I don't know much about Labor Subs to answer...what I did notice is that your lawyer is through company...not going to generalize, but with company lawyers you really should question them and not believe totally what they say....meaning do your own research too. Company lawyer's are interested in keeping employees longer at company and can sometimes push you to do things to cause that. I don't know why you can't have 2 I 140's. But withdrawing your first one would invalidate your 485/ead and depending on your priority date (which would be 2007/2008) and country of birth, you may not have a chance to apply for 485 for a long long time (meaning stuck in same job for long long time...). Again I don't know much about labor subs, my advice is to do your own reasearch, get answers, opinions, and not just take company's lawyers word on everything.

I see an update on jan 24 on this bill to grant 55000 visas for advance degree holders from DV lottery. Does this mean progress? Rest of the immigration bills never make it to the sub committee.

You can just walkin to Dr Stern office. Even if you have an appointment with them, you may have to wait 0.5-1.5 hours depending on the time you go. If you go on weekend or weekdays after 5 you may have to wait longer but afternoon should be faster. And there fee may be more than $350 if you need to get shots and xray. Hope this help.

This has been discussed before, but I could not find a definitive answer.
I live in Alabama and my I-485 is pending with Nebraska Service Center. Based on instructions in I-765 form, Alabama falls under Texas Service Center.
My category for I-765 EAD is -- (c) (9).
Now I am filing for my EAD renewal. Where should I send in my paper application -- Nebraska or Texas?
Would you all pl let me know. Last time my EAD was messed up big time, (wrong dates on EAD card), and I want to make sure everything goes normal this time.

You need to follow instructions. It makes no difference in processing time if your I-485 application is pending in NSC and based on instruction you need to apply in TSC and Vice Versa.
In fact I think, load sharing is going on. I applied I-765 at NSC but case is handled by MSC. Don't be surprized, that you apply at TSC and case being handled by other office.

It makes no difference whether they allow concurrent filing of 140/485 or not IF YOUR EMPLOYER IS WILLING to pay extra premium processing for 140. IF not , it makes minimal difference (2-3 months delay). Earlier this year, people were getting 140 approved on 6-8 weeks on average without premium fee.
If your date is not current:
This rule makes 0 difference. File 140 and wait for approval while your date moves forward. Once its current, file 485. So everyone who is retrogressed, this rule makes no difference to you 485 filing and getting EAD/AP.
If your date is current: File 140, regular processing 2-3 months and then file 485. If you can get premium processing done then it would be 15 days and then file 485. Either ways, you are delay in filing 485 by 2-3 months. In the grand scheme of things, its negligible. It would take even 2 months for your lawyer to get the paperwork straight for filing 485.

Calculate the "real" mortgage interest rate you are paying after taking tax deduction into account. It will be slightly lower than your mortgage interest rate.
Then, see if you can get a better return by investing your money somewhere else. If you can't get a better return anywhere else then pay down your mortgage. Normally - you will find investments with a better rate of return than mortgage.

I was in DC yesterday and today and it's a life changing experience. It was very well co-ordinated. Thanks to all the people who showed up. Three cheers to nixstor, Arun and the local team who had the difficult tasks of getting permits, co-ordinating with local authorities and everything went according to plan..Since I had lobby meetings in the PM had to leave early. They still had pletny of work to do. Their hard work paid off...

I never thought registering on IV is a an issue. I see close to 50K registered users on IV, I have not come across anyone who had any issues for registering with IV.

Since you are in EAD, take unemployment and enjoy life. Hope for the best and get ready for the worst.
My company laid me off in one day without thinking a H1B guy has to leave the country immediatley. I asked them to buy my car, furniture and appartment lease as an obligation for fair value. Because of that i got 2 weeks more time to think over. Anyway they are not going to pay. Did you ask the company to pay you a return airfare to your country. If you ask, they will need time to research and you will get more free time.
This is completely wrong. Once you are in EAD and got laid off...you lose your status. There is one more thread in this forum where one guy applied for unemployed benefit in EAD, in a weeks times the ICE was coming to his home and severed the notice to appear in the court. That guy started the thread and every one bashing him for applying the unemployment benefit. But he later came to know that his employer notified the USCIS that he got laid off during EAD. So he lost his status and they wanted to deport him. I am not sure about the outcome. He is here in only in the IV. That thread was created in the last 2-3 months time. So search for it.

Thanks brb2 for picking up on my concern.I was afraid,not a single person would reply.This problem is going to be as bad as the BEC one if nothing gets done about it.Its so unfair and there are soooooooooo many people stuck at that stage with no hope of even knowing their status,until its actually approved or denied.Cant even imagine how frustrating that is going to be.Yet somehow not many seem worried about it.Even though i am not at that stage yet,its painful to see my friends go through it.They have resigned themselves to wait endlessly.If we can fight against the unfairness of the july flip flop,we can surely do something about this.I am sure core group has this in mind but it'll help if all members show the same anxiety!!Maybe we can bring this up along with the SKILL bill.Maybe the FBI needs more funds or manpower,watever it is,let them ask for it and get it,instead of stuffing us all into this bottomless pit!!

I mailed my I485 to NSC on June 29 , 2007. Reached to NSC 07/02/07.
NSC sent to CSC. CSC approved my EAD .Again CSC transfered my I 485 to NSC on 08/26/06.
Fingerprints were taken on 01/12/08.
After that no LUD.
What woul be caluclated as my RD?
Can I expect Interview ? OrI am going to get GC soon?
Please clarify my doubt.

My AP online status says mailed on Sep 11 th. I have not received them yet.

Even mine was approved on 18th september...Neither me nor my attorney has received it...It's frustrating..I have to travel to India next week..

You will get your card between 5 to 10 days from the date you have recieved card production email, so you will have time to go India and get the marriage certificate.

I am GCBikari and I approve this message. You are saying you ran out of savings and in next paragraph you're talking about investments!! Anyway what I did was list out all minimum payments (rent/mortgage, car, utilities, groceries, gas). This gives the money needed every month in worst case. Then multiply by 6 months. Keep that amount in bank or a locker (now a days difficult to trust banks also!!). Then go for what others talk about like 401k, Roth IRA.. You will have a better start once you know how much you need per month to make a living on bare minimum.
My recommendation would be to build at least 6 months of emergency fund. Open an account with ING Direct or HSBC where they pay decent interest rate on a savigs account. Build the emergency fund first.
Once you have sufficient foundation, then I'd say start building investment foundation. If you employer has 4o1K plan, then start putting pre-tax dollars upto the maximum contribution at employer matches (generally it is 6%). If your employer doesn't have 401K plan, then open a ROTH IRA and start investing in low cost mutual funds or index funds. Vanguard is generally the best place to get low cost, no load funds. Once you max out both 4o1K and ROTH IRA, then start looking into opening a taxable individual investment account.

There is a very clear distinction b/n Legal and illegal immigrants. He loves chinese food, indian food. He never says he does not like other cultures. What he says is that others come into this country and try to claim that it is their own country and start doing things the way they want to do. But legal immigrants for the most part are different they come here and play by the rules. they speak english, they love america and that is the reason they stay here. I think it is very important to talk to him and see what his stand is on this. It does not hurt. It is tough to get thru' to talk to him and hence I posted the message here so that others can also try and may be one of us will get to talk to the guy. If we just stick to the IV talking points and tell him we love america and of course are english speaking ( we are definitely not lying) he will be fine.

I understand 221g is an action to prevent fraud. But at the same time consular officer should give a chance to prove visa applicant's point at the time of interview. In my case I had most of the docs at the time of interview, Why don't they accept those docs and start processing immediately, then I would have saved some 3 weeks ...
