There was a soft LUD on mine as well as on my wife's I-485 :D. Mine was filed in NSC on July 2nd 2007 and transferred to CSC for receipts and transferred back to NSC :confused:. Currently mine is not within the priority date :confused: . Not sure why there is sudden LUD this month :eek:.

I have a question for you. You said in your post below that your 485 was approved end of september 2008. But I thought the visa numbers were already exhausted by august 21 2008 for eb2 india. Are u sure you got approved in end of September 2008 and not in august, did you actually get an email end of september or your LUD on 485 was actually end of september. China eb3 may move but not india eb3. there are too many of them. i dont think there will be any cir or things like it passed this year. there is already however several bills writting to resolve but with eb3 world and rest doing just fine, why would the congress want to do something for india. i would be very surprised if they did

Sen. Edward M. Kennedy (D-Mass.) joined a chorus of immigrant advocacy groups in condemning the Bush administration's plan to charge legal immigrants significantly more money to obtain green cards, adjust their residency status and bring relatives to the United States.
Under the plan, announced yesterday by Emilio Gonzalez, director of U.S. Citizenship and Immigration Services, the government would charge $905 -- up from $325 -- to apply for a green card or to adjust residency status. Immigrants with green cards would have to pay $595 to become naturalized citizens, a $265 increase. The cost of bringing a foreign fiance to the United States would more than double, to $455.
USCIS has long been plagued by an application backlog, slow processing by poorly trained personnel and an inability to track applications for people. The agency receives no money from Congress and passes on most costs to applicants. A highly critical 2004 Government Accountability Office report said that the agency's fees did not cover its costs.
Gonzalez said the increase would pay for better facilities, more workers and more training so that applications can be processed faster and by a more courteous and professional staff. He said the improvements would help USCIS cope with a guest-worker program should Congress approve some type of comprehensive immigration reform.
The fee increases will be published today in the Federal Register, beginning a two-month comment period. USCIS expects to process nearly 5 million applications in the 2008-2009 fiscal year.

You have already got your case approved. Then why do you mention " ... shall we all unite and file the applications ..." This is like Al Gore wasting energy in his own office and preaching to the world to reduce global warming.
I dont see any merit in your suggestion. Rather to the cynical eye, it all seems sinister.
I understand that there is lot of fear among applicants that USCIS might retrogress the dates interimly sometime in july due to the expected high volume of applications filing in the begining of july.
To minimize the chance of USCIS from taking any such steps, shall we all unite and file the applications on a specific date in july probably on 30th of july? This will accomodate all applicants...so that we shall all be winners and use this opportunity to our advantage instead of competing amongst each other...where only a few will be winners and others will be loosers.
This will also reduce the pressure among applicants , attorneys and doctors.
Can the AILA cooperate? Will there be unity amongst applicants to make this possible??? any ideas ??

I'm not sure how voting on this site is going to improve the chances of this bill. It is simply an application site 2 companies have created. It does not do us any good by voting on such site. You are right that spill over of 23020 visas from family based category contributed to movements in EB2 categories, however that was not the only spill over that happened. There were 12144 unused visas in EB-4 and EB-5 category which also spilled over. You could argue that those visas spill over to EB-1, however EB-1 had usage of 36591 visas last year compared to maximum allocation of 40040 visas which meeans that EB-1 also had 3449 unused visas. This means that there was a spill over of 15593 visas just from EB-4,EB-5 and EB-1 category.
So there will definately be some spill over this year if you assume same usage level as last year. How much? I am not sure yet.

What has happened here is extremely unfortunate. What I would recommend is that you file a new PERM application. You could appeal the decision, but considering the complications of your course work and degree, it would be an uphill fight. In your appeal, I dont believe that the case would have much merit if it fought purely on the basis of your attorney saying that "he marked the incorrect box".

What has happened here is extremely unfortunate. What I would recommend is that you file a new PERM application. The only time I have had to deal with the Houston Consulate (or any Indian Consualate in the US) was last year when I needed a new/renewed passport. Sent it by mail and received it back in 1 week. I really can't complain since it's the best experience I have had with any consulate.
I applied for a UK visa, and they stuck someone else's visa in my passport. To call them, there's only a paid line for 99c a minute, even if it's their fault. And I was put on hold for 15 mins.
Applied for a Canadian visa, 3 mnths in advance of my trip. When I asked after 3 weeks, they told me pretty rudely that of I enquire about the status, it'll take even longer to process. (This is a tactic I would love to use with my boss whenever he asks about the status of things I'm working on) :) Finally processed it in 2.5 months. This was a simple single entry for 4 days.
Applied for a schengen visa(Germany), they took 3 weeks to process a simple business visa. Sent back my documents saying that I didn't have coverage for repatriation of corpse should I die in Europe, even though my policy clearly had it and this was verified when I presented the documents in person at the consulate. Schengen countries demand that you apply in person, because they want to make sure you have the face for going to Europe.
I have a Dutch friend whose Indian wife took 3 mnths to get a visitor visa. This is because he complained to the Dutch foreign ministry when her visa wasn't done in 3 weeks. He was outraged that the wife of a Dutch citizen should be treated by his govt. like that. Oh well, they showed him.
So given all this, I would assume that all embassies/consulates are inefficient, simply because they are government workers who are not answerable to anyone and can't get fired. And they work in a monopoly.
Of course, we like to think Indian babus are either stupid, lazy, corrupt or a combination of the above because it's a mindset we have. But looking at how USCIS and the embassies above operate, I think Indians are pretty much on par with everyone else.

That is why I have said "most" and not all. You are right I do not have any proof or data (but I am sure IV does) , try scanning any of the threads and you will see what I stated is very obvious.
If this post instigated you then you are not as thick skinned as some of your EB2 peers and hopefully will join the bandwagon of Donors soon.
My bitterness is the same for EB3's who do not do much other than posting on threads but I think (no proof again) there are more EB3 donors in the Donor threads than EB2's.
Agreed that I haven't contributed (yet) but that's a mighty big acquisition from your end on calling all of us EB2's free riders without any considerable data to prove it.
I think it's within our best interests to remain united until things are straightened up but I sure can understand your bitterness and hope the best for you too.

That may be but do you actually think this practice is fair and should be legal. To me and hundreds of thousands of other folks who are patiently waiting in line, it is fraud because you are cutting in line. The sad part is we see that you are cutting in line but we can't do s**t about it just because it's legal.
