If DOS has set the priority date for EB2 India to Jun 2006, and USCIS does not want to waste visas, they have no other choice but to forward the processing dates at NSC/TSC. Even though the 485 processing dates may not move significantly in much awaited July Processing dates publishing, the August Processing dates bulletin will show the massive forward movement (485 processing date will reach till June 2006).

Question is what happens if I decide to withdraw the H1b App
Or just change the job .. will then still then keep RFE alive?
If my employer won't give the wage reports etc. today.. he's definitely not going to give me that even in future then..

Hey, I just added this one line to the composed content and sent it to KXAN news Austin to a immigrant reporter who highlighted legal immigrant document woes (for Mexicans though) yesterday night. He replied quite promptly.
Added content:
Would you and your station be kind enough to highlight our plight? We may not be 12 million in numbers but we do contribute in dollars the same number on a daily basis
Reply from Matt Flener:
<snip>
Surendra,
Be assured I received your email and REALLY want to follow-up with you. I would love to highlight your story. I will try and give you a call this weekend, or Monday at the latest. Thank you for your email.
</snip>
If I do get a call this weekend, it would be nice to receive support from like-minded people in Austin. We could meet him at Coffee Shop or at my apartment. Alternatively, if he agress to interview via telephone, then I would love to include one from immigrationvoice core itself to highlight the woes more appropriately.
Let me know and by the way thanks for composing..

My application reached USCIS on Aug 14th.
How do you guys get to track the status online, do you get the receipt and then track it online.
I am from arizona and dont know which place my lawyer filed the I 485 app with EAD and AP. Is it that applications from arizona go to a specific location so that i can go to USCIS website and get some approximate date.
Please do let me know.
Thanks.
Yes, you create an online account on https://egov.uscis.gov/cris/jsps/login.jsp with the provided receipt numbers.
You can also choose to get email notifications every time there is a change in status for any of your applications.

I am still waiting. I created a SR and reply was to wait for biometrics. I am going to India in dec. Any recommendation on what to do if I still have not got the card?
Take Infopass appt, take your approval notice and mention that you need to travel and your spouse has a job offer.
Which service center has processed your case?

My suggestion is not to insult or hurt anybody. I understand the purpose of immigrationvoice. I am a contributor and will continue to support IV. However the way people hijack threads really pisses me off. The leaders of IV should figure out a better way to motivate people to donate. If people are not inclined then stop calling them names etc. I am not talking about anybody in particular. If somebody is not inclined it is not completely his/her fault. The coercive tactics some people use on the forum to make people donate actually does piss of a lot of people. I am nor talking about anybody in particular, but this is NOT the way to motivate people to contribute.
Sorry if I heart anybody feelings.
And I will donate to IV again..
I understand your point but theres been barely three fundraising threads to my knowledge in the whole existence of iv. and frankly ppl are just waiting to get offended - grow up ppl!

I got an RFE for I-131 for both myself and my wife. They have asked for absolutely everything (I-485 receipt, I-140 approval, I-94s, I-797s, marriage certificate, Passport copies etc). As my lawyer said "they have thrown the kitchen sink at you".
I dont even know why - but the amount of documentation they have asked for seems absurd just to issue a travel document.
BTW - my EAD from the sample application was approved!

yeah but its time anyway for the August VB, and its VERY interesting to see what they say. If they put everything as U, they are potentially in trouble, as they have apparently returned unused visas to DOS. So there are unused visas...

This is the address I got when I submitted my application online.
U.S. Mail:
USCIS Texas Service Center
Attn: E-Filed I-765
P.O. Box 852401
Mesquite, TX 75185-2401
Guys,
I live in NJ and I had sent my EAD renewal package to the following address via USPS certified mail:
USCIS
Texas Service Center
P.O. Box 851041
Mesquite, TX 75185-1041
When I tracked my receipt today (for both mine and my wife's package), I got the following status:
Status: Notice Left
We attempted to deliver your item at 1:47 PM on May 9, 2008 in MESQUITE, TX 75185 and a notice was left. It can be redelivered or picked up at the Post Office. If the item is unclaimed, it will be returned to the sender. Information, if available, is updated every evening. Please check again later.
Can any one tell me if I have used incorrect mailing address or is this status normal? Do I need to do anything about it?
Thanks a bunch. Your replies will be appreciated.

I appreciate your response even if the guy is not a donor. Great job.
I thought about that for a minute too. This guy has joined on Dec 06, don't know if he made any financial contribution, don't know if he acted upon any action items IV core requested us to do (hopefully he did)
But IV core stepped in to help this guy, that shows the commitment of the leadership team to help everyone.
You guys rock!

sam_hoosier,
You are correct to the 'could' part.
Let me begin my explanation by stating my position on debt default:It is bad, it' NOT worth it and don't ever do it. With the explanation that I will be providing below, I don't want to sound like I'm encouraging debt defaulting, which I'm absolutely NOT. There are severe consequences for your credit, if you default a debt.
So, with that accusation out of my way :), let me explain the logic behind why I think OP is ok. Only thing that is in OP's favor is statutory time-limits, he had dodged the debt bullet for 5 years, afaik, creditors including the collection agencies lose their right to take him to court for a debt older than 5 years from the first date of default. Unless, OP makes some kind of partial payment now, which will bring the debt to current. At this point it will be a mistake for OP to do that. Collection agencies force him to do that mistake with all kinds of scary tactics -- He got to have a thick skin to settle the debt with whatever he can afford once for all.
Secondly, collection agencies buy debt in bulk, like 1000 defaults at a time. Collection agencies go through a rigorous screening processes, including threatening phone calls, attorney-letter-head notifications etc, for each debt, even before they can take it to court. When they could not talk to him or trace him or find any utility bills of him for 5 years, they would just consider him as MIA. Unless this guy is a rich dude with Hummers parked outside his mansion all the time Or has couple of rental properties on his name, they will not risk further investment on this particular debt.
Like always, my 2 cents.
I stand by my suggestion that OP must seek help from a Govt or a not-for-profit Debt Help or the best thing is to seek Attorney's help if you can afford. Don't go to the collection agency or to any of your debtors first.
Best!
Your comment is factually incorrect.
The creditor (or collection agency) can take you to court. If you don’t show up,the judge rules in favor of the creditor and against you. However, this judgment is just an acknowledgement that you owe the money.
In order to collect another court date must be assigned to perform a ‘writ of execution’. If they summon you for this, and you don’t appear, they may issue a bench warrant for your arrest.
If the amount is small enough, the creditor may just write it off (with impact to your credit history). But if its big enough they could go down the legal route.

....does PD porting require that the new GC application have exactly the same job profile as the one for which the original Labor was filed and I-140 approved?
No.
The only requirement is that both I-140 must have same beneficiary and all I-140 must belong to eb-1, eb-2, OR eb-3 preference categories.
The Priority Date recapture applies ONLY for immigrant petitions (I-140) approved under EB-1, EB-2 or EB-3 classification.

Thanks, But how would I know the case number? Because it was filed by my company and I dont have any clue.
Also do you think there is any value in at least getting total number of LCs certified, by date and then basing our assumptions by proportioning how much each category is retrogressed? If we can actually get the real number and then making certain assumptions might still be more realistic than now when we dont know anything about how many LCs are in the queue. We might as well assume that those whose prority date is on or earlier than the certified date are approved (even if they are not) because they should be getting approved in a few months time. Especially EB3-I as I dont see rampant jumps in the priority date, you know what I mean?
To answer your questions.. I could narrow the search down by case number as well as Employer name. That should hopefully pinpoint your case. The SOC code is the one you use to ensure same or similar per AC21. You can get the descriptions from the SOC classifications. Just Google SOC job Classification and you should get it.
I had done some analysis as you suggest for EB3 India a while back, but was hampered by the fact that there is no information on country of chargeability for pre-perm cases.

i believe that whatever the above stories convey it does not apply to skilled workers......life in india/china has got better only in the last 5-7 years....otherwise i have seen above average people in india retire with barely enough to live a good life.
if a skilled worker spends 6-7 years in usa with good financial planning he can easily retire, unless one has really started living the dream(big car....big house...all the latest gadgets....yearly india trip...etc..)
i do agree that this story can be related to a non-skilled worker from any country....(even below average americans have nothing except for social security when they retire....)
techy2468 I hope you are kidding & r not serious :) . If you are then u need to meet someone (ofcourse skilled professional) who came 6 /7 yrs ago & ask his opinion on retirement or check out where he stands.
You did not mention any figures (would love to see them from you as well as others reading this thread ) so not sure what you consider to be good savings/financial planning for retirement ?
According to you all those who came in 1999/2000 have enough savings & can start thinking of retirement now.
Do you all guys agree to this or is it only me who is still poor :D ?
Here are some approximate figures, which i hope go for most of the skilled professionals
Assume billing rate: $90K - $100K per year
Consulting Company cut $ 30K - 40K per year
Let's say average salary is: $60K ( i know many professionals r working for even less but let's include some little rich guys too :) )
Now 60K means $5K salary per month
After Family Health Insurance (considering married) & taxes salary in hand is $3500 to $4000
Let's take $4000 in hand
Now expenses :-
House rent : $850
Car Insurance : $150
Car Loan payment : $250 (assuming used Toyota/Honda for 8K - 12K, No big dreams :) or rich lifestyle )
House Utilities bill : $150 (like water, electricity etc)
Cable/Internet/phone : $75 ( No HBO or special channels - No big dreams :) )
Grocery : $500
Eating out once a week : $125
Lunch out : $0 ( ask your wife to give u lunch :D - No big dreams)
Misc $300
Total monthly expenses $2400
(living an average middlecalss lifestyle)
Savings per month 4000 - 2400 = $1600
Now in 6 - 7 yrs (assuming the person worked like a "Donkey" :D with not a single vacation , no trips to india)
12months X 6/7yrs X 1600savings = $ 115,200/ $134,400 (Total Savings)
Do you really think this is sufficient to buy a house & lead a retired life either here or in india ???? or maybe i hv started thinking big :D
(By the way even after 6 yrs i don't hv anything close to above figure -maybe because i did't live/work like a donkey)

I got an RFE on Nov 15th for copies of my degree certificates and my attorney sent them in a few after getting the RFE notice. I had an LUD on Nov 30th (Date when they received response to RFE) saying case processing has resumed. I also have another LUD on Dec 2nd. But the status still says case processing resumed. Does anyone know why there are 2 LUD's even though the case status is the same. Does it mean anything?
Relax, LUDS could be internal updates no one can tell you with absolute certainty what they mean. I saw this whole thread you are in panic mode and restless. Just relax man your case will be approved soon.Think of it this that they are working on your case not like others who have filed and heir cases are lying on the shelf.
