1. I am working part time on EAD with my sponsoring company and full time with other company under different position and less requirements than labor certification. I want to leave full time company and want to open a business firm. Is this okay? Along with my own business do I have to work for sponsoring company?
2. My daughter is going to college next year. Is she considered as international student or in state student? Her 485-I is pending under my derivative. She do have EAD and ss.
3. If my daughter turns in 21 years before our green card comes, then will she have any problems in getting GC?

Buddy, what were you doing for 40 days after your got terminated? If you knew it was coming you should have made efforts to transfer H1 or right after. If you transfer H1, then obviously INS will look for pay stubs etc from the last sponsoring co. Since you mentioned you never actually worked for them (if I understand this right) then you are in trouble. You can use EAD but you lose your H1 status. If you want to get back to H1 then you are back in the lottery mess to qualify for one. Obviously you need to decide what is important to you at this point. Marriage or your job/GC. Good luck.
I was in India and didn't know about it. As soon as I came to know I was under the impression it was easier to switch back and forth between EAD and H1 except that I may have to go to the consulate for visa.

Chandu is one of the active folks/volunteers who is helping us more that we are helping ourselves... His push and constant nagging are coming as +ve reminder who couldn't send letter due to hectic schedule or are still Procrastinating ( there is a huge chunk of people like this ) . At the same time there are a certain gang of folks who will never send letter , never support anything - just eat the fruit of other's labor and be proud and happy !!!
My personal request to Chandu would be - Pls continue the push and nag but keep it above the beltline. Let's not create 5 threads but do the push 5 times in 1 thread.

At times, people just need a push. When they see 5 therads with bold topics, they do feel the push otherwise - people just carry on with hectic schedules and forget to do it even though they intended to do it.

I am stopping with these, but it would be great if members take it up from here.

Below is data of PD from last four years for EB2-I - only for Jun, Jul & Aug.
Except July Fiasco , I don't see dates ever moving forward in July VB; but they do move in August VB.
Has anything changed in spillover laws in last 1 year - which will explain this no movement in July but in August?

Got following email today on my daughters case today. NSC July Filer. EB2 I Mar 2006.
All our cases show this status now.
Any idea what happens next?
Current Status: This case is now pending at the office to which it was transferred. The I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS was transferred and is now pending standard processing at a USCIS office. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address. We process cases in the order we receive them. You can use our processing dates to estimate when this case will be done, counting from when USCIS received it. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case. To receive e-mail updates, follow the link below to register.

But they are not yet finish with the horse bill. I think Republican's Smith and King will again filibuster by trying to put in a lot of amendments to the horse's bill until the day is over. The chairperson is not doing good countering the filibustering of the Republican side.

I just don't understand one basic question.
Congress is trying to pardon 12 million illegals as a one time measure and give them Green Cards. (OK - Very good)
On the other hand we are about half a million who entered the country legally and helping the U.S. economy and paying taxes. Why don't they consider giving all of us Green Cards as a one time measure too ?????
We the legals... pay taxes, contribute to this economy by spending earned money here in the US, abide by the rules, carry medical insurance.
We keep doing this, till we get our green cards or till we permanently leave this country. It is a win - win situation.
The strict H1-B rules that are added to this Senate bill will be removed or some work around will be sorted out or else the US economy will go down.
The question now is how confident we are that they will get an amendment to give us some EB visa relief.
The high tech employers have a problem with the new merit based system which is going to take away the reins of holding an employee from them. Employers of other industries have raised their concern against this new system which gives more points to degrees and not skill. This system is also causing a lot of concern among the familiy members here.This system will take a lot of time to kick in.
1) The tech lobbyist can add pressure to give relief to current members in backlog so that they can hire them soon. They know that many skilled people are stuck with their companies because they can't switch due to the GC process.
2) Can add pressure by saying that they need us now and not after 5 years when we get our GC.
3) We need to force them to understand that they should give relief to legals too when they are doing a lot for the illegals.
That is all I think can be possible.

I really see useless threads a ton here, some of them are opened by these guys. They might be helping this organization by donating some money , that does not mean they can dictate terms. I will say these guys motives will not help any one.
I would consider this type of threads and discussions worth only if they are created by regular members.
I don't like someone create a new handle come here and post something without filling profile, start arguing with other members and run away when isolated.
The best way to deal with these guys are to avoid them.

Folks - one must also realize that talking to administration and getting things dione costs a lot of money through advocacy and IV needs a lot of money.
So please be generous enough to contribute to IV - we need a lot of funds in these times when we really needs help

I was wondering how L1 can be allowed instate tuition while H1-B's have to pay out of state according to the Arizona list. What exactly is the fundamental difference between the 2 which results in L1's fulfilling the requirements?

I'm sure you can give these guy's a run for their money. One thing - if you pursue it long and hard enough I think there is a chance that you can get instate tuition. The only area I was concerned about was the domicile part but if L1's can prove domicile so can H1-B's.
My son was able to get in-state tuition at Arizona State University after we filed an appeal. The new rule allows those who have filed I-485 to get in-state tuition.
