WASHINGTON, D.C.--The American Immigration Lawyers Association strongly condemns the bait and switch perpetrated by the federal government on thousands of intending immigrants who have waited in line for years and were following the rules for obtaining a "green card."
On June 13, 2007, the U.S. State Department announced that, as of July 2, individuals seeking permanent residence ("green cards") through employer sponsorship finally would be allowed to proceed with their applications. Applicants would have a short window, possibly only through July or perhaps August, to complete their paperwork.
Those intending immigrants, immediately and at great expense, rushed to gather final documents, complete their paperwork and obtain required medical exams. Many sent their applications off on Friday, June 29 for arrival on July 2 at the Department of Homeland Security, for the last phase of the multi-step process that leads to a green card.
However, on the very day the door was to open, DOS and DHS slammed it shut.
On July 2, DHS and DOS announced-based on no different information than they had on June 13 when they announced the opening of this filing door-that all applications would be turned away.
"People ask why those who come to the United States illegally can't just follow the rules," said Kathleen Campbell Walker, President of the American Immigration Lawyers Association. "But here people followed the rules and did everything right, yet without warning or explanation the door was slammed in their faces. This hoax perpetrated by these two government agencies is unconscionable, and is an example of how badly our immigration system is broken."
AILA calls on the Administration to do the right thing and keep its promise to the people affected by this sudden reversal. AILA also calls on Congress to get it right this time and fix our badly broken system.

Applicants would have a short window, possibly only through July or perhaps August, to complete their paperwork.

If you enter on AP, but have a valid H1 extension approval to xx date, and the xx date approaches and you are working for only the original H-1 employer maintaining ALL the conditions of H-1, you can request an extension of H1 status and if all is ok and it will be granted and you will get back on H1B non-immigrant status. But until such time, one is not considered in H1 non-immigrant status but "adjustee of status," which is NOT any non-immigrant status.

What IO told is correct. Untill the case 140 is not approved, EB information is not updated and IOs at the infopass has limited access.
If the 140 is approved, IOs at infopass can see this, otherwise they cant.
I was also under the same impression that IO at Infopass is able to see whether my case is in EB2 or EB3. She told me that she cannot see even though both of my I-140s are approved and interfiled(hoping success).

Let me be clear. my H1 is with a different employer than the future GC sponsor. I never worked for the GC sponsor and that is the reason wanting to get the H1 transferred to sponsoring company. As said I 140 approved and I 485 passed 180days.
I was under the impression that you can switch over to H1 from EAD easily.
if there is a gap of 40days will it be ok to file H1 transfer? assuming that I get the H1 approved. Will this gap any issue in 485 adjudication?

Its been more than 30 days since i mailed my application and checks are not cashed yet.
I called the uscis support center last week and was told to wait.
Not sure how long this is going to take.

To the bro who suggested I rather stay here than go back..well I work as a consultant thro a vendor hence that is not an option (thanks to the new memo).
Given the market is so hot in India right now and here new policies are made to make our life tougher, only makes one's consideration to move back stronger.
I will call up SSN office today and check out how much more is remaining of the 40 Q for me...will try and do that.
On RONR, I will find out and post here when I have any confirmed updates - but one thing I know for sure is:
Tax year starts on april 1st in India. If one stays atleast six months starting that date, he is still considered NRI. Hence say if you deposit 40,000 USD in SBI on may 20th...and return after october 10th, you are okay. No tax in that year..but if you came back before the six month, then there is some tax that you have to pay.
NON - RESIDENT STATUS UNDER THE INCOME TAX / WEALTH TAX ACT:
Condition Status
1. He is not in India for 182 days or more during the relevant previous year. >> If yes, then he is a non-resident.
(so check the next condition.)
2. He is not in India for 60 days or more during the previous year and he is not in India for 365 days or more during the 4 years prior to the previous year. >> If yes, then he is a non-resident.

If a person has a copy of 140 approval, can he/she port the PD even
if the employer revoke it?

Different lawyers have different opinion about it. Some believe you lose the PD once the 140 is revoked but others believe the PD is yours for life even if the underlying 140 is revoked later on.
There are some risks in changing jobs based on 140 and depending on your personal situation, you got to decide whether the risk is worthy or not.
One reason that all lawyers agree on is you can lose your PD if the 140 is revoked for fraud. But then thats a completely different ball game.

Very interesting. I thought affidavit from the mother or father along with a letter of non-availibility of birth certificate should be Ok.
Ofcourse the non-availibility is usally given in a piece of paper and not any official letter head. There might / might not even be an official seal in many cases.
Would be interesting to see what others think about your issue.

I similarly applied online on Dec 20th and haven't heard anything at all. I applied online and the documents were sent to the Neb office. Can you please share your details on I765 extension filing?
well, honestly speaking, it wasn't an extension. i am still on h1b, however it expires soon, so, i filed at texas service center, taking the 120 day period as the processing period.
what i mean by not an extension is that, i once applied for 765 when i filed by 485 during july 2007 fiasco, but later, i never bothered to renew it.

That is expected based on the number of I140s that would have been approved and ready for adjudication. Also, with priority dates moving forward, more applications from earlier dates come into play and the processing dates move back.
Hopefully, they start moving forward soon and go over the July / August 2007 hump.

I agree with High skilled educated "illiterates" version part. Sad, but this is a bitter truth.
I have many friends that have pending I-485 application and almost all them act/behave as if they are green card holders. May be, it is due to feel good factor. May be, they feel like GC holder as spouse can work and/or start business. Infact, when asked about visa status, they state that they are almost green card holder.
Well, I hope they all get green cards. Having said that, until I-485 is approved, person is not green card holder.
In my opinion, EAD is a step towards green card status as it allows some freedom (AC-21, spouse can work), but it is just that, a step.

Hello Everyone,
Hi I am a student in United States and I was on Optional Practical Training from Jan 2008 to Dec 2008. As I finished my OPT in Dec 2008 I joined again in New course for M.S in soft. Eng.
In the month of November I got a job in California through an employer, who is based in New Jersey. As I got a job the employer asked me to sign a contract which states that I will be paid 60,000 per year and I shouldn't work with his clients for 1 year after the agreement is terminated.
As the project was only for 40 days I finished it successfully and I my employer couldnt find me another job till now. So I decided to work on my own when I got an opportunity with the previously worked vendor, when my employer came to know about this he has threatened me to sue me. Then I retrieved from the opportunity but now even my employer doesnt pay me anything. It is been 4 months, he hasn't paid me anything , even he hasnt provided me any insurance.
I asked my employer couple of times to terminate my agreement otherwise I would go to Department of Labor and claim my wages but he downplays that by saying I am not on H1B so I will not be paid unless I am working with Client. But the agreement didn't say anything like that.
I have even asked him to run the payroll where I worked .I.e in California but he ran it in New Jersey. When I pointed this to him he said the payroll will be run at the residing state if the employee works more than 6 months.
We had an argument about this but he never replies to my emails he only calls me and says whatever he wants to say but when I ask him to put whatever he has said to me on phone in an email he doesnt reply at all.
And to mention, he doesnt have any documents of mine. I even didnt fill any I9 form, what ever he has is the only agreement that I signed and social security number that I emailed him to run my pay roll.
After the argument I even requested him to send my original agreement signed by two parties. I only had the agreement signed by me, he even didnt send me the agreement with his sign on it even after repeated requests.
Now he doesnt even care to answer my calls or emails. I am really tensed. I am getting opportunities from vendor that I worked with but I am afraid he would sue me. Please help me What to do. I am really really frustrated, tensed and I can't express how I feel right now.
I want to get out of the contract and work with the vendor if Possible.
Please explain me how can I tackle this problem?

And to mention, he doesnt have any documents of mine. I even didnt fill any I9 form, what ever he has is the only agreement that I signed and social security number that I emailed him to run my pay roll.
After the argument I even requested him to send my original agreement signed by two parties. I only had the agreement signed by me, he even didnt send me the agreement with his sign on it even after repeated requests.
Now he doesnt even care to answer my calls or emails. I am really tensed. I am getting opportunities from vendor that I worked with but I am afraid he would sue me. Please help me What to do. I am really really frustrated, tensed and I can't express how I feel right now.
I want to get out of the contract and work with the vendor if Possible.
Please explain me how can I tackle this problem?

1. You have two hands and two middle finger...just show to him and move on.
2. Or call the DOL and inform all...and he will be in soup.
Put everything in e mail or certified mail and pass all those information to DOL and move on.
You dont have to bother anything else.

yes finger printing is not required, mine was issued recetly without FP. You can take a chance and send the photos. At the most they will ask for it again.

I am 19 yrs old and on H4 visa since Sept 2002. Will this act be of any help for students on H4 who will get be aging out shortly at 21 yrs.

My son and you are in the same boat. He came here 9 years ago went to middle/high school here. Now, he is in college and will turn 21. He will not get his greencard because he is here on H4 legally.
