Does anyone know whats the protocol for the Bill to be passed???
After the Floor Debate the bill goes to White House or again there has to some measures taken from Senate???? I know there some initiative taken in Senate (last year)..
I am just trying to check if there is any timeline on how and when this bill will be passed.. :rolleyes:

There is a section in 485 application to list your spouse and dependents. Talk to a good lawyer to see if you can still add her. Or you can live in india until you figure out a way to bring her here on student visa or something.

- Consulted my lawyer and went thru all docs they submitted as part of my I140 package. On my last employer experience, found out that I had submitted only one affidavit from a co-worker and that would cover for less than 60 months of experience at my last my place.
- Came up with a list of some 30+ documents that include paystubs from US/India, W2/Form16's, letters submitted to CIS by previous company for new H1b back in 2003 and then for an extn in 2006, appreciation letters and other material on previous company letterhead. Discussed this with my lawyer
- Lawyer is of the opinion that we can prove our case of alternate evidence based on documents i am producing.
- Plan is to submit an affidavit from me that i was unable to get an exp. letter from my previous employer mentioning reasons on why its not possible, submit 2 affidavits from ex co-workers covering span of 63 months.
Based on your scenario or known people, can one of you respond to how should i approach following issues:
1) I am going to draft content for experience letter non-availability. I have mail trail from last 1 year following up on asking for details of $12K. Same mail mentions that am asking for experience letter and provident fund amount back from HR. Will it be a good idea to attach deputation letter mentioning 5 lac indian rupee to be paid for breach of terms and a 100 rupee bond paper contents which i signed before US deputation. Will it be Ok to mention that previous employer is asking for $12K settlement amount to provide experience letter and attach copies of bond and deputation note OR only mention that am unable to get experience letter and i have been following up with HR for last 1 year and attach email trail as evidence. Any pros and cons from CIS perspective on which approach to choose.

Thanks! I have visited this web site before. Now my doubt is, if I show my EAD as a proof for the status, I am worried about they will give DL only for 3 months i-e till the validity of EAD. Then I have to go again to DMV after 3 months to renew again for another 9 monts validity of new EAD. This is pain in bu--, as it continue till I get GC. Due to the retrogression, I do not know when I will get GC.

I got my FP done on 11/21.I did open a SR on 10/05, based on which I got my FP notice on 11/06.
My details:
485 filed at NSC on July 6th
Receipting done by CSC on 09/05, EAD and AP sent by CSC
485 pending at NSC
Looks like they have started the FPs for transferred cases like ours...
I haven't got my FP Notice yet! No SR opened.
Is there any NSC-CSC-NSC filer who got FP notice without opening a SR?

I donot see any point in paying off the house, as you can deduct the interest to get some tax benefits. Why loose any benefit you can get.
On the other hand, use the money you were thinking of paying off the home for investments. Investments may it be CDs or stocks ( though right will come in future).
Although personally i have never bought a brand new car in US. Car depreciation is biggest loss one can take; we just bought a 5 th car...all cash paid and it is used.
Keep your cash, play with 20-30% based on your risk apt, donot pay off your home...cash is king.
On your comment of " being a novice in financial "...i have to say it Everyone is a novice in every matter, we all learn it here. Rather one who says he/she is a novice will make cautious decisions; i am wary of so called experts/gurus who mauled financial markets and still call themselves experts.
Start reading finance articles, blogs and you will be able to understand.

As far as contacting AILA goes, could we have someone from core who knows them come forward and help us voice our concerns if we're able to gather some support for this?
This can turn into an ugly backlog pretty soon if nothing gets done about it. I read last month that they had 146k pending I-140 cases.
My point is not TSC or NSC - my point is we all sufferers should now unite and create pressure. I cant do alone , you cant do alone.

One thing i dont follow in your post how EB3 becoming U affect Processing times of I-140 ? I-140 doesn't depend on "Country of Origin" or "Retrogression".

But back to topic - you will get hired for a paying job based on a combination of your talent, knowledge, and experience. Show them what you can do or have done. My personal situation: I was on F1 visa for 6 years before I started LC process with a company for a totally unrelated to my field of studies position (EB3). We had PERM approved and filed I-140, with me still on F1. I-140 was approved and now we are stuck in retrogression. Meanwhile, and after I-140 was approved, I graduated and applied for H1B based on my major. I have disclosed on H1B application that I have I-140 approved from another company and attached a copy. Not a question asked. H1B was approved within 9 days (cap exempt). And there's more. Because I violated my F1 status years ago by accepting unauthorized employment (tracable through taxes), my lawer told me to leave the country and re-enter, to cut the tail clean and be eligable for adjustment of status when the quotas open up. I went to Canada, and applied for H1B visa stamp, disclosing on the applicqation that I have I-140 approved and have violated my visa terms previously ("yes" to question 38, in "kiss of death" section of the application). Very stressful time that was. But in the end - no problem, got the stamp and was back in two days.
Anyway, sorry for the long post. I hope this helps.

I am in the same boat, My I-485 was approved on Aug 5th, so far no cards received.
Also, i received SR (which i opened on 8/3) response 2 weeks back "saying my I-485 was approved and my application is waiting for bio-metrics for whichi will receive an ASC appointment later" so far i have not received bio-metrics appointment either.
I guess, i should wait for 30 days and take an info pass or open a SR.

You have to stick to Software Engineer field in order to take advantage of PD recapture. If you move to Business Development using MBA than its hard to justify same or similar. Find a new job which requires EB2 and show BS+5 to qualify.

OTOH PD recapture does NOT require you to be in the same/similar job.You can file a new LC for the bizdev position, and when filing I-140 request older PD is ported over. Then 'interfile' this new I-140 into the old one on your existing I-485.
