had a brother in the US who is a US citizen. I'm thinking of transferring my credits and using same major course this time or at least similar. This way in the eyes of the consulate officer it will look as I am going to the US to finish my education. The thing is, I am planning to attend community college first in order to finish general courses and then transfer to the university. My major in my home university was physics and this community college doesn't have it. I may go with "general education" course at the community college and explain to the consulate officer my situation.
Is it even legal to apply for F-1 visa while I-130 is pending? I believe so. My another question is. Once I finish education. What's the next step would be? I am in 7th year of H1b now..last time my h1b was renewed dates were until April 2008. I went to india in Dec 2006 and came back in Jan 2007. My passport was expiring on Sept 29th 2007 so Immigration officer dated my I-94 until sept 29th 2007 and told me same thing that you can go to any port of entery or international airport and meet USCIS officer and extend your I-94 with your new passport. I waited until last moment and around sept 24th I went to USCIS officer on airport as well as on Port of Entry (called Deffered Inspection site). Both places got answer you need to file extention online because we only correct mistakes and this is not a mistake but it was case of passport expiration. I called my lawyer, my hr, my company lawyer. Everyone told me I cant work after 29th sept as my i-94 is expiring. Thats same as your H1 expiring. SO either leave country and comeback with new stamping or file new h1b. I ended up filing new H1b as i had only couple of days left before my I-94 would have expired. I have filed I-485 and ead and my I-140 is pending. My pd is Dec 2003. As per my lawyer I want be out of status as mY I-485 is pending but I will loose eligibility to work as I wont have any work authorization once my I-94 expires and dont have EAD approved on my hand. The jury found that Alberto and Bernardo Pena, twin brothers from Brownsville, along with co-defendants had encouraged and induced 87 individuals from Gujarat to unlawfully enter US on temporary H-2B visas, knowing that the Indian nationals did not intend to work for the company that was used to get visas for them.
The brothers also knew that the visa-seekers did not intend to return to India when their 10-month visas expired, a statement said.
Pena twins also travelled to India to assist the Indian nationals with the application process and visited and corresponded with the US Consulate in Mumbai.
Two other co-defendants -- Mack Patel of Ft Worth and Rakesh Patel, a Houston pharmacist -- pleaded guilty for recruiting Indian citizens who were willing to pay $20,000 to $60,000 in exchange for visas to enter the United States

Current Status: Fingerprint fee rejected and notice mailed; case in suspense.
On August 21, 2007, we rejected your fingerprint fee and mailed you instructions for how to submit the necessary payment. This case is now in suspense.
Please submit your payment with our notice as soon as possible after you receive our notice so we may resume processing of this case.
But USCIS cashed my checks i didn't know what went worng the total amount i paid is 325+70,170,180.
Did any guys get same kind of problem?

I filed mine on May 12 and sent to Phoenix Lock box and had the same issue. My checks are not cashed and am going through the same pain as you do. My lawyer suggested its not unusual to have these delays and it could take upto 4 weeks for the receipt notice to come. I am still tensed as the checks are not cashed and there is no receipt for the renewal. Please let me know how you are proceeding or find any new info

I think the new name check change, will help the system work FIFO.
This is what the system is intended to do.
Also, as time goes by, this will make the PD more transparent, so instead of having dreams and making wild guesses, there can be somewhat logical guessing.
I know it is not possible as it is USCIS and anything can be true.
But i am really happy for people with older PD's who have been struck with FBI Name checks.
Please help IV with the letter campaign and also lets get together and try to make the system more transparent and open.

I don't know exactly what AC 21 regulations are.I just want to follow any best Lawyer's advice in this matter.
The term Technical Recruiter is very generic This job can be done by any person who doesn't have any technical background .But If a person with good technical skills will bring more value to the company.
The area which i'm focussing is basically IT Sales.Company which is offering me this Technical recruiter position is impressed with my technical back ground and hiring me.They are actually looking for some one who is very senior and having good amount of experience with Technical back ground specially ERP Packages.The role is also not confined to just recruiting but meeting the clients and bidding the tech support and new impementations for the company.
I personally see lot of career growth in this path.But unfortunately there is nothing one can do in this matter.
