the effort to address the ugly country caps and retrogression in general shouldnt depend on someone else's misfortune - why should we profit from some other familiy's heartache? the system is atrocious and needs to be reformed - even if you get your gc tomorrow, hopefully u wont instantly join the group that wants to shut the door on those following-& pls make sure whateevr u sire too doesnt turn anti like the nutcases that i've come across

I hope IV does push for the 485 measure but if for whatever reason they change there mind and dont push for 485, I would be disappointed but that will in no way affect my attitude towards IV. Over the past year or so I have seen enough of core tem to say they take a decision in the best intrest of IV.
I have not filed for I-485 and neither am I close. I feel I-485 is much more controversial interim relief then most members think. This is explained in a post (from a law firm) in another forum. Another reason for my feeling is that AILA is not supporting I-485 filing for health care: they are supporting a temporary 25K-75K increase in GCs. It is possible that health care GC does not have I-485.
You have to choose an issue that has a chance of getting through rather then an issue that most persons want or is logical. I will be surprised if I-485 filing as interim interim relief reaches the bill state and/or the bill gets approved in Senate + Congress.

I was wondering how L1 can be allowed instate tuition while H1-B's have to pay out of state according to the Arizona list. What exactly is the fundamental difference between the 2 which results in L1's fulfilling the requirements?

This is a Tricky situation.you need Medical leave for your child but 4 months is a bit too long. Pls.contact your Attorney about the consequences of taking 4 Months leave on H1B visa.make sure your HR provides you with all the Paper work that your Attorney might ask to substantiate your leave.

My new born son is sick and he needs total attention for next 4 months. I have used up all my vacation and planning to apply for medical leave. Pediatrician recommends me getting medical leave and support my wife.
I work in a very big hardware company. I have completed 3.5yrs in H1B so far.f I apply for medical leave, I may get a pay cut (like 20 to 30%). Will I be affected because of this medical leave? Are H1B's allowed to take medical leave (upto 4 months)..

We all know how permanent jobs are here :) It's just the way the immigration law has interpreted it.
His point was more in support to legal-Skilled immigrants that create value for US of A ;)

IV is not an Indian organization. If this is one of the reasons why few non-indian members are not making donations then please re-consider your decision and start donating.
Also let us not dillute our fight by expanding the fight to include other problems. Once we achieve desired results, we can continue to pick up other problems and lead the fight.

I had communication with one of the moderators (core members of IV) and he clearly stated that retrogession is in IV's agenda, but FBI name check is not in IV's agenda as an organization. How come retrogession which is mostly a problem for indian immigrants in the agenda of this organization, but FBI name check which is a problem for most nationalities not in the agenda of this group(maybe with the exception of Europeans)? There are over 100 members at a yahoo group, and some more registered at an immigrationportal forum with common problem of FBI name check, cases delayed for 1, 2, 3 or more years because of name check. The registered use names suggest that there are from all over the world, yet no core members of IV is caring about this matter with the exception of one person who scheduled a conference call with an attorney in PA, but did not help any more. Sorry about my humble sincere feeling.

When markets worldwide rise or fall in response to election results in India, it gets major media attention everywhere because the audience is interested. Diwali is as unimportant in America as Thanksgiving in the U.K. There is no point fretting over it. No I did not. Because my attorney did not ask me to do so. But, after I got my GC, they emailed me some instructions on what to do and what not to do. In that list they had this instruction to carry my GC with me all the time in BOLD.
So I got concerned and posted this which has resulted in a lot of hating and loathing. I am not understanding why is this my fault.

Same here. I saw another soft LUD today 6/14 after a LUD yesterday 6/13. Wonder if USCIS works on Sat or it's just some regular database update.

Hi All,
Its seems that my approved EAD card lost from mailbox (seems like post man delivered it in diff mail box instead of mine).. It�s been more than 15 days of approval but no card in the mail.
I contact customer service and they said wait for 30 days otherwise file new one. I am not sure what are the option I have if I won�t receive my card on time? My existing EAD is expiring within next 25 days. Is there any way that I can get my card back or USCIS issue new card without filling new one?

Today, I filed an official complaint with IRS about this employer. They told, they are going to send a notice asking the employer to reply to the tax bearer within 10 days from the receipt of the letter. I don't know how the employer is going to react and if they would still provide a corrected W2. Hoping, they would provide, otherwise I would have to call IRS again after another 2 weeks time. I had to be on the phone line for almost 30 mins to reach the IRS customer representative. It is a real pain.
Also be prepared for a backlash ..make sure you have your bases covered.

I have contributed $50.00 so far. I think good way is to create spreadsheet showing member names and contributions, make link to it. Whoever wants to see, they can always look it. But I think we should not make it mandatory to contribute for becoming a member. Any advice / opinion is valuable for IV.

If you put the IOs into situation where they can potentially make mistakes...
more often then not, they will make a mistake. Then you have to pay the USCIS to fix their own mistake by filing MTR. Not to mention unnecessary stress... That being said, everybody has different risk tolerance.

They can do a lot. on monday one mentioned that listeners should call a particular senators office and state their opinion against the bill, by tuesday 7000 had called the office.

My take: these talk radio hosts cannot do anything for our cause. They spend all the time in radio. Only lobbying works and that too a focussed effort. Our focus must be in getting the message across to the Judiciary Commitee members, then as many senators as possible. Next step will be with the house members and this is the most difficult task.
IV is doing this and the results are there in the form of amendments. On another track, Sen Cornyn has introduced a good point in his SKIL bill Section 402. This I am sure is the result of letter from someone affected by retrogression / backlog.
So, we can get results only by presenting our problems directly to Senators and Congressman.

Higher salary should not be a problem at all. Important thing is, the salary should be equal or above the prevailing wage at new location for that job classification at that position/level. PW also a survey of wage by DOL. It does not mean that one should not earn considerably more than average. Lets see an hypothetical example,
A young Software engineer joins microsoft using AC21 and dates Bill gates son/daughter and marry him/her. Bill gates increase that person salary to 1 million, but he/she continuously doing same SW engineer job. In that case 1 million salary should not be a problem for AC21, because it is higher than PW in seattle.
(Dont ask me why not if a person marry Bill gates son/daughter they can come in family category)
