At what stage will my current job description be matched to the Job description in my Labor or I-140?
My I-140 is approved foralmost a year now and I had enquired with USCIS a few month ago and they told me my Name check has also been cleared and my case is just waiting I-485 adjudication when visa numebrs are available. I thought when my Priority date becomes current, I will get my GC seamlessly unless there is an RFE.
Also, is there any documentation that states 50% job description match? This is the first time i'm hearing this criteria. I do understand that if I work as Mechanical engineer, I should not chnage my job to a Software engineer...but will getting a Mechanical Engineering job in a totally different industry be a problem?

Once you invoke AC21 .You may get rfe where your new employment detail will be verify by adjudicator assigned to your case against Perm application. This is very subjective matter depends and how uscis handle your case. I think 50 % matching requirement is not written any where, it is just common practice .No one can expect us to match 100 % job requirement with old labor petition.
Mostly watch for your EB2 requirement with your job description. Here is the DOL web site link which talks about job description comes under that code.

It should be, "How many of you have children that are non-US citizens?"

I recently moved to CA (San Diego). I have a DL valid till 2011, from the state where I lived before. Now, I am in AOS pending status. No more H1B visa and I-94 expired long time back. I have EAD and AP. If I go to DL office for california DL,what will be the validity period? Will it be till the EAD ( which is going to expire in next 3 months ) ? In this case I do not want to show my EAD to apply the licence. Will they accept 485 recipt notice to prove my legal status in USA ? Will they give five year license in this case?

My priority date is EB3 (August 2005). Last week her status changed to following. The thing is I checked with my lawyer & my employer and both said that they never received any RFE or never responded anything for my wife to USCIS.

Similar situation...
I am getting married in the 1st week of Sep and am planning to get my spouse by mid Sep.
Can someone please suggest if I am fine, if I apply alone for I-485 around Jul30(and not for EAD and AP??) and add my spouse around sep20th. I-140 approval is pending and have a valid visa till '08.
How long does it take for the I-485 'approval' and is 2-3 months a safe window to add ones spouse?
Any suggestions and help with my planning are greatly appreciated. :)

I have not got Receipt yet...I don't know the status of check..as employer wrote the check

For eax, mine was Dec 2002.I downlaoded 2002,03,04.My record was found in 2004 database.

If you open the file, it is the database of all the Labors that are filed in that year.One of the attribute is the Employee name.You can also search on Attorney name.

Cool down dude, I can understand OPs frustrations, I am in same boat and see similar cases around, not that ead or ap is anything great, just that someone who applied before feels rejected seeing TSC giving out eads like cookies:)

Even receipt is also not some thing great but for you question should be what is more critical at this time getting receipt or getting ead.
I guess every one can wait for EAD but every one need receipt first.

Guysssssss N Gals , I got it (I-485 approval) 10 minutes ago!!!!!!!!!!! NO RFE. Recent Luds were on I-140 / I-129 / I-131 ( Luds occered on 10/29 & 11/4) . Been in USA (F1, H1) since Aug 1997.

Who r u to ask him to get lost??? Just becoz u have so many greens dozn't mean that u can rule the roost. Therez something called as freedom of speech and hez just using it. Its a free forum and u cant dictate terms here while u r a member here urself. Accept the truth and live with it. Whyz that some desis get so offended when someone rightly points out the dirty behavior of desi employers? He has a point and u need to respect that. Whatever the original posters intention, this is a relevant post since it is immigration related. Most indians and similarly most EB GC applicants are legal, law abiding folks. Lets not get offended or take this personally. We have to mature and show that just coz some section of 'our' people do a misdeed does not reflect that all of those people are of the same color or morals.

As somebody said earlier, it's not right a forcing statement that donate. When I read the first reply of my email was not something which I asked advice but a dontation I was somewhat flustered. IT reached the limites when somebody mentioned cancel your trip of Bahamas and donate.
I would just say please mind your own business in these things if you don't want to give advice, dont act like some jerk and tell me what to do and what not to do..

On Cruises generally they do not ask about visas but it always is better to get one. We went on one 2 years back and had visas for all the countries that we went to. None was checked.....but if you do not have the H1 stamped then you will have to use AP to re-enter. There is always an immigration officer when you come back to US. They check all paper work and ask questions. We were asked. We had stamped H1/H4 visas.
To be safe always check with some/your lawyer. I did and they were very helpful in this regard (and not in others though).
Please do not abandon the forum as it has been created to help all. While you are here consider donating a small token to show support. This is request and not a demand.

I am not sure when the CIR will pass...its not on Nancy Pelosi aganda in forseeable future... and several people already mentioned that if it didnt pass by MAY07 then you are looking at Jan 09 to get immigration stuff to happen...
I think we need to work on an interm EB relief bill ...which is absolutely non contraversial and try to pass it....not worring about piggy backing the CIR...
Issues such as h1 increase or adding more numbers need not be in it...we can include things like EAD after I-140...spouse/childer not considered for EB quota...etc...
Unless we act desissively now...its going to be a long way to 2009..

All Pls. signup for state chapters to be able to work together with other IV members in your state. Each chapter can organize 'meet the lawmakers ' drive as outlined in my posts. Currently only few people have signed up to help with the grassroots efforts. Without active participation from members we willl be seeing the frustrating visa bulletins every month and debating about it on forums.

Yes, unfortunately the clients (mostly US based ) react quickly and negatively to such news because much work happens offshore. The board members of the client organizations are bound to raise questions about reliability of doing business with such a company.Due to this new contracts may be hard to come by.

Its been more than 30 days since i mailed my application and checks are not cashed yet.
I called the uscis support center last week and was told to wait.
Not sure how long this is going to take.
