Thanks everyone for being patient and supporting us. The work is happening at all ends and it is an uphill task.
We really need to increase our membership. Higher membership will mean us looking tall when we meet lawmakers. Please all try to help us spread the word of IV to everyone you know that is stuck in retrogression. We represent at least half million people but we currently not even have 6 thousand members. Thus we have to bring lot many people into IV. I would encourage everyone to pls. register on this forum instead of being visitors.

I was in a wait state for 16 months until my 140 was cleared earlier this month. Continue business as usual, your case will eventually go thru if all your docs are in place and your case is clean ( no 3 yr Ed issues).

As I am writing, I understand there are 1900 active members and 5800 members. Even if 50% of the members bring one new member each, there will be a tremendous increase. And this can be done via internet: web and emails. Set a target (50% increase?),deadline (Oct 31st?) and have weekly count of new additions displayed prominently. Democrats did that for Howard Dean's campaign and the model has been used for subsequent elections by both the parties.. There were many new members who were asking for rallies on streets. There are others who want to send flowers, 'Remember me' cards to lawmakers. A few others wanted to put up fliers in INdian and Chinese grocery stores. Even 20% of effort to carry out those activities would fetch at least one new member per old one, then the target can be achieved.
IV core had been very voiceferous, when we needed to achieve the funding target in summer. Can they become more involved chalking out a plan to
increase membership, if that really matters? In the membership enrollment form, if there is a field asking if some old members brought the applicant in, then we would know how many old ones really care to do something. Without personal outreach and contact, the rate of new additions will never increase.
Each member has potentially minimum of two votes to spare 6 years from the day he or she gets GC. When presidential elections are decided by ~600 votes in a single voting district, even thousands of potential votes from IV community would appear to be a juicy carrot.
In my work community, there are ~100 Chinese and Indian staffers. As far as I know,my Chinese colleagues, who are more in number and most are in some stage of GC, have not heard of IV or even SKIL bill. They don't need to as all of them are EB2 and hence they are retrogressed for just over an year. Among lesser numbered Indian-origin staffers, the story is the same. On my part, I can spread the word here and breath down the shoulders of some and get them in. I am working for a non-IT non-profit establishment. Just imagine, what happens if a personal quest for new members happen in an EB3-rich IT or finance sectors?
Any suggestions for concrete plan of action? Without a plan, committment from some of us to act as catalysts and keep up the momentum this drive will not work. Bringing in at least one new member per old one is much better than rallying, sending flowers, chocalates, 'Do me a favor' cards etc.

As a Primary Applicant my GC was approved (EB-1) but for my wife's application I got an RFE. RFE - USCIS is asking for a VALID wedding certificate showing proof of a hindu wedding under hindu act (dont ask what I was doing or what my lawyer was doing while submitting 485)
Now I have about 28 days (total is 30) to respond to it. I have not rcvd. my GC but it has been approved and has been sent to production. My lawyer told me that as my GC has been approved my VISA is not good anymore. My wife was on dependent visa and so is my kid.
Now as my GC got approved.......my visa got cancelled...........my wife's & kids visa is invalid.............and we did not file for Advance Parole so we cant travel. On top of all this we dont have a wedding certificate.
Any suggestion to address this situation? I cant get a certificate without going back to India and I cant leave the country as If I do so I wont get to enter the country again. Even if somehow (on some legal basis) I can re enter I dont think my wife and kid will be able to re enter US.

People do not agree and have different ideas - sometimes to the point of personal hurt! - this is natural. They have different interests and even when they have shared goals, sometimes their paths to those shared goals may diverge - this is natural, too. Yes, differences, discussion and divergence can lead to a final separation and then two or mroe new groups are born - and it can happen naturally and it does not have to be rushed or forced through censorship and persecution. But sometimes debates and differences actually help the whole group to stay together and find a better path or a better solution - in the heat of the discussion and in the fight of the dualling arguments a new idea, approach or solution is born. I do think that a lot of the most contentious discussions on this forum are actually the most important and interesting ones because those are the oens that will cut to the heart of the problem and reveal the real depths of the issues. Suppression of diverging opinions is the hallmark of dictatorships.

There were a few instances where the previous senate majority leader, Dr Frist was trying to by-pass the committee. But, in the case of the House of Reps, it would not have done any good as Denny Hastert had the rule of "super majority" meaning that he would only bring bills to the floor when a majority of the majority (of Republicans) would support it.
Bills almost never go to the floor directly. Especially something as huge as CIR. It will go thru committee again and it will go thru normal rounds of debate and amendments between the 18 people in Judiciary committee.
Its very unusual for a bill to hit the floor directly without going thru the committee that has jurisdiction over it. If it happens all the time, then the committees would be meaningless. The whole point of having a committee is to be able to either kill the entire bill, or a congressional appointment before such a bill / confirmation is debated by all 100 senators. Same thing in the House.
If it was possible to bypass committees, then people would have floored the SKIL or other bills directly on the floor of the house, therby bypassing Jim Sensenbrenner and his Judiciary committee last year.

As far as I know, starting a PERM application in itself does not amount to an intent to immigrate - it is simply a labor market test for a future position.Remember, the employer can port the LC to a different employee at a later date. I-140, however is an application to immigrate permanently to the US; hence a violation of the F1 visa. You may have a difficult time getting your I-485 approved or have to go in for consular processing. It is best you consult a lawyer on this one; don't count on random opinions on the forum for such a serious issue.

No, you will still have to complete the requirement or else your 485 will be denied. There is no escape from waiver. :eek:
Always remember that a J1 visa is a non-immigrant visa and H1B(waiver) is dual intent. If your spouse applies for your GC(i.e. files your 485) before you have not completed your waiver requirements there are 2 things that can happen:
1. Either you will get your 485 rejected,
or
2. Your J1 visa will be denied. Always remember residency visas(J1 or H1) are given on a yearly basis and yours will get denied the next year even if you get it for the 1st year.
Infact my wife started her residency on J1 visa and my 140 was approved. She will be starting her waiver next year. I have a PD of feb 2007. I will be filing her 485 as accompnying spouse(you can use your PD even if you have received your GC:conformed this with my attorney) once her waiver is approved and if my PD becomes current. However she will still not get her final green card until she has completed her waiver requirements.
We had decided not to let USCIS define our carreer objectives and going with the flow. Looking from the likes of it she will be done with her waiver in another 3 years and still the PD won't be current.
Now look at the bright side of J1 visa:
1. Once her waiver is approved I file for her 485(she gets her EAD) using my original PD(no need to get into family based immigrtation hassles)
2. Since we have not exhaused our H1B( she gets 6 years of the same)
3. Her 1st H1B is quota exempt.
4.You save tonns of money since J1 are exempt from social security and medicare taxes etc. :)
You will eventually have to make your own judement call depending on your family circumstances.......so far as I mentioned we just decided to go with the flow and things seem to have worked out for us well. She got the recidency in the same place as my job was and then I got laid off 3 months back and now she got her new job in the same place where my new job is.........

I recently came across an old friend of mine. I was shocked to hear his case. He is an original applicant EB3 India with PD of September 1998. Please note he is the original applicant and this is not labor substitution.
Here are the details
Sep 1998 : Applied with Texas Workforce Commision as regular Non RIR.
Oct 2001: TWC asked to do recruitment. No action was taken on submitting results.
October 2006 : Labor finally approved from Dallas BEC. Concurrently file I 140 and I 485.
Jan 2007 : I 140 approved.
Nov 2007: Took Infopass appointment. Was told case pending name check.
This case is absolutely amazing. My friend doesnt care anymore since he recently married US citizen (genuine case ABCD). He has worked at the same company since 1998 and stuck to stupid job (non IT). My PD is August 2001 and seeing his case I am getting mentally prepared for much much longer wait.

I have sold a house in US while being physically in India. All you need to do is give a notarized affidavit to your Realtor and you don't need to be on the closing table. There is always a solution to worst case scenarios. Dude do some googling and you'll know what I am talking about.
You need to live in that house for at least 5 years to recoupe the commision/closing cost. Will you pay the loss if someone needs to sell the house suddenly due to immigration.

Oh, so when you made the statement below you were not assuming everyone fakes their projects because YOU fakes yours? All of a sudden you became this guy that has never faked his resume! From your statement anyone would assume that you are not the guy you are claiming to be - genuine!
As an architect i participate in interviews of dozens of people all the time for all positions in my teams and I know how they fake resume's. Anyway enough of this .. there is no point in responding to this diatribe..apparently you have too many frustations

In the present situation i believe it would take around 1.5 years to 2 years if you start by preparing for labor and by the time you get your labor and new I-140.
If you ask me about audit, its better i don't scare people, i started this porting process in Jun 07 by applying labor and it got audited after a long wait it got denied, my lawyer filed an appeal and we waited for 10 months still no answer so we applied for withdrawal even that took long time and finally applied for new labor in Apr 09.. so don't get scared it doesn't happen to everyone.. maybe 1 in million case :)

Guys pls stop taking useless info pass appointments. People like me who have not received EAD and may loose the job are not able to get infopass appointments because of all the people taking appt to know the 485 status. Pls understand......
I do not know when you started the process of renewal, but you could have filled 4 months ago. Then, secondly, if you are so eager go and take an appt in another city. Just an option...Everyone has the right to do whatever they choose...

The coming back of CIR seems imminent - we need to step up lobbying/calling/faxing/writing. Is IV still have the lobbying firm support? do they have any specific suggestions so EB friendly amendments will be introduced/succeed.
With dates being current I think everyone will say - hey employment based system does not have backlogs why increase their numbers. This priority date movement is so complex its easy to mislead anyone.
