I came back last month from India via Frankfurt on Lufthansa. Airline does suck badly, but there is no need for transit visa if you got valid AP/visa stamp.
Folks - Amsterdam, Dubai, Brussels are the best way to go. 4 years back, I had problems with Lufthansa, I did not know I ahd to take transit visa and they never allowed me on flight and I had to travel the next day by going to german consulate in morning get visa and went back in afternoon, and surprisingly they had blocked me for that day. Until then, I always used to travel ONLY by lufthansa, but after that experience, I never wanted to. I always fly emirates and I like it.

This part refers to family benefits, i.e. payments to spouse based on your SS contributions.
The family benefits are explained on the ss website but there is no clear information about how the worker will get the benefits. On further digging, I found a document which indicates that the worker must be in the US to get the benefits.

Really... Selling a house takes longer and in some places its six month - a year. When you are detained at the airport, you can not list your house and sit in the airport for a year. Think before what you post.
I have sold a house in US while being physically in India. All you need to do is give a notarized affidavit to your Realtor and you don't need to be on the closing table. There is always a solution to worst case scenarios. Dude do some googling and you'll know what I am talking about.

This is how it should be done...
- request USCIS to port your PD from already approved I-140 from past employer
USCIS may or may not do it for you
- if not apply for I-485 using Category of 2nd (should be EB2) and PD from 1st one. You need to attach both of these with I-485 application and of course a covering letter stating what you are doing.
Here is the extract from the law -
QUOTE
(3) Priority Date Based on Earlier Petition.
If an alien is the beneficiary of two (or more) approved employment-based immigrant visa petitions, the priority of the earlier petition may be applied to all subsequently-filed employment-based petitions. For example:
Company A files a labor certification request on behalf of an alien ("Joe") as a janitor on January 10, 2003. The DOL issues the certification on March 20, 2003. Company A later files, and USCIS approves, a relating I-140 visa petition under the EB-3 category. On July 15, 2003, Joe files a second I-140 visa petition in his own behalf as a rocket scientist under the EB-1 category, which USCIS approves. Joe is entitled to use the January 10, 2003, priority date to apply for adjustment under either the EB-1 or the EB-3 classification.

So you mean I should not even think of invoking AC21 EVEN after 180 days ?
Maybe some people had problems using AC21. But at the same time a lot of people do use it. Every person must take the decision after consultation with a good attorney in AC21 matters and after looking at their own GC, Job, career and personal life situations. There are some areas like salary and same or similar job criteria that must be carefully looked at. There is no general answer to the question above. Each person must do what is best for them. It is speculated that a lot of people will invoke AC21 from next month after crossing 180 days and seeing that the upcoming visa bulletins will only push the dates back for countries like India and China. This would certainly frustrate a lot of people who do not see any career growth and may have to decide if they wish to be stuck in the same job for several more years or change jobs.

Let us say I accumulate 40 points and return to India for good. Do I still get Social Security in India if -
1. I am a US Citizen living in India?
2. If I am a GC holder living in India?
3. I am neither a US citizen nor a GC holder living in India?
Any helpful links are appreciated. I have tried to calculate benefits using Social Security benefits calculator, but if you key in residence outside USA and non-citizen, it does not work...
With citizens of India, it is full penson benefits, what ever it is (earned based on contributions). You don't get medicare type of thing.
For citizens of countries like Canada, it is limited by windfall limits. People who worked in both US and Canada become elligible for too much retirement benefits and it is curtailed by limits.
So in nutshell, any treaty may worsen benefits of 10 or 10+ Social Security Contributers.

They won't wait for your PD to be current to issue FP Notice.
Also, I don't think (my 2 cents) its advisable to travel before FP.. You never know when it will come and if you miss it... its considered as if you ignored it... They will issue one more FP notice before closing your AOS application...

I wanted to get an idea how many EB2 guys would be willing to visit DC to meet lawmakers to help out our EB3 brothers. Unquestionably all EB3 should be willing to visit. This is the chance to show that IV is indeed one.
