One more question is right now my wife is on H4, My I140 and 485 are in pending, if my wife got EAD she can use it right?
2) If my I140 denied and her EAD become Void, Is she permitted to stay in USA or She needs to go out of country and enter with h4 status?

I do know that you guys will be safe on your H1 and H4 status. I do not know for sure if she needs to go out of the country and re-enter on H4..I've heard something like that before though..

I have been on H1B for 3000 days so far and I am still waiting for GC, (filed for 140/485 in November) and I thought I have been waiting for too long, but it looks like one of these people might actually qualify for Guinness Book.
3000 days might seem small when compared to a member's data whom I spoke with during the Sept Rally time. He has been here on a work visa since 1994 and unfortunately he had to start his greencard process several times. He was thankful that he finally got his I140 approved and filed I485 this year after such a long wait.
He was calling members and asking them to join the rally as he truly values IV and the fact that due to IV he could file his I485. I was very impressed with his dedication for IV and also felt sorry that he and his family had to endure such a long wait.

a recapture helps everone by moving the line forward and making dates current. there is also a parallel effort on to bring changes like 485 filing without PD being current. so no one ie being left behind or ignored. these efforts will help all of us affected by retrogression and stuck in different stages.

Exempt from the H-1B cap; not the EB cap. See line 14 on page 2 of H.R. 5630 (http://frwebgate.access.gpo.gov/cgi-bin/getdoc.cgi?dbname=110_cong_bills&docid=f:h5630ih.txt.pdf).

Did I mention EB cap in my earlier post? I mentioned CAP which does not conclude that it is EB cap. I went through the bill too.
No offence to anyone. Of all the drama that was going on from Jan 2006 until now, I feel (+ve) that our issues(EB relief) will be taken into consideration only when they come to the topic of making the illegals into legal residents of this country. Any immigration debate in Congress cannot be taken up without considering the Illegal Issue.
We will see and will be surprised to see that an illegal will be granted a status independent of an employer and will also have the travel permit and he/she can live here forever renewing his status.

Please do not mix social issues with immigration, this is not a forum about one particular country or its social manifestations (like how do I marry?, should I stay single forever? How am I going to find a girl?). These questions are absurd from American / immigration standpoint. If you already have a spouse and have immigration issues related to those situations then yes that is valid to ask here but otherwise (But how do I get the spouse then???) is purely a social / cultural issue. Please stick to immigration issues.

Curios, is your employer desi. Wait for sometime, tell him that you need to go to your home country and need receipt notice to use your AP in return. Catch is you have to use your EAD & AP after return.
There's no catch at all.....according to my lawyer. He said even if you come back on AP, you can still work on your H-1B so long as it's valid.

Hi, all,
I think my situation is a little complicated as follow: while I am still in F1 status and visa (2.5 months before graduation), one company filed I-140 petition for me on EB3(May. 2006), I applied for OPT EAD card and got it approved on Sep, 2006. Then my previous I-140 got approved on Dec. 2006. And now I am using my OPT EAD working in another company, and will start my H1B application with the current company soon.
I am wondering if the previous I-140 application with previous company affects my current H1B application with my current company? Since it was filed while I was in F1 status(even before OPT EAD approval), some said it is not allowed...
I am really concerned about this now... please advise ..

You have already violated your F1 status. You can not have a company apply for PERM & i140 while on F1 status, period. All that stuff of "it�s for a future position" or "you did not authorize the company to apply for I 140" is B.S. The only thing that matters is that F1 is not a dual intent visa, and initiating a immigrant process in your name (yes the PERM and I140 applications have your name on it meaning you authorized it) means you violated F1 status. You need to consult an attorney before you file for H1.
Your answer is incorrect as far as I know. Please do a little research before giving such answers.

guys i think USCIS is not interested in giving EB 3 guys GC...
as mostly EB 3 guys r ppl with Bachelors (and less than 5 yrs exp) or who are stuck with EB3 due to there company (like me)...
EB 2 guys r mostly with ppl having masters degree from US...so i guess they will definetly get more preference than eb3...
I guess US wants to raise there economy by giving GCs...so that ppl more ppl will buy houses....
I hope something happens for EB3 also...but I guess in Oct bulletin PD for EB3 will b some month in 2001....
so gud luck to all of us

Thanks for your comment.I am afraid you mis understood what I said medicine and pharnact vet med etc. There are practitioners in these fields called MD, DVM, PHARM D etc. However there are many more PhD students who do research in these fields. And they are not listed as STEM graduates. I guess whoever did this listing of the STEM majors don't really have much knowledge about various fields of research and also they ignored the highly multidisciplanary nature of the current day research. I hope more people will start taking this issue seriously.

Thanks gcpool for your reply. My question though is that is it pretty much guaranteed that the green card will come through after the 140 clears? I ask because just today the USCIS website updated to say that they sent out a RFE for our 140.
The risk/reward matrix for my situation is as follows:
Stay in USA/green card comes = most assurance of good job and pay.
Go to Canada/green card denied= harder to find job and less pay, but at least not deported.
Go to Canada/green card comes = I'll survive, but there's the possibility that I'll be kicking myself for a long time.
Stay in USA/green card denied = I'll probably jump off a building. :D
So you see it pretty much all depends on how much assurance there is of getting the green card after 140 clears.
