My wife changed her job after getting H1B transfer receipt. Her previous H1B is not expired or revoked. After one month with new employer, her H1B is denied. We didn't appeal, but immediately filed new H1B with another employer and give paystub of the denied employer with all details. She got her H1B approved with the latest employer. This happened 4 years back.
So, if H1B denied, you can file appeal or find a new job and file new petition ASAP.

Before Sep 2009 it was two minutes time to take LCA. Now it takes 1 week time to approve LCA. We never heard about Employer-Employee relationship before 2010.

All we can do is request and lobby.If senate feels right,they can pass a legislation.We can ask and lobby for it at least.
As it turns out,even EAD is not helpful as it has several issues which dont give you the total independence to do what you intend to.

If company is promoting and Apply for EB2, then the PD should be Promotion Date. Because EB2 qualification starts only after promotion. One cannot go back and get old PD and attach it to EB2 after promotion. That is unfair to people, who are already promoted and applied before. Hope this makes sense.

They filed it and waiting for approval.Once I get labor and 140, yes I will use EB-2 and take the promotion. How is this become an abuse, can you expalin? In my view if you get an offer for the future job in EB-2 category and not use that opportunity then that is called abusing yourself not the law.

Actual number of EB visas issued: 154,458
Check Immigrant visas FY 2007 (http://www.travel.state.gov/pdf/FY07AnnualReportTableV.pdf)
That is true. but it only happened because of the aggressive Visa Date setting of DOS and hence the Visa Fiasco..

I got FP notice on 8/14 with appointment date on AUG 31. My application received on 7/2 and notice date of 8/2.
NSC sent the notice to me and to my attorney.

If someone has EB2 application, and EB2 is unavailable, but their EB2 PD is current with respect to EB3 visa bulletin date, will USCIS allow an EB2 to take an EB3 slot?
If not I wonder whether you can "down grade" by interfiling a new I140.

Below is data of PD from last four years for EB2-I - only for Jun, Jul & Aug.
Except July Fiasco , I don't see dates ever moving forward in July VB; but they do move in August VB.
Has anything changed in spillover laws in last 1 year - which will explain this no movement in July but in August?

What do you mean by "new system"?
If you want to wait until approval, file H-1B premium. If you have skills and its "bonafide job", not much risk for H-1B denial. Note, H-1B visa is not for speculative employment.
