Today I was talking to IO in Texas service center, during discussion I told her that India dates might retrogress.. can you please expedite my case. For that she replied that " that's what they are doing"

I have been on H4 since 2000. I once got an H1-B in the year 01, but did not get to work. Meanwhile my H4 got extended till now.
With the recent changes of de-coupling H1 & H4.......
My question is can I use the previous H1-B issued in 01 and apply for COS without any cap restrictions ? And can this be used by a new Employer ?
Appreciate any responses on this. Thanks

It is unbelievable how much emphasis is being given to the family based immigration when this bill strives to eliminate their backlog!!! ......and amazingly enough there are very few voices (IV being one) that are really crying about the injustice to the employment based GC and H1 programs..........we have to work on getting through to mainstream media guys......its unbelievable that we are not even on the board as far as close door immigration deal negotiations are concerned.........

I really am not able to understand your education pattern
10 = Std 10th
+2 = Std 12th I assume
+1 = Is this the commerce 1st year?
+3 sounds to be your diploma right? now what was eligiblity for the diploma 10th or 12th? I am assuming it was 10? since it was 3 years course.
My friend I hate to be sounding pessimistic but your education might add upto 16 years but it is not progressive 16 years as required for a bachelors program, most of it is redundant. your +2 (12th grade) and diploma are overlapping. Your +1 is completely tangential to your course work. It is same as some one doing 1st year courses for 3 different strems example 1st year Science , 1st year arts and 1st year commerce and then claiming he has equivalent of 3 years bachelors course work completed and so he be awarded a bachelors degree.
Please dont feel bad. I do not want to give you any false hopes. Please consult some proffessional evaluators to check if there is a way they can make your education sound progressive but looking at USCIS response you pasted they have evaluated your diploma and cannot accept it as equivalent to degree program. Or saying I have 2 Masters degree so count it as equivalent to a PhD that cannot happen even if the person might have completed equal number of credits as PhD still it is at masters level and not at PhD level plus they are not cumulative which will be the most sticking out point.
I dont know who will pay for the MTR + refiling in case your employer is going to shoulder these expenses then there is really no harm in trying but if it is you who has to pay for appeals then my friend it will be better if you consult education evaluators and some other lawyers like Murthy, Khanna to get a second opinion before you embark on this long and costly journey.

I agree with most of the comments, the backlog definitely seems to be the overbearing issue here. The USCIS has faced a great deal of criticism because of this backlog, which many people argue is highly unfair. I'm also suffering like you for years but doing a RE-FILE just for managing bad odds is not reasonable. If they reject your application - You should be able to resend it from FEDEX/USPS signature and receipt Notice even after Aug 17th.
I'm not a lawyer and i've nothing against Rajaiv Khanna but on a general i'm advising you that " Any lawyer wants their clients case get complicated and convoluted". By doing this you/we are just complicating our case and offering "Money making" potential to already Rich , Wealthy ,Cut throat Lawyers.

We already have a 12 member offshore team...the average asking rate (H1s and citizens) is 90K ..H1B quota restriction is working in our favor very much. Market rate for IT professionals has increased quite handsomely..put ur resume out to dice or monster and see for urselves.

If the hosung markets turned down like the NASDAQ 5 yrs ago, and brought down the whole economy with it, then as a result of the ensuing economic recession you lost one, two or all 3 of your jobs and ended up in negative equity, could not find a new job sponsoring H1b due to the deep recession and your greencard is nowhere in the near future. Would you still feel as secure and happy? I am not sure what country you are from, but would you make a salary close to what you are making here?
Security my friend, thats what a green card brings. I applaud you on your courage and bravery in just taking a chance and doing all these things, you will likely be fine and get your green card eventually but taking risks can bring consequences as well. Many people are more risk averse than you.
A GC is going to make finding a job a lot easier & is going to make you feel much more secure than a H1 is a fallacy in my opinion. I think, if you currently have a H1 job, you have proved your worthiness in the job market. In fact, you are probably better off than a GC holder, since you are forced to be on your toes to maintain and update your skill set for fear of the difficulty in finding another H1 job.
I have plenty of (EB) GC friends around me who got their GCs through their job through the 1996-2000 .com boom, but now have trouble finding their 1st right job, post the GC. They missed out on the 2002-2005 housing boom, all the time while I, on a H1 was reaping the fruits of taking the risk and getting in while still waiting out on my GC.
Besides, in a global economy US jobs themselves are far less secure than during any other times in modern day history, so even a US citizenship is not going to make one feel secure with regards to employment.
What is going to make you feel secure ultimately is being well qualified & well skilled. For people with the right qualifications and skills there will always be a H1 job (or for that matter a well paid job no matter what the geography) out there. In my opinion, having the right skills and qualifications is one's security, and that�s what I have always banked on while moving so forward on a H1.

1) Unless we get lot more folks involved, it will be a tough task. A small number for a DC rally or a few hundreds doing phone campaign will not achieve much.
2) Indian community (including GC holders, Citizens and highly placed individuals) would need to be involved if this has to become a visible voice.
The best way to achieve these objectives is by taking it upon ourselves and reach out to these people. Unless enough awareness is generated, our campiagns will not generate enough heat to power the bills forward.
