    Hi

    I work as independant consultant as aslways have risk of no assignment for shorter term.

    This is what i do - see if it helps
    - Create emergency fund for 3/6 months if you dont have already one in place.
    Atleast 3 months, depends on how much one feel secure / confident to getting another assignment/job in case of job lost

    - Open/get approve HELOC -
    dont use untill necessary - if any further emergency you can tap that always

    - Start paying the mortgage as additional principal some part of your surplus (even $100) every month which helps you get higher limit of HELOC at later date

    My wifes' application is in the same situation (though mine is clear). I sent (through attorney) proof of check encashment from the bank and also a new check for $70.

    Attoney gave these options

    1) Send ONLY proof of check encashment - This could lead to delay in Processing till they find the locate the missing check and account it

    2) Send proof of check + $70 - They may or may not encash the new check. If they resolve the issue without encashing the new check, it's well and good. If they do encash it and the issue is resolved - well, it's still better than her application getting rejected over $70 [ Of course MTR and other actions can be taken, but didn't think it was worth it]

    Attorney response has reached them. Waiting for the change in her application status ( God only knows when it'll get changed)

    Due diligence
    Send a Certified email with receipt /delivery acknowledgment to the employer with your request. Prepare a proper trail of documentation. If the employer does not relent, report the same to IRS after consultation with a tax consultant.

    I didn't send a certified mail but I have a reply to my email saying that they didn't received the statements from the Insurance Company and we can still report those missing wages without a W2 from the company.

    Can we use this as a proof of contacting employer requesting for a corrected W2?
    Or
    Do you still recommend us to send a certified mail? so, first thing Tuesday morning I can do that.

    Murthy's lawyer suggested Consular processing as an option.

    She explained that in Consular processing I still need continued Sponsorship from my firm, but it will revoke my 485 application. I will end up filling bunch of forms with USCI, including 824.

    This was my PD will remain intact and when it becomes current, I will have to go to Indian Consulate and get Immigrant Visa from there.

    IN this whole process My firm needs to continue sponsor my GC processing. Advantage is : I don't have to come and renew my EAD and AP every year.
    If you really want to maintain your PD, you can go for CP while studying. After school finishes, if need be, you can always come back on H1 again before your GC is complete. This way you will have both options Europe and USA !!

    Right now we don't have any savings, paid off the car as of Oct 30th. I was trying to figure about the money which we are going to save from here on...I will take all your advice, sounds so logical and keep the emergency fund for 6 months aside.
    Coming to the city we live, it's a small place in Florida and not many employment opputunities for techie people. Like I said I am working for state while my spouse is consulting and travels every week (can't find a job in his area). We never imagined a management change leading to a risky and frustrating job situation, making us to repent our buying a house. Because the moment I stop impressing this new boss, we are out. Huh...I don't want to imagine that, because we will be left with a house we can't sell or rent (don't know if some one would want to rent it) and have to move.

    Thanks all for your time and advice. Let's keep it coming...

    My I-140 was never approved..

    there was a first RFE for my exp letters,

    and then there was an enquiry against Employer
    and then RFE for A2P
    and after answering A@P it is denied.

    while it was pending, during July07 fiasco we applied for I-485.

    Do you know why there was an inquiry against Employer?

    A lot of times.. companies use this bugaboo of job desc etc.. Those that want to promote you badly enough will find a way.. First of all.. What your job title is v/s what labor is filed under is not directly related.. Secondly you can have matrix responsibilities that span across 2 bands etc.. So lot of times it's an excuse to not have to let you down hard way.. always easier to blame on that "damn immigration queue"

    Democrats want to win Presidential election and increase their numbers in congress based on Iraq and Immigration. They are thinking that if CIR is passed they can project that it is Democratic congress which passed CIR. If they fail they will blame that Republicans voted against and they will make this as election issue. They are thinking in that way. But it will not work. People are against big immigration numbers but they will not oppose moderate immigration increase. But American people are divided when it comes to illegal immigration. If any other issue is burning then immigration will become non issue and democrats will not get any extra votes because of CIR. But liberal immigration is not good for Labor unions(we know democrats are pro-labor also) so that may work against Democrats. Right now it is not sure whether parties are really dedicated to pass CIR or Just for making immigration alive to get political mileage.

    We all come to this site and give our interpretation of the situation, but the whole situation is so funny isnt it.

    A writes something then b responds, c comes in an says something but the finally nothing is achieved.

    The congressmen do what they want, our effort of conversation is useless.
    We should come together and raise our voice somewhere were it can be heard.

    I dont think by sending emails to these congressmen about our situation will be that effective, most of them dont know or dont care. We should come out onto the constitution ave in DC and let our voice be heard by the masses, then the media will know, the common man will know, the companies will know, the congressmen will know, this will also help the lobbyists to fight for our reforms who benefit more than us.

    I joined recently but I am sorry to say that by donations from people, a few people IV core cannot lobby our issues. There are lot of us who are suffering, even 200 people on washington ave will effect. Slowly more will join,

    I did. Changed to same/similar job (exact same description). Old employer not revoking I-140. lawyer has asked me not to send AC-21 letter to USCIS, wait for the RFE, if any. so sitting tight.
    Moved from H1 to EAD.

    It would be a smart choice to accept those application, but based on USCIS recent behaviors, I really doubt their decision makers have that intelligence to make such a smart choice.

    Actually its possible but my firm is against it. Firm is saying there are tax complications for them. If I move work location to Canada they will put me on Canadian Payroll, and will not renew H1B. They are ok with continuing GC however but if I need to travel to US then I will need to apply for tourist visa (B1/B2).

    Try the following:
    1. Send all the documents that are requested to the field office one more time with FedEx signature confirmation. Take InfoPass appointment and fly to the field office and see what's going on.

    2. Find your local congressman/woman by using Zip Code. Call him/her and speak to person in charge of immigration matters. Take an appointment or send them all your case details and copy of all the documents. They will follow it up generally with the agency. Also, send a personal letter describing about the hardships that you are facing because of this delay.

    3. Send the same package to both the senators of your state. Follow up with them by making a phone call and personal appointment.

    4. Check with your employer if they have wage issues with DOL or tax issues with IRS or other RFE cases like yours in the past. Ask them if these are resolved.


    The seattle, WA office or any other local office doesnt accept form I907 (which is for PP). After my case transfered to seattle, WA my employer tried to convert into PP. He sent it to USCIS, CA they said it is not with them so they can not accept it. Then he sent it to Seattle, WA with all the letters attached. The seattle office rejected the 907 saying they dont accept 907 in their office.

    I am in 9th year extension with priority date 09/2002.

    My I-140 denied on 06/18/08n and immediately I485 also denied.:mad:

    I have Visa vailid till Jan09.

    1.If I change employer and able to get labor cleared before jan09 , can I apply for I140 PP and get H1B exension.

    2.Is the Priority date transferrable if I change the employer?
