    I am stuck in EB3 and want to apply for EB2. How does one find companies willing to do EB2? With desi consulting companies you can ask upfront to the recruiter but with american companies can you do the same?

    Can users suggest some companies who are currently doing EB2?
    I think now we know why we are so fukked. Both EB2 and EB3! I bow to you sir.

    I checked with my company attorney, he says as below:

    140 approved, 485 pending for more than 180 days and if they stay with the same employer, they could get promoted. The job description may be the real driver here. It changes only 20% and they keep all the originial provisions. The 20% extra is addition to their existing role, but the job title changes to lead role.

    If your 485 is filed and you have spent 180 days after that, then the AC21 portability allows you to change employers and change job locations but not the job description.

    Even after 180 days on 485 stage, you can use EAD to change employers as many times as you want and get jobs in different cities/states but the job description should be the same -- which means that you cannot except promotions because promotions do change job descriptions.

    I am pretty sure about this part and I have verified this part of AC21 portability with a lawyer before.(make that a very reputed and smart lawyer)

    You may want to check this part before accepting that promotion.

    For the derivative beneficiary, like the spouse who gets EAD because of primary applicant of 485, there are no restrictions though.

    Got the status update email from USCIS stating a card has been issued for my 485 application.

    I am not married yet. What are the implications if I get married to a citizen of india residing in India.

    Kindly refer me to appropriate material if you know of any.

    Dear Pappu and Core Members,

    I appreciate all your efforts and have made my own contributions to support what IV does. Lately due to the political standstill in the House, we have not seen much movement on the immigration issue. At the same time it is important to have some actions illustrated in the open forum to attract the attention of new members and existing members who continue to visit this website. I am of the opinion that unless the 'interest level' of people is maintained in coming to this website, understanding the action items and following them, people will lose interest in visiting this website.

    Yes, I am definitely for this idea that we should petition/ask USCIS to change the rules to allow those with approved I-140 to be able to file I-485 while their PD is not yet current even if we would pay US$5,000.:rolleyes:

    I would second this proposal. This will definitely ease some of the pains of retrogression.

    I got below response on 15th to my SR created on 9th Sept..

    The status of this service request is:

    USCIS is aware that according to the Department of State?s Visa
    Bulletin, there appear to be visas available however there has been an
    extremely large volume of case requiring visas. A visa may or may not
    be currently available for you, however if there is a visa available
    for your case, those cases are being assigned to officers and are
    being processed in date order. If you do not receive a decision or
    other notice of action from us within 30 days of the date of this
    letter you may place another inquiry after that period of time has
    elapsed.

    If you have any further questions, please call the National Customer
    Service Center at 1-800-375-5283.




    :( All this time I wasnt worried too much about my GC... but now when both my priority and processing dates are current, I am getting very anxious... Its so frustrating not to see any email from CRIS for the whole day, not to see any LUD, not to get anything from CSR.... :( Why, GOD why? :( :( :(

    We all know why U and me visit the site, Information. And in the process if you find any thing not so important to you, just ignore and move on...did this thread of asking to send letters made other threads invisible?
    Just to piss u off, i am requesting again to all the folks to send letters.

    Well, you have not pissed me at all. I did what IV had asked in one month back. I had sent my 2 letters (me and my wife) 17 days back and collected another 12 letters from friends and send them too. I had contributed what ever IV had asked until now, what ever it may be.

    I am sorry, but just a note can baffle you guys and you put all the -ve comments to the post, then sorry to say you guys cannot take any constructive opinion from others. And I think I did no wrong in asking Chanduv to stop posting innumerable threads just for one cause.

    I went to Chennai US consulate for my 7th year H1B visa stamping. Without verifying any of my docs which took it with me, VO just issued 221g green slip and asking all petitioner's docs....

    Here is more detail about my case.

    1. I am working for a small company < 50 employees as a full time employee, since 2005.

    2. I am the only one H1B in my company ...

    3. My company was acquired by our competitor and name got changed ...

    Here are my concerns

    1. If they have any concern / doubt about me / petitioner, Why dont they clear it before approving I-129? Now DOS is sending back all the 221g cases to USCIS only for further verfication. So does it mean USCIS is not doing enough verification before approving I-129?

    2. Can IV team / Experts help to rectify this too much of back and forth b/w USCIS and DOS?

    3. If my visa is rejected, How do I vacate my apt, selling my car?

    4. What will happen to my son's school? i.e. How do I transfer or continue his education in India...

    5. I would suggest all the H1b people to think twice before going for visa stamping in India.

    Proud of you guys who are in DC. No doubt, we have an excellent Team today. Those who are reading silently, ask yourself a question today. Is this the way you want to live by saving those pennies? If not for others, do it for yourself; come forward and contribute. IV is short of funds; If not IV who will fight for your own cause?

    This is exactly what I said in my previous posts. EB2 India may become unavailable towards the end of September as most of the visas will be used in August itself and we will see a flood of approvals starting August 1st itself. I think most of the approvable cases are already processed by USCIS after it gave the data to DOS on July 8th. I think most of the straight forward and less complicated cases during 2004 - 2006 period will be approved soon.

    I do not want to spoil the party fun but somewhere in my mind there is a lingering doubt. I read Ron Gotcher's post about August 2008 bulletin.

    He says that Eb2 India will retrogress to 2003 or 2004.

    This is my opinion. TSC 485 processing time is July 17,2008. NSC 485 processing cut off date is July 28th, 2008. I don't know if CSC is still processing 485 EB applications but CSC EB processing cut off date on its website is April 04, 2006. The priority date for June 2007 bulletin was April 1st2004.


    Lot of big law firms filed 485's around August 1st because the date for filing 485's was extended to August 17th. So I think these 485's are still unadjudicated. Once they get adjudicated there would be retrogression. Analysts analyze. However the silver lining would be removal of concurrent processing of I-140 and I-485 which may give some additional EB 2 numbers next year.

    Could you please clarify what "find out NIW holders in your / related engg field"? How can I find out?
    Do you believe EB2-NIW is easier than EB1-OR?

    You cannot apply for EB1-OR on your own. Only EB2-NIW and EB1-EA can be self-sponsored. If your employer applies for EB1-OR then it might be easier than EB2-NIW since you don' have any citations. To find out "NIW in your own field", talk to your adviser ... he might know other students who applied. You lawyer might have handled cases in your field. No citation is not good but hard to quantify what is a respectable number of citations. A few hundred might be okay in one field but maybe a thousand in another field of research/work.

    I would say Canada because British Columbia has a much higher standard of living than Boston. Canada is generally a much better place for raising kids and the stress levels are lower because of freebies like health care etc. BC also has a much better weather compared to Boston.
    The other reason is that you could always come to the USA from Canada later but if you lose the Canadian PR now and don't manage to get a green card in the US, you lose everything.

    I would really appreciate everyone's honest opinions on this matter.

    We filed 140 and 485 concurrently in July 2007, EB3. As of now there is no word on either application. Previously we had also obtained Canadian PR, the 3 year grace period of which will expire this August.

    Not only am I faced with a decision of staying in the US or going to Canada, but my future career is on the line too. This year I will be 23. After taking my undergrad degree in electrical engineering, I have been accepted into Boston University Law School in the US as well as the University of British Columbia Faculty of Law in Canada. Canadian lawyers make around half as much as American ones after all factors are considered.

    In your opinion, should I stay in the US, going to law school, in hopes that the green card will come through, or should I pursue a new life in Canada, but take the lower future salary / international renown?

    This issue is currently causing much discord in my family. I hope to hear your frank opinion so that I won't take my decision lightly.

    I started the US immigration in 2006, PD-September 2006, by CP, EB3ROW. DS230 renewed 3 times since then... a couple of months ago I applied to Canadian PR, now I am waiting for my interview date. So I have two processes parallel - US GC & Canadian PR. My question is : How these two immigrations can jeopardise each other? :confused:
    Logicaly I will attend the Canadian interview first, will they ask me about US immigration? should I tell the truth? Will they deny the PR because of the GC process?
    Presume that I have successfuly done with canadians and have landed in Canada with my PR in 8-10 months from now, and suddenly, I,ve got an invitation to the GC interview... :eek: Does the fact that I have a Can. PR will kill my future GC and at the interview the will deny and cancell my case? :confused: Or The interview will be successful and I will have my GC, but somewere in the future there is a point where I should refuse one - GC or PR? :confused:
    I should mention that the GC is the choise No1 , and PR is a plan "B"...
    I believe that my situation is not unique, but now I am out side the US and in my country it is difficult to find a competent lawer. So I hope that somebody from this forum could answer my questions.

    Well said, No one here is going to let go an opporturnity here, if one gets one. In my case, I did NOT go in search of one, and I did not get one. So waiting in line for years. that said, If I had got an option, I would have taken advantage of it. This guy does deserves his GC. Anyway, he/she has been here since 1997 and it is a long time too.

    Lot of people have been around for a long time. Each of us have a story why our PD is not earlier. One thing is guaranteed - bulletin dates will not progress or progress very slowly as more and more labor substituters take away visa numbers.

    Another thing - People from 2003/2004 are taking visa numbers. Almost 40% of EB-2 numbers were taken as of first week of Nov (as per latest bulletin). By end of Nov that number might well be 50%, 60%, or 70% - who knows.

    It's going to be a loooong wait.
