    Obama or Mccain or Joe the plumber whoever becomes the next president, the bottom line is, nothing is going to happen with regards to reforms for legal immigration atleast for teh first 1-2 years. So we are all still going to keep posting in IV forums, predicting VB dates and fighting between Eb2 and Eb3..... that is really the sad reality....... because these guys have far more important issues to deal and to steer titanic america.......

    Senate Amendment 4439 to the American Jobs and Closing Tax Loopholes Act (H.R. 5297).. Correct??

    I think this is a brilliant idea and might even fly esp because it still preserves USCIS/DOS EB caste system while providin some relief to the EB3s.

    While porting is still an option, it is in EB3 filers' interest to push forward on this idea.



    I feel frustrated at some peoples' unwillingness to admit that EB3 needs IV's help now more than ever. They are saying that nothing much can be done for EB3, as INS merely corrected its wrong interpretation in visa allocation

    But, if we are all willing to put our hearts and minds to it we can surely come up with new ideas that will help our cause. Surely, laws are written so that justice can happen. So if justice is not happening, the law would have some answer, somewhere.

    Let me put forward my idea.

    The INA language says that until EB2 is not current, there will be no spillover to EB3. Agreed. But I would contend that this statement is on a year to year basis. That is, if in the year 2002 (for example) all EB2 has been satisfied, then the spillovers should go to year 2002 EB3.

    Is this something IV can point out and fight for? Can EB3 members put their money and efforts in this direction? Let me know if this sounds worthwhile

    In that case, employers should mention the following in the offer letter

    " In case, in future, if economy goes bad and recession occurs,we cannot sponsor your green card since it is easy to find american citizens who has minimum qualification."

    This should be mentioned on the offer letters given by big comapnies.Then it is up to H1B candidate whenter to take the offer(risk) or not.

    Though it is unfortunate, I don't think you are understanding stuff right. If you think you have a case to fight, go ahead and do it. Consult an employment lawyer and see what can be done.

    Anywhere in the world, it is always the employer who has the upper hand and you fight only if you are capable of.

    It looks to me that you are venting out on the employer on this forum because you feel decieved or cheated, but the reality is that, it is just an unfortunate situation for you and all of us go through bad and frustrating times.

    There are some companies who have filed EB1C left and right and employees got GCs in few months, there are companies who file EB3 for most qualified and that too when in 5th year.

    A lot of physicians get future offers while they do fellowships etc... and the employer actualy files directly for GC and these folks get GC by the time their fellowships are over and they start work immediately.

    Work with the situation, work with your employer, look for options, try to infleunce the system to make process better .... along the way you will see that you can achieve a lot by being positive about things.

    Try to "Make things happen" rather than expecting things to happen, because things change and we all know "change is constant"

    Thanks for the update and good to know that we will get an RFE and not a rejection for our EVL.
    But on (2), what if we already have an A# from our approved I-140? Is there any other way to know that our application has been accepted??
    Actually receiving the I-485 RN implies no rejection, only RFE, that is what the service representative told me about.

    First, I would like to congratulate everyone who contributed to the success of the DC rally on Sep 18, 2007...

    I was there and I am proud of our ImmigrationVoice members for this FANTASTIC effort!

    We are just starting and taking baby steps with these kind of activities...So, anything I mention below is not a critic, but a humble feedback/opinion...Please don't get offended.


    1. We must immediately change our name to LegalImmigrationVoice.org( LIV.org)...But still Immigrationvoice.org should work....This should be done ASAP...like within next week...Please conduct a poll for this ASAP.


    2. We must/should always wear formal suits for these kind of rally....this would definitely give us a very high status and definitely there will not be any confusion if the rally is by legal or illegal immigrants. Even if it is hot summer, we must stick to this dress code...


    3. In all the signs we had today, we need to have one line clearly in bold as "Legal Immigrants - LegalImmigrationVoice.com - Faster Green cards for Legal highly skilled Immigrants" - bold and clear..

    Also, all our T-shirts should have
    "Legal Immigrants - LegalImmigrationVoice.com - Faster Green cards for Legal highly skilled Immigrants" in the back

    4. One of the rally participants told me that a guide was telling a tourists bus passengers quote "these folks are illegal immigrants...", the rally participant who heard this went to the guide and explained that we are legal immigrants...if you think the guide is not smart enough to read our signs and understand that we are legal immigrants, read next point...

    5. On the rally route, one gentleman, who was dressed in suit, looked well educated came up to me and asked what we are concerned about...I told him that green card process for Legal Immigrants is taking between 5-10 years and we are requesting to expedite it.....so it is clear that all our signs need this text at the bottom "Legal Immigrants - LegalImmigrationVoice.com - Faster Green cards for Legal highly skilled Immigrants"


    We cannot be perfect the first or second time....Lets learn from this rally....

    yes this is what has been worrying me, ever since i became member of this esteemed organization. With the illegal immigrants also fighting in the same era, I fear IV is not misunderstood & hence misjudged. Lets really really change the name to LEGAL IMMIGRATION VOICE.     Hi,
    Have a question on my visa.

    I applied for H1 visa with company A, when I am in US in Apr'08 with
    L1 thats getting expired, due to emergency I went to India.

    I got h1 approval notice with COS on July'23 2008.

    My Indian company B asked to get fresh L1 , so I took a stamping on
    Aug'20 2008 and came to US on L1

    changed company A with H1 visa . (company A did not do any COS again, since they say H1 is already with COS).

    Want to know if my H1 is valid do I need to do any other things to
    tell USCIS that I am on H1 NOW. Can I do stamping at Mexico/Cuba.

    If there is any problem above how to come out of it.

    IV has people on the national advisory board that include the previous USCIS ombudsman, what is their take on this? I have not seen any thoughts from such experts that support this organization on this issue of quarterly spillover

    What if the employer is an NGO or NPO? I believe, it is not counted against the H-1 quota but in that case, can he start working right away?

    That depends. I dont know how the H1s that are issued outside of quota for educational and non-profit organizations work. If they have the validity date sooner than 1st Oct 2007, then yes, you can start working based on that date.

    Whatever the case, the H1 Approval letter (I - 797 ) will have start-date and end-date on it and that when you can work legally.

    I have not seen a single person say positive things about the h1-b program. Instead of infighting here, can we all go there and try to justify the need for skilled labor? Everyone seems to say..they should hire from US...but they forget that there is noone in US to hire. This one sided bashing by anti-immigrants/ racists will only damage our position.

    Here is a summary of what we discussed in the conference call. Please add anything that I may have missed out.

    1> Contact local congressmen - This is by far the most important thing that we have to do. As mentioned in my previous posts, congressmen will talk to only their district people, so each one of us has to try to contact the local congressmen - Varsha, Sanjay, Shekar, Ajay and Rajeev

    Nobody knows whether congressional action is needed to allow I-485 to be filed during retrogression?


    Look, No body know about it. I think we should contact with some law firm in order to find it out from some reliable sources.

    One more thing is what how does USCIS start retrogression. There is no law about it either. This is something USCIs start by it self using "New Rule" option.

    I think Core team should look into it. Since we spend so much energy to calling all Senators and we all know the results.

    USCIS can allow to file I-485 or they can make some rule without going congress.

    Correct me if I am wrong but there is some light in this path for us if we seriously fellow it.

    We just sent a letter and 485 receipt for me and my husband.

    Just wanted to let u know.
