    It's just a caution. Some people would like to take it slowly but surely, some people love to run fast with a risk of stumbling in the middle. Whichever you go, the finish line is always the same.

    All I am saying is if you wish the fast route with the risk of stumbling, then go for it. If not, try the slow but sure route.

    I understand that your intention is to get heard. I appreciate your effort at writing letter. However writing to the president will not help us much. Here is why:
    In the USA, infact for that matter in most democracies, Laws are made by elected representatives unless it is an executive order to grant an immediate relief.

    The composition and powers of the House and the Senate are established in Article One of the Constitution. The major power of the House is to pass federal legislation that affects the entire country, although its bills must also be passed by the Senate and further agreed to by the President before becoming law (unless both the House and Senate re-pass the legislation with a two-thirds majority in each chamber). The total number of voting representatives is fixed by law at no more than 435.[1] (United States congressional apportionment - Wikipedia, the free encyclopedia (http://en.wikipedia.org/wiki/United_States_congressional_apportionment))

    So, In our case, the president at the most can sympathise with our cause and the hardships we face because of the limbo, But he cannot really help until there is a bill that passes both the house and the senate.

    So, Can I suggest that it will be even more worthwhile if you contact your congressman/woman and go meet them. We need them to understand our plight and anguish.

    We all need to go meet our lawmakers, educate them.

    They already are educated. Do you think they do not know about us?
    They fully know about us. But they will not help us because we are not voters and cannot contribute.
    A better idea is to have our employers contact them. People working in large companies can do this. I am surprised why the big companies have not taken up this issue for us. Why cannot we have big companies issues statements in our favor?

    Got the approval notice today :) "Welcome to the United States of America" - ironically i have been in this country for a decade now! finally the "welcome" :)

    It has been a very long journey!!! and a very frustrating one for the last few years... but the feeling that I now get is really liberating... first thing I did was thanked God for ending the seemingly endless wait that me and my wife (she didn't care as much) were in.

    I'm already thinking of the things I want to do after this new found liberation... it includes showing the middle finger to those who have taken undue advantage of my status :cool: :D and i'm not taking it anymore... I'll be a new person starting Monday!

    Just so there is no confusion... my PD was Feb 2003 EB3 but my wife's PD was EB2 April 2004... we got our freedom through her application. If anyone needs more info on how/what/when - i can share that (it had its up's and downs - mainly downs, but all's well that ends well)!

    Lastly as a token of my real support to the cause of IV I will be donating a small amount. I have donated in the past... I have participated in conversations in the past... I was not so active on other fronts but I truly believe in this organizations effort to help the community. And God willing each one of you will get this freedom soon! God Bless!

    Good to see nice welcome gesture from you.

    You did not earn red mark...my comments were more on humane side to not worry too much about anything.
    You are right, we need to be cautious, lest things go wrong and feel sorry later. You (IV) all are doing great work. I love this site.

    I fully agree with you we all are frustrated with this mess, but my idea is...For many things as many can go wrong....there will be equal if not more things turning right.



    Off topic...here is a question for you, how does one becomes a member from junior member and so forth.

    You put it in excellent words. Hopefully we see more diversity in future &
    concerted effort to get to it.

    The IV is about issues/problems of employment based immigrants, and the goal is to get support as much as possible from every corner in this country to further the cause. Everyone who supports this cause fit in to some category (within legal limits - pro, anti, this group, that lobby, this ethincity, that nationality, etc.), and that does not mean we are promoting something or have preferences for a group. In my opinion any support (with in the legal framework) to the cause of IV from any corner in this country is welcome and should be appreciated.

    Our FP were sent back to USCIS the same day - 10/1/07.

    What does this mean. The lady didnt have any information on name check. Seems like there is no way of knowing anything about name check!:mad:

    Yeah sadly, there is no way to know. Even I am desperate to find out how one can know if they have cleared name check. I happened to know this from my friend - Get an infopass appointment and maybe an immigration officer might be willing to help you. I don't know how far this is possible since I HAVE NOT TRIED IT. But could be one of the options. More discussions from other experts might help.

    I listen to him frequently. I'd strongly recommend not contacting him. Even if he is pro legal immigration, he is very moody and could say something bad that we don't want to hear. He likes Indians but hates Chinese. He also hates Tabla by the way!

    Sean Hannity could be a better option.

    I don't know much about Labor Subs to answer...what I did notice is that your lawyer is through company...not going to generalize, but with company lawyers you really should question them and not believe totally what they say....meaning do your own research too. Company lawyer's are interested in keeping employees longer at company and can sometimes push you to do things to cause that. I don't know why you can't have 2 I 140's. But withdrawing your first one would invalidate your 485/ead and depending on your priority date (which would be 2007/2008) and country of birth, you may not have a chance to apply for 485 for a long long time (meaning stuck in same job for long long time...). Again I don't know much about labor subs, my advice is to do your own reasearch, get answers, opinions, and not just take company's lawyers word on everything.

    You are right! This is our company lawyers. They are very bureaucratic and always says as per company policy...Here is their response that why they have to withdraw:

    "1. An I-140 is a statement the employer makes to the immigration service regarding what job the beneficiary will be performing. We filed an I-140 LC Sub petition on your behalf stating that you will be working in a XXXX position. We will not file another petition stating that you will be working in another position / occupation XXXX without withdrawing the first statement (I-140 LC Sub).

    2. If we file the I-140 based on the LC-PERM, we would interfile it into your pending AOS, so your AOS would be pending based on the pending I-140 (NOT the withdrawn LC Sub)."

    I know that their first point is all "BS"...am going to fight this with my Manager. But, the second point am not sure.

    Is it possible to interfile if the PD is not current? My pending LC SUB and the PERM LC PD, both are not current. Please confirm whether it is true or not. This will help me make my case.

    Guys, I wanted to circle back and update you on the results. My I140 was approved today and this is what i had submitted as alternate evidence. Hope someone else will benefit from the details I am putting here.
    Thanks to you all who took time to reply and assist me on this issue.

    Documents submitted:
    > Experience letter non-availability as an affidavit mentioning that we tried but previous employer did not provide the letter.
    > Email trail of communication with ex-employer detailing communication asking for exp. letter.
    > 2 affidavits from previous co-workers detailing job responsibilities, skills, dates employed together.
    > For 63 months of last employer experience, paystubs, W2's, Indian Form 16's, Indian IT returns, yearly appraisal letters, other evidence related to employment(not all but whatever was available).

    RFE was :
    Asked for evidence to prove 60 months of experience as listed in PERM.

    Guys I had posted this yesterday IV is a non-profit. Check the video below - there is nothing to hide:

    The fact that IV is helping Donors is because all its activities are only possible because of Donors, and we are still short of funding. If this was for all for free, then no campaign could be acheived.
    And believe it or not , we get a lot of spam and rogue users visiting IV.

    BTW I am not in IV management

    We need you and a lot more to join. I can't believe you cannot trust IV a non-profit organization with even $25

    I know Immigration voice is not for profit organization and it is doing a great job.

    My intention is not to belittle IV, my intention is just to express my opinion as a user, most of the problem will be solved if the links are not shown to non members if they are not allowed to see the content.

    I just saw your post in YouTube, it is very informative.
