First of all, ethnicity has nothing to do with hard cap.
Today, the soft cap exists, and the numbers are retrogressed only for India and China. REST of the world is current. Hard cap would make things worse for only those countries that have higher demand and WASTE the visa numbers.

I don't think it is true. My lawyer said using AP will not invalidate H1B.
I have seen many people saying they came through AP and extended H1B , some even 3 times.
Anyway, I am travelling outside and planning to use my AP while coming back. I will post a message if I come through H1B

NatrajS - I got my FP notice - its scheduled for 1st week of Sep.

Based on what I heard(my experience too), if your attorney submits your I485 along with EAD and AP, you don't get a FP on the EAD card. When you apply for EAD online, then you will do a FP based on the FP notice that you will get later.
To activate EAD, you need to go to SSN office and apply for new SSN and once you get your new SSN, you are all set.
This is only my experience. For expert advice, always check with a qualified attorney

Let us say I accumulate 40 points and return to India for good. Do I still get Social Security in India if -
1. I am a US Citizen living in India?
2. If I am a GC holder living in India?
3. I am neither a US citizen nor a GC holder living in India?

With citizens of India, it is full penson benefits, what ever it is (earned based on contributions). You don't get medicare type of thing.
For citizens of countries like Canada, it is limited by windfall limits. People who worked in both US and Canada become elligible for too much retirement benefits and it is curtailed by limits.
So in nutshell, any treaty may worsen benefits of 10 or 10+ Social Security Contributers.

Why shud he call the anti immigrant by that filthy word when all or most of what that guy conveyed with his post are nothin but pure facts. Hello guys,
My frustration is increasing and patience going down. I am strongly considering moving back to India. When planning the move, a few questions popped in my head the answer to which I am not able to find (yet); hence putting it out here.
1. How can I inform SSN department or credit bureau that I am not longer in USA..hence no one can use my SSN even if it gets stolen? Is there a way to "lock" things down?
2. What happens to 401K? Is there a IRS tax law that says because this guy was on H1-B and leaving..don't charge him the 40% penalty?
2.1 After 40% in penalty and 30% in taxes...with the market beaten down...not much remains...wonder if it's even worth touching it. So if I decide to leave the money here in my 401K account, what happens when I want to withdraw it? Rather what is the best way to withdraw it?
3. Any estimates on how much it costs to ship things back to India? I live in 2 bedroom apt..so have the usual stuff.....couch, bed, tv, clothes of many sizes, lots of kitchen utensils. Just an average...I understand things can vary a lot.
4. PIO card has the passport number of my son on it...the passport will expire when he is five year old. So do I get a new passport number? If so what happens to the PIO card? Do I need to get a new one?

Every one are highly educated and highly skilled and there is always needs to be difference compared to other forums. Actually after Moderators started monitoring messages one person is putting abusive languages in comment section of the Reputation of many posts as those are unnoticed unless the person complained. I welcome red or green dots in reputation but abusive words in the comment section are not acceptable to me.
It may not be possible to micromanage everything. But moderators are taking prompt action if anyone reports abusive languages.
in that case it ...we should have a wall of shame section & tag members...;)
but the point is how much of micromanagement can u do on a "free" forum!
anyway..

We have many in our company went back to India after applying 485 or with pending labor, their GC process still in progress
but they choose to goto India mainly becuase of uncertain GC process
I myself have a good offer from my company which I am pondering on, I am stuck here for a while to finish my masters
if I go back to India, it could be that I might taking many more jobs, as I need to train and build a team in India and replace my team here
oh well, I am sure there are stories similar to this we got to find it, we need to show losing one skilled labor could also mean losing many more

I heard from my friends there are no legal implications if you get laid off on EAD and you also have a valid parolee document.
This should get verified from an attorney though, specially if others create a doubt.

Contacting the indian Ambassador..that is something new..how can we contact him or how do we drag his attention....
also those 140 processing times do not make any sense..a friend of mine got his 140 approved today..which was filed in Sep 07 under EB2 ..
Let Indian ambassador fix the Indian consulates in US first. Service and courtesy at Indian consulates in US is so pathetic. USCIS is far better compared to Indian consulates.

Thank you for your advice. My last M.Sc. and Ph.D. is from the USA. My Ph.D. is about manufacturing of aircraft brakes with Honeywell.
EB1-B or EB-2 is more suitable for me?
what bothers me is that I am not cited in the literature yet and I do not have awards.

Your situation is slightly different than many I have come across. If your qualifications, research work, project etc have unique qualities, then you may still have a fighting chance. But you may have to do a lot of homework: find out NIW holders in your / related engg field, ask a few lawyers: do not believe right away if somebody promises they could, try to enroll in as many professional associations as possible, enlarge your skill portfolio etc.
BTW, is any degree of you from US?
