USCIS is trying to make EB2 all countries Current sometime during FY 2009. Of course "a few" 2004, 2005 cases will still be pending past Oct08 but hopefully not too many.
If EB1 and EB2 are shown as current soon, then the DOS can transfer the so-called "spillover" into EB3 ROW, then into EB3 IN & CH.
Based on available numbers, EB3 India / China will see rapid movement in dates April 09 Visa Bulletin onwards.
What will happen during 2009 in all likelihood is the following,
Almost all EB1 spillover will go to EB3. (~ 25k)
Some of EB1 and all of EB2 spillover will go to EB2 IN/CH (~ 10k to 15k)

Guys and Gals,
I decided to go with my credit union and called them this morning to lock the rates. I just received some disclosures and rate lock agreement, when I was reading it, there was a section where it asks "Are you a U.S citizen?", loan office assumed that I'm a citizen and checked the box.
I understand that I should tell them the truth, but wondering if that may increase my interest rates. Please share your experience or advice you may have for me.

I am going to India for couple months and plans to return back on AP.I am planning to get my passport Renewal in India.Is it OK to Renew in India as it shows my India address.

I think its easier to get the PP renewal done in US as it can be done via mail.
But i think its equally easy to get it done in India. I got my passport renewed within a week in India just last month. There is a 'Tatkal Service' for passport and you can apply under that and get your passport renewed very quickly.
One thing though, if you change your address on Passport, then it may go for police verification, but if nothing chnages on ur passport, you can get it back quickly in using Tatkal...hopefully within 1 week like i did.

Berkleybee isn't saying anything in that conversation with DOS which isn't already covered by the law or the note in 2005 visa bulletin.
Still; everyone is thinking it is a mistake and it is going to get current in 3 to 4months?
The cynic in me believes that everyone thinks it is just a matter of time before it becomes current or there is significant movements in dates. This is dead wrong. All one needs to do is look at data coming out from backlog processing centers; amount of 245i labors; statistics on how many people have come on h-1b; l-1's, b visas, f visas, amont of perm labor approvals; amount of greencards approved over the last five years.
It is going to be a very, very long time before there is significant movement in dates.
The cynic in me thinks Berkleybee posted it in immigration.com so that people may now get the message the dates aren't going to move. They aren't going to move significantly next year either. There is TOO many people going for greencards.
As long as people think that the dates are going to move, then they sit on the fence and don't do much to get rid of retrogression.
I am sure if people could get convinced that in current environment; visa dates will never get current then people may have some urgency in participating to get rid of retrogression.

So how are you going to pay off your house if you've no money? Do you mean you are going to sell it and pay off mortgage? But in current market your house value would be less than what you owe, so you may end up owing more to mortgage company than what you'll get after selling house.

We bought a house last year needless to say that the prices have fallen. We are now in a dazed state as we just realised we don't have any savings, whatever we had, we made bad choices - house, 2 cars (They looked good at that time though) and put about 10% on the house.
We were planning on to invest all our savings in the house as we recently paid off our two cars and no other debts. But after reading some posts here on the housing and investment market. I am not sure if I want to put everything in the house, having my job at risk and no GC yet.
Being a novice in fianancial matters, need advice.

1. How many days is required to get a H1b transfer receipt.
-- upto 1 or 2 weeks if it's Premium
-- Upto 2 or 4 weeks for regular. Looking at your case, your lawyer probably already has receipt Number.
2. What happens if my H1B expires before i get a receipt.
-- Nothing, you will get a receipt sometime , so long as you get a receipt that will have date of receipt as you originally sent it. If you are afraid your company didn't actually send it, then
3. Should i go on EAD or continue on H1B. My wife is a green card holder for last 3 years 6 months.
That decision has no relation to pending h1. You can choose to go to EAD anytime. Looking at your situation, you are probably better of on EAD. Your wife will eligible for citizenship in 18 months then she can apply for naturalization, I think even now you can probably apply as spousal category so really no reason for you to be on h1 ..(Not entire sure abot this.. check with family immigration lawyer)

1) DOS releases July visa bulletin making all EB categories current (except for other workers)...hoping to force the USCIS to adjudicate cases and avoid wasting visa numbers as in previous years
2) This infuriates USCIS, and for whatever reasons (this has been debated enough already), they decide to use up all the FY2007 visa numbers in June itself and then force the DOS to revise the July bulletin in June itself...so no one can file in July.
3) Unfortunately, they run into issues going through with their plan of using up all visa numbers in June
4) July 1st and morning of July 2nd...they still are working frantically to use up the numbers to avoid new July filers. But by now, it is July already and they have failed in their original mission (see 2 above). Now they start panicking and do some dumb stuff (in violation of their own regulations). They approve I-485's of some folks who were ready for approval (processing complete and FBI check cleared), but whose dates were not current. They also pre-requested some numbers for folks whose dates were current, but processing was not complete i.e. FBI check was not cleared.
5) Late morning July 2nd: By requesting all available numbers from DOS and exhausting FY2007 quota, they forced DOS to revise the July bulletin, which was unprecedented.
6) July 5th and later: It is now post July-2nd, and USCIS still has cases for which they pre-requested numbers. Now the problem is that even if the FBI check comes through for those cases, they cannot approve them because technically, all numbers have been used up for FY 2007. So they start returning numbers to DOS. They also decide NOT the send the applications of people who filed on July 2nd or later back while they decide on the next course of action...
I think this will have major implications for both USCIS and DOS. The key for USCIS was to exhaust visa numbers on or before June 29th to achieve their obejective without repercussions...and force DOS to revise the bulletin in June itself...and they failed miserably at it.
And now they will have to pay. I know some people are thinking please let USCIS just sweep it under the carpet and just allow us to file our cases...no harm done. But I diasgree...what they have done is shameful. And they should be made to pay for playing with our lives. They should never be able to even think of doing something like this again.
