    I know there will be many people who are working on their employer's payroll but keeping maximum share of their rate.

    I have my EAD and i want to switch my current company and move to a new
    one as my current company is keeping around 20% share.

    I am thinking of the following options:

    1st option) I have my Canadian PR and thinking of an option to join the current vendor directly. Incase my 485 is rejected, then i can move to Canada.
    In this case, i do not know how to run the paycheck and other related stuff to stay out of trouble for my current 485 processing.

    2nd Option) I can find an employer who will just keep around 5/hr from my share and keep me on their payroll. I can also keep myself on my H1b by having my H1 transfer done. I will take care of running the payroll from a third party.
    In this option i dont have to worry much as company will show me on its payroll and my H1b will be valid.

    I would appreciate response from people on this forum. I know someone might be doing it right now.
    Please suggest pros/cons of the above options.

    It just means somebody touched the case. The case is still at NSC.

    The previous message said that "my case was transfered from CA to NSC on Sept 12th 2007". I had been seeing the previous message for the past 9 months. Anyone knows what the new message means?

    Coincidentally, I had called today and spoke with an IO to check on the status of my 485. He said that within 30-60 days it should get assigned to an officer. Would this have any bearing on the new status message? I see an LUD with today's date.

    Congrats for the painless Visa stamping.

    If you are on EAD before leaving US, you better to continue the same status. Their might be a situation for USCIS considering giving up your AOS, if you enter US on H1b while you were on EAD before leaving US.

    Are you saying that

    I should use my AP to enter the USA and not the H1?
    And then ofcourse I will have to continue using EAD.

    OR are you saying?

    I should enter on H1, but use EAD ?
    Wont that invalidate my H1 stamp for any future use?

    Secondly, Arent the h1 and l1 visa holders allowed to have dual intent?
    Why would they reject my 485, just because I used an H1 to re-enter?
    I have seen posts on this site where people have entered back on H1 despite 485 pending.

    Can someone clarify and help on my situation ?

    Did you file for I-485? If so, what is the address mentioned in the I-485 application? If it is US address, then you should be residing at that address.

    I-485 application indicates that beneficiary is residing in the USA and applying for adjustment of status.

    The address on 485 is a US address. I was in Jersey City when my firm applied for 485. However, subsequent to 180 days of filing, I transferred to Detroit practive with the same firm. And, I provided my cousin's address in Detroit where I lived temporarily. Subsequent to that, I moved to Windsor, Canada, because it is a nicer place to live.

    I did consult with my attorney at that time, and she suggested that it is fine for me to live in Canada.

    gc_chahiye, Thanks for your response. So, can I be on H1 with my current employer, A, and on EAD with my new employer, B, simultaneously?

    Also, employer B might be able to start me on H1-B (my preference--just in case)--though as you said, B will have petition my new H1 for concurrent filing. My other option, of course, is to wait until Feb '08--though I'll miss out on a month's salary from B (not a biggie in order to not have any potential issues).

    Why dont you just work for your new employer in december on voluntary basis and take the salary in Jan as a signon bonus?. This way you will have a clean record of 6 months on H1.

    How is omnibus going to help guys who missed train?Most of the fixes(and for most part most of threads on this site) are for guys who have filed 485.I, along with lot of my friends, are early waiting for new H1Bs to get approved.Is ominibus going help us?

    It is Adjustment of Status (AOS) application for the I-485 that my company/lawyers filed in 2007 August.

    Was your I-140 approved? In my case I have I-140 approved and have moved to another job with EAD but havent informed my old employer ,so now my question is if he revokes I-140 will it affect my GC at the I-1485 stage?

    I havent sent the notice to USCIS yet.

    Why is this topic being discussed. masters, no masters, eb2/eb3/ India vs china vs world. Who cares?
    Do you think the politicians or their staff understand these nuances? do they understand any of the steps? I140/i1485/labor? NO. And nobody cares.

    FOR ONCE, if we all get united and rally behind IV, NOT GET DISTRACTED, WE CAN ACHIEVE SOMETHING FOR EVERYBODY.

    There is a golden opportunity right now for once to eliminate all backlog

    Please take the action item seriously and after you have sent emails out, Please encourage others to do the same.
    Then take appointments at your congressman/woman/senators office next week. Ask them to support the two ammendments to the DREAM ACT. That is it!!

    Do not talk about any other issue while at the appointment, the message we need right now is for them (the lawmakers) is to support those two ammendments, DO NOT DILUTE THE MESSAGE By adding/confusing them with other related issues or personal issues.

    Imagine if we all are united and stuck to the message, next week and week after if there are hundreds (wish thousands) of us going into our lawmakers offices and asking for these -just two ammendments. The message will be loud and clear and they might just get it.
    Imagine this vs the second scenario where members go in and are inconsistent and talk about all the problems in the Immigration-Universe- EAD Delays, Masters, H1/EB3/EB2/QUOTA?. They will not understand any of this and it will confuse them thinking each one of us has a small unique problem-

    That is why we need everybody to be consistent and focus on the message. It will make them take notice and gain their support.

    You can appeal quoting your friend got approved. I have seen in the past, people got their approvals in appeal.

    I am not sure if this can be a good defense for ability to pay issues. Employer's revenue/profits drive the number of employees that can be sponsored for GC. It is not everyone or no one scenario.

    Nope, no FP notice for me yet. I am still waiting on the receipts, however, I was able to get the Receipt# by calling USCIS few days back.

    Any FP notices for folks falling in this category?

    got my receipts from CSC, filed at NSC, details in signature
    checks not yet cashed, no receipt for 131.

    I read in one of the posts in here that for case being sent to California, the EAD and AP are being cleared much faster than other service centers...


    Does anyone has any idea about this?????

    there is no "Permanent" Job in us, I assume you are now atleast 5 years old or having masters degree... we already have these in place...

    Why a asylee or gc lottery guy should be hired before a skilled person and he is not comparing apples to apples... no country limits and elimate backlog by recap anything else is waste of time ...

    The pdf file in your post indicates that you would qualify for in-state tuition if you have filed for GC. How does the university determine that you have filed for GC? After you have filed for labor or filed for 140 or only after filing of 485? Those 3 dates could be years apart and depending on how the university defines that you have filed for GC could determine the residency status. If you have any further information, please share.



    They only accept filing of I-485. I submitted an appeal after I file I-485 before my son's status fo in-state tuition was approved.

    I have got FP appt notice 7 days back. I am July 2nd filer, filed at NSC, but transferred to CSC and then back to NSC. Also, got AP and EAD approved long time back from CSC.

    I had seen a similar thread for NSC->CSC->NSC filers, but can't seem to find it anymore---did anyone whose cases got transferred to CSC receive FP notice?

    I am a July 2nd filer, EAD/AP approved from CSC, case transferred back to NSC back in early Sept--still waiting for FP notice for over 4 months now.


    PS: I am not desperate for FP notice---and i know it's going to be several years wait--just want to get the FP done and move to an apartment with lesser rent :-)

    Employee is responsible for the accuracy of the time sheet submitted for payroll. If Nathuram-daulathram-desi-Company pays you and we did not get the money from the client, he/she are responsible to reimburse Nathuram-daulathram-desi-Company all the amount that is under dispute within 5 business days. Employee is responsible for all the legal and administrative costs (attorney, collections etc) for enforcing the above terms. All disputes will be settled according to the laws of the sate of NJ.


    Are you serious you want to sign something with that wording. If the employer and client have their own agreements (like delay of payment for 60 days or so), then you will be always struck with your employer until the end of this project.
    This is unacceptable.

    One of my friends had an agreement like this and they threatened to cancel H1B if he did not sign. Make sure you have your transfer papers ready if they take that extreme step

    Yes, you'll have to get it registered.

    It is not big deal. Just ask your parents to get in touch with a document writer (guys who'll be sitting in front of Registrar offices) and they'll do it for you. Your mom and dad may need to go and sign the docs in front of the registrar.

    both mom and dad or one of them is OK?
    Does the registrat allow such affidavits to be signed in his/her presence. What role do they have? Do they attest that the affidavit was prepared in his/her presence?
    An notarized affidavit on Rs 100/- deed paper (or whatever you call that) is not OK?
