USCIS cannot reject PERM as USCIS has nothing to do with PERM. PERM is done by the dept of labor, and this agency is not part of USCIS.
In terms of PERM, PERM is not considered an "immigrant petition" and thus would not be deemed as violation of status. PERM is berely the assurance there is no workers who want to take the job in the position beeing sought. Note, that when you go for a visa, one of the questions asked is, Have you ever filed an immigrant visa petions, or has an immigrant visa petiion was ever filed on your behalf?"

Yes - Good Lawyers Take that much ... About $1500. Lawyer Fees.. 1200 Bucks, Educations Evaluation 200 Bucks, Postage 100 Bucks.
I can get it done for $500 bucks, But Would you want your H1b to be done in Hyd/B'lore/BBy.. by some one who does not have clue ?... I don't think so.

Movie is not focused on H1b quota. It would tell common public the real side stories of H1 people as they are focused now as job stealers (is wrong). The odds of that and how they struggle on H1 etc.

Do not get me wrong - I do not expect the IV activists to jump on the "ideas" I posts. They have done more than enough and have said that many times. Just one thing was not properly handled in my opinion - the backlog issue. There is no excuse for the Immigration dept for this backlog. This is a simple clerk's job which they screwed. IV as a an organization should clearly state it and insist on fast resolution by the respective authorities, not just foggy promises.
But it is time for the "grassroots" to start thinking and acting, not just waiting for someone else to do it for them. That is why I keep this conversation going and suggest "ideas".
Again, thanks for the good job done by the core team and volunteers done until now. Unfortunately this is just a beginnig of a long jurney...

I have my I-140 approved from previous employer , and my labor for the current employer is stuck at BEC center. Can i get a three year extension on my H1b ? OR the I-140 has to be from the current employer?

my LUD for I-485 did not change since 8/28 even after my FP is done.
Today I got email regd EAD that the card production ordered.
called FBI Helpdesk and she told me that over weekend(sat 9/22) then have sent the approved file to USCIS. May be USCIS is lost my file somewhere.

I do not want to spoil the party fun but somewhere in my mind there is a lingering doubt. I read Ron Gotcher's post about August 2008 bulletin.

This is my opinion. TSC 485 processing time is July 17,2007. NSC 485 processing cut off date is July 28th, 2007. I don't know if CSC is still processing 485 EB applications but CSC EB processing cut off date on its website is April 04, 2006. The priority date for June 2007 bulletin was April 1st2004.
Lot of big law firms filed 485's around August 1st because the date for filing 485's was extended to August 17th. So I think these 485's are still unadjudicated. Once they get adjudicated there would be retrogression. Analysts analyze. However the silver lining would be removal of concurrent processing of I-140 and I-485 which may give some additional EB 2 numbers next year.

Any number lesser than 800,000 is good for us.. doesnt mean all is well.. we have to continue in our efforts with IV and we could have a better breakthrough..
Anything less than 800,000 is good... even a few hundred thousand less :) There's still a lot of work and patience required but a good news is a good news nevertheless.

Also, consulate-provided certificates cannot be accepted as primary evidence. They can be used as secondary evidence along with school certificates, etc. Primary evidence is either copy of original birth certificate or affidavits or a combination of both.

It is interesting......why does congressman/senatorial inquiry works for some and not for some. What can we do differently. I sent out a "Thanks...but no thanks" email back to Congressman's office.
I mentioned that I expected that a congressman's inquiry will at least make TSC to look into the case and do a due diligence but not throw the same reply that they'd to individual inquiry.
There is a saying in Hindi...
"Jab kismat hi hai gandu to kya karega pandu"

I was waiting for my H1 Approval and that didnt turn up in time before my current one expired. (Thx to Extremely Efficient USCIS) The State revoked my Spouse's license and she was told that she cant drive till she produce a document that states we are legal here.
Fortunately they accepted my receipt notice and gave her 90 addl days to prove our Legal Status. What a Hassle...
I was waiting for my H1 Approval and that didnt turn up in time before my current one expired. (Thx to Extremely Efficient USCIS) The State revoked my Spouse's license and she was told that she cant drive till she produce a document that states we are legal here.

I work as independant consultant as aslways have risk of no assignment for shorter term.
This is what i do - see if it helps
- Create emergency fund for 3/6 months if you dont have already one in place.
Atleast 3 months, depends on how much one feel secure / confident to getting another assignment/job in case of job lost
- Open/get approve HELOC -
dont use untill necessary - if any further emergency you can tap that always
- Start paying the mortgage as additional principal some part of your surplus (even $100) every month which helps you get higher limit of HELOC at later date
