    Thank you very much for the response. I actually want to put 5 years minimum experience though my lawyer said that it is too much. He would recommend either 2 year or 0 year work experience for this position with M.S. degree. Accordingly, we come down to 2 years with M.S. degree. After receiving the audit letter, my lawyer said I should have put 0 year instead of 2 years. I was also told by my lawyer to give him the answer about the following questions:
    1. Why does the company require 2 years of work experience?
    2. Why does the company require M.S. degree for this position?
    3. Why does all skills and programs require for this position?
    4. How long it take to obtain those skills and programs?
    I’m very confused and have no idea what to answer why the company require M.S. degree since it is the requirement. Have anybody also have the format of the audit letter?
    Also, if I have to be outside of the country by taking vacation due to this H1B issue that is going to reach the 6th year, do I have to be employed full time with the company and get pay as well? Thank you very much.

    Can you eloborate more on onet code -classification and job description in detail? Other thing , Was your MS Certification in your country of birth or in USA? And if it is not in uSA did you get it evaluated in USA and have submitted evaluation cert copy along with your application?

    I used to be client of Gowda couple of years back and I did not like the experience at all.

    My situation was little different. Gowda's firm was the de-facto firm used by my employer although I used to pay all attorney fees out of my pocket. In spite of me paying for his fees the firm always put my employer's interests ahead of mine. My employer then was a typical blood sucking desi consultancy shop and used pending GC as one of their leverage to make employees stuck with them in spite of poor pay scale. As far as my own experience goes Gowda's firm happily played along with my employer in the grand scheme. They denied me any update regarding whether my labor was cleared as well as didn't send me any original approval notices/receipts etc. at my employer's request. When I raised lot of noise I was finally told I can no longer have direct access to the attorneys and have to route my requests through my employer! I wised up, cut short my losses and ditched both of them to join a big respectable company loosing my earlier PD and approved labor in the process (which I'm sure my employer must have sold back when LC substitution was legal). I finally received my GC in September.

    Your experience maybe different if you directly retain Gowda without involving your employer. Competency is not an issue here, conflict of interest is.

    I agree with SSA. I retained Gowda without employer interference and still I did not get proper service and guidance. Further I found that Gowda is not keen to handle EB cases, compared to Investor categoy cases and the rates are exorbitant if there are any RFEs or representations for smaller persons. I moved away to Ron Gotcher and found his fees are dead cheap and his services are thousands of time worth, compared to the fees I paid.

    Anyone thinking that recession is confined to a specific industry or geography needs to do a reality check. I am not saying we are in recession or we will be in one soon. I will leave that to forecasters. But core to all the down markets/recession/bear market is consumer confidence and inflation. Now what we are seeing in Finance industry could trickle down to tech in a quarter or two, simply because Financial sector spends big on tech and downturn in any specific industry erodes consumer confidence.
    In 2001 it started with tech but financial and other sectors also took a big hit (take a look at the layoff figures from tristate area). The reason then and now as has always been was consumer confidence. In 2001, tech downturn and stock market correction eroded consumer confidence. As they say we can actually talk ourselves into recession by simply feeling depressed about economy and hence directly affecting consumer confidence.

    As far as layoffs go, during 2000/2001 a large chunk of people left the industry (tech/telecom) never to come back again. Some of them remain unemployed/underemployed some moved to Real estate. Each down turn systematically purges bottom 20-30% who never get employed at the same level. Generally the most vulnerable ones are older workers or fresh college graduates.

    That's very correct. But I think AILA or concerned folks like us should ask USCIS to clarify their stand on it. I am sure they will do it soon.

    The AC-21 became a law in 2001.... if they really wanted to clarify it, by now they would have....They have taken a position of strategic ambiguity....

    Government lawyers like this kind of situation...If they donot like something you or me not doing they can use this weapon against us....to throw you/me out..

    So the crux is if you/me donot get into any trouble like drunk driving or something...we can get away with some things...

    It's OK to have a bunch of illegal immigrants to do the dirty work.

    Let's think as a modern slavery. They want to be in command, to be the boss. It's their nature. And they just don't accept skilled immigrants coming here and taking the top positions from them. They want people who just take orders - from Americans.
    I dont agree with that coment. Whether it is an american/foreigner, if you are not suitably qualified (work skill and knowledge + Social / managerial / personal) you are destined to be in the recieving mode all your life. Now I do agree that being in a foreign country, always it would be easier for the natives to reach the managerial position faster, compared to a foreigner. So what we can do is improve our skills and be more confident about ourselves. The american citizens have been exposed to years of economic prosperity that has lead to the belief that even if they dont study / work hard the country will provide them the jobs to enjoy life. When suddenly they find that they are not enjoying the same liberty (chaning jobs as they wish, bargaining for more pay, employer at employees mercy kind of thing) they are unhappy and are starting to complain. Now regarding ilegal immig doing dirty work, its not the fault of the american employer. Its because the workers find, what you call as dirty job, better than what they have at home.

    Yes, I've had this problem and I'm nearly at the end of my rope with Nikon. I've been a Nikon user for over a decade now. I own three Nikon bodies, 7 Nikkor lenses (mostly AFD primes), and two Nikon speedlights. I do mostly existing-light photojournalism as well as macro photography and landscapes.

    Originally, my D70 had horrible backfocus with anything wider than a 70mm lens. The left AF sensor in particular was completely useless. After the first repair, the camera was much improved. I bought a $1000 12-24mm Nikkor, only to find the camera didn't focus properly with the lens. I sent both lens and camera in. I got the camera back a few days ago and it is worse than when I sent it in. I don't think Nikon Service has any quality control. The problem was obvious from the first few shots I took. The left AF sensor is again useless and the center sensor is marginal. At f2.8, it is obvious that the depth of field is all behind the subject.

    I have an old N90s that takes painfully sharp pictures with the same lenses that I put on the D70. I'm going to give Nikon one more chance. If they don't fix it, I'm going to sell all my Nikon gear and never buy another thing from Nikon as long as I live. After years of shooting Velvia, I've found I really like digital photography and I'm not going to stick with Nikon if they can't provide quality products or at least proper repair.

    IF you have a current PD RIGHT NOW...AND submitted your I-485 on or before June-July 2007... AND have an approved I-140


    I-485 submitted in last week of July 07. I 140 filed in premium processing and approved in Jan 07.



    (i) they are sweeping through all the files to find such files because if you filed your application in June-July 2007, 180 days have likely passed since your name check was submitted to the FBI. Name check request are made within weeks of generating a receipt for you.

    (ii) they plan to complete this sweep by March 10; UNLESS visas run out, they plan to process such cases in approx 60 days (hah! like I believe them).

    (iii) within the set of applications with current PDs, they apparently process in order of RD. Not sure if this is within the EB preference and current PD or across all EB preferences.


    If what you say holds true then thats good news for me personally! But I would be curious on the process used by USCIS to dig out all applications that have current PD in march, and then sort them based on application receipt date and process all these within 60 days. I am hoping (or rather praying !) that the fact that they have entered our data into computers allows them to apply some simple sorting logic to CORRECTLY arrive at a subset of qualified cases to be opened up come 1st of March. Now the geographical distribution of cases across service centers, the huge mess during the July fiasco, and cases of people still waiting for their FP appts even now, doesn't give you too much confidence in their systems and processes. But, hey, guess I might be getting too pessimistic here and going against the spirit of own handle name :). Waited for 7 years. Whats couple more months or even a bit longer for that matter !


    (iv) Some cases are approved without any changes in LUD i.e. that amazing email arrives before without any prior LUD changes.

    IF you don't have a current PD, I have nothing to say except best of luck to all of us...the situation is pretty grim. The movement of EB-3 ROW will mop up most of the green cards left this year.

    In general it should not affect the visa bulletin because even if people lose jobs they can potentially scramble and get something soon enough (esp if they are on EAD). A future job offer is enough to maintain status atleast.
    So for all the people already in the queue, its possible to stay in the queue even if the economy tanks.

    For people not yet in the queue, even if they are forced to return to their home countries, they dont impact the existing queue.

    I have noticed for several cases in here, where all the 3 applications are sent to the california service center....and CSC processes the EAD and AP and forwards the 485 app. back to NSC / TSC for further processing. The positive thing is that CSC is quick in processing AP/EAD....thus in a way this situation can prove to be lucky for all those whose applications are forwarded from NSC to CSC.



    I believe USCIS is trying to comlete the receipting job from all the Service centres.

    so you wont be sruprised if folks started reporting their receipt numbers start with EAC (for Vermont).

    Let USCIS do their job of receipting everyone who filed in July-Aug 2007.

    Ultimately processing will be done at USCIS NSC and TSC for I-140 and I-485 due to their bi-specialization program.

    Personally I do think giving this 55,000 annual quota green cards to employment-based Science & Medicine immigrants is better than giving DV-lottery to other lucky people just win the lottery but without any high educational qualification. Also, since international students have stayed in US for long years and they have documents such as social security no. and driver licenses' to run the comprehensive background check. Therefore, it minimizes a lot of the risk to invite the criminals to immigrate.

    However, I am curious whether this bill will be beneficial to all US advanced graduates in Science & Medicine or not. I know some new H-1B workers in those advanced degrees may NOT be the EB-type and they need to wait for certain years and then the employers will sponsor them green cards as the EB-category. And if the employers don't sponsor them green cards due to companies' merging different departments or for other accidental reason, they will lose their green cards.

    Also, some advanced graduates in Science & Medicine cannot get the H-1B working visa smoothly due to H-1B quota is full and need to leave US and some of them can't get the
    H-1B extension and need to leave US. Or some of them got laid off during their employment period due to merge of 2 companies and if they can't find another employer, they need to leave US too.

    Therefore, if they can't get into the EB category, this bill cannot help them out!! Personally I do think if to allow all those advanced graduates in Science & Medicine to enroll online by "first come, first served basis" and once the 55,000 quota is filled, then they need to wait for the next year to immigrate. This will be fair and can retain all those US advanced gradudates in Science & Medicine who are graduated in different years with different luck to get the H-1B working visa.

    The real question is if Senator Kennedy's office said March 07 or March 08 or 09. This drama has no ending.

    What is our worth here, to me it looks like for the politcians illegals are more valuable than well educated immigrants. It is the same old political crap that I had seen back home, it is just that here it is packaged differently.


    I called Senator Ed Kennedy's office and was told that CIR is likely to be introduced in early March something like first week. They of course told me that there are no guarantees, but more a reasonable probability.

    My PD 12/2001 - EB3
    My wife's PD 12/204 -EB2

    Filed cased independently back in 2007 (pre & post july fiasco). In september lawyer sent
    a letter to INS with marriage certificate to adjudicate both the cases together. By september end INS promptly approved my wife's GC. When I spoke to INS over phone, they mentioned the letter is of no use, since my wife's case is approved.:confused:

    Any suggestions how to proceed. Out of job now, moving on to EAD from H1 after 10 years!
