real problem is we are trying to wake up someone who is pretending to sleep and we can never achieve that. I am starting to feel pessimistic too about this whole bill thing, when they debated for the freakin horse shit for so long where as genuine issues like ours getting delayed..excuse my language, i am just so frustrated and starting to feel there is no light at the end for legal immigrants.

Interpretation of a rule or law is not absolute but in context. Your lawyer seems to have forgotten that and is generalizing a ruling.
What has the ruling said: There will be an audit for business necessity if the job requirements exceed the Zone requirements the job is in.
IT occupations include various senior level positions too which require several years of work experience and advanced degree. As long as the sponsoring company is able to prove that they need a person having those qualifications/skills the labor is likely to be approved under EB2.
Non-IT Masters degrees do not automatically come under EB2 either, as one of the members thinks it will. If that is truly the case, then the DOL might be soon looking at a lawsuit challenging the premise that non-IT occupations are somehow more demanding and require more preparation and experience, which warrants that it be placed in EB2.

Now when the dates have moved, now some idiots are speculating on when and how the dates should retrogress.

yes. there is a possibility of some retrogression for EB2 India/China in the comming bulletins. But that is just for few months and it might be a mild retrogression as long as there is horizontal fall outs of spill over visas.

Got the status update email from USCIS stating a card has been issued for my 485 application.
I am not married yet. What are the implications if I get married to a citizen of india residing in India.

See the audit questions again, all relate to justifications that the requirements are really needed for the job advertised. ie. when the job ad said MS+2 Years is needed, DOL wants to know why this job requires MS+2 Years of experience. His lawyer is right, a more conservative approach to job requirements (MS+0 or BS+5 for EB2 is much more easier to defend). As you increase the minimum job requirements, it reduces the pool of available candidates who can apply for the job. DOL wants to make sure the minimum requirements are really valid, and not set artificially high simply to reduce the pool of candidates.
Basically your LC sponsor needs to be able to justify all requirements posted for the job (education, experience, specific skills) else you can be in trouble.
Yes audit questions seem to be hinting screw up from employer side but then also it can not be judged exactly on the same line without going into detail of provided job classification, job requirement and furnished docs from employee.Now all of the areas you mentioned are crucial from employer side and in addition to that "employee's degree" evaluation is also done at labor stage,(PERM or OLD LC). Looks like it is the photos. I got the RFE after opening a Service Request and they have asked for photos. Morons. They could have made it clear in the instructions to send photos.
It doesn't happen to everyone. A couple of my friends got the ead without sending the photos. It all depends on who processes your application. If he is an ass, you are in trouble.
So, better send the pictures if you are planning to e-file.
I have sent the photos and now have to wait for another 45 days. Hopefully a smart guy who knows what he is doing will process it this time.

Yes, we cannot give up just because we got EAD. Due to a silly mistake, most of us eligible were able to file for I-485. It does not matter whether EB2 or EB3. We are LEGAL IMMIGRANTS.
Leaving our family relaitives, pursuing a career and leading family in getting new friends here, immigration delays have been causing nightmares.
Imagine a person who is pursuing American Dream and waiting for Green Card for 10 years? This means the prospective life of (mid 20s to mid 30s) of a guy is lost in pursuing GC? Is this the modern era slavery? Hitech slavery? Green Card should give us more flexibility.
So, united we stand to fight for legal immigration!

I totoally agree. We need to educate people who are not familiar with the legal immigration system.
For the organized efforts of IV Brand Ambassador--one of my American friend, who is a retiree suggested that I go to present at the retirement center. The retirement center he has in mind houses mostly well-off retired professionals and active AARP members. My friend said these people have strong influence because their established financial and social status--even political status.
Would IV be facilitating/ organizing on-going efforts across states to really deliver our message to American citizens?

Mr. Vayalar Ravi , Minister of Overseas Indian Affairs,is coming to USA on June 27,2006. He is coming to Washington DC on July 4 to meet Indian Ambassador and Indian community. We should try to meet him personally and explain the problems we are facing. He can talk to US counterparts and do something for us.

Organizations like numberusa is vehemently looking for a way to prove that how all pro-immigration provisions are anti-american. So we hand over them the Jackpot.
Whole idea of involving Indian Minister looks to me like small kids involved in a fight seeking help of their parents to get the issues fixed. Here we are not dealing with neighbors kid. Lets grow up..

Can you get AC 21 advantage if you just wait ( NOT WORK in case of a friendly past employer) after filing 485 ?
Is it necessary to work for 180 days ?
If working for 180 days is not required then, one can work for someone else on H1B & file 485 from the past employer. After 180 days of filing, one could use AC21 to move from one job to another.
