The day I got the email ( April 9 ) from TSC, I received an "unknown" call on my cell phone. I was in a meeting and was unable to take the call. Couple of days back I received a similar call and it was from an immigration officer @ TSC. She chatted with me regarding my old 140 for 2 minutes and told me that the priority date has been ported / used. I think the nice lady wanted to let me know about the approval and since I did not pick up the call generated an email from the OLD TSC system !!!!! . There is no update on the online system after wards.. I will update once I get something in regular mail..

ask lawyer to file MTR and resend response to RFE along with it. You should get a quick response (within 4-6 weeks). If MTR is denied, ask to file appeal, but sometimes it's better to change employer and start from scratch. Appeal can be a long process.

I added this process:
1. Senate Judiciary mark up and pass bill proposal
2. Senate majority leader schedule floor discussion. If bill do not have support of more than 60% Senators, Motion of Cloture can not pass and bill may have indefinite discussion and amendments. It is important to have more than 60% member's support otherwise bill have no future. Senate Kennedy is trying to negotiate with both parties to have more than 60 senators in favor of bill.
3. Senate Pass bill
4. Step 1 to 3 are separately done at House
5. If the language of bill passed by House and Senate is not same, it will go to House/Senate conference committee. It is in power jurisdiction of House and Senate leadership to appoint committee members and their schedule. Last year, House leadership didn't appoint committee for CIR.
6. Conference committee will remove all inconsistency of the bill and approve bill with common language.
7. Senate and House separately pass/fail conference approved bill with limited discussion and no amendments.
8. If it pass by both House and Senate, President will sign it or use veto to the bill.

I finished my AMIE in three years and I am in trouble.
If you took four or more, then you are lucky.
May be you can request a letter from IE, Calcutta mentioning the timeframe you took to finish AMIE.
That helps to support AMIE is a four years degree.
Regarding MTR, may be you can tell your attorney that similar AMIE applicants got I-140 approvals and your bad luch that it got stuck.
If your ed eval says you have bachelors, then you can tell your attorney that you have the qualification and you want try one more time.
My personal recommendation is go for another new labor with EB3 and draft it accoring to your qualifications.
Once the I-140 is rejected, then it is a bad remark.
All next I-140's will be linked and tracked. So it is difficult to convince USCIS that you have bachelors. Even though you go for MTR, you can buy time and it is hard to get positive results from USCIS. This is all my guess.
It is always better to go for EB3 new labor as you have some time.

My Vermont ext says received on Jan 9th and i see a LUD on Feb 17th but after that pindrop silence - no movement.
Dont understand what that LUD means , earlier i always got approval within 7-15 days of LUD from Vermont.

I've gone through the pretty much same situation and had a hell of time
with it.
The best way in my opinion is:
1. Stamp H1B with latest approval from India(Home country) is the BEST way.
2. If you have the approval right now goto Mexico or Canada and stamp it.
3. Show the new approval letter to the POE and beg him to give the new data ( Mar 2007). ( Incase you dont stamp VISA).
4) Incase you dont want to stamp and at POE officer gave you Feb28, immediately after reaching here, do an amendment on you H1B saying
a slight change in job description. ( Like add one more thing in your responsibilites or whatever)
If he gives Mar 2007 on I-94 you are okay. If he give Feb 28 that would
create problems. I did not know it first time and found it after the date expired on the I-94. Murthy advised me to do an H1B amendment. So I had to spend about 3grands on this. Atty said technically I had some 2 months out of status stay. I travelled out after this incident. Nothing happened to
me on the way back. So I guess everything is okay.
I would recommend as clean as you could with these things, since doing business with USCIS is an ugly one.

3. If you pick C9 for Eligibility Status Question, we have a Text box for the question, please provide information concerning your eligibility status.. what should we fill in this box?

So I am in some real mess ....
I married to a gal in 2007 during my visit to my home country but it did not work out b/w her and me due to some family reasons. (Not divorced just separated)
I came back to US in 2008 and applied for 485. My green card got approved and now my wife is in my home country and I am in US.
Now my wife and I have reconciled and I want to bring her to US.
Can I apply for her Green card and bring back to US ASAP w/o waiting for 5 years as I married before approval of my GC. I can get papers from my home country showing that I got married way before my GC approval.
I did not show at any stage in GC application that I was ever married. I thought the marriage is gone so why show it and now it could hurt me. I even dont remember if there was any question regarding marital status on 485 application.
Please help me other wise I would just have to cancel my GC and go back to H1 to bring my wife here. I cant leave her any more with our stupid relatives who might again break our marriage.

This case has been sent to our DES MOINES, IA location. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case. Does anyone know whats the protocol for the Bill to be passed???
After the Floor Debate the bill goes to White House or again there has to some measures taken from Senate???? I know there some initiative taken in Senate (last year)..
