Dear Friends,
I have an approved I-140 with PD of Mar 06, but i left this company to join a new company. I have tried many times to file PERM through this new company but still unsuccessful. I am waiting to withdraw my PERM appeal to file a new PERM since January 09 (so folks don't ask me to update my profile because i am yet to file PERM, I have updated my profile three times since 2006 and also cleared it).
Question: When i spoke to my company's lawyer regarding my earlier I-140 they say that first i need to get my PERM approval (I agree) and than i need to get my I-140 approval (Which i am not sure) inorder to port priority date, is it true? Can't we port Priority date along with I-140 application itself?

It is very comprehensive list. It covers every field. Graduates of pharmacy, medicine, vet medicine etc are not PhDs. They have to go through special programs to get that degree.

However I am afraid you misunderstood pharmacy, medicine, vet med PhDS with practice professionals PharmD, MD,DVM.The people who made the list of STEM have ignored the fact that Research is highly interdisciplinary. This is unfair for many researchers in biology who should be in the STEM majors but they are not in just because of technical/clerical reasons. I request you all to take a look at this anomaly.

you need to be old enough to carry on a convo like adults with full words, not slang, etc.
most states allow people to get work permits at certain ages, to work after school and such.

I have to agree with Tito.. I too thought the DREAM Act would benefit my son who is soon to be in College.. the more I look at it, I am forced to get an impression that the Act is intended to ONLY help the children whose parents are illegal immigrants....

Is it possible to file I-485 without I-693(Medical) ?
The reason I ask is that I cannot get a doctor's appointment in July. For some reason, if we are able to file in July, can I submit the 485 first and submit teh I-693 later.
Please advise

Sorry to answer you question late.
I am the July 2nd filer as well. It took me quite some time to figure out the case numbers on back of the checks. All start with "WAC" means California Servcie Center. After I entered my cases number each of each (total 6 of them, 3 for my wife and 3 for me). On Sept 13. there was LUD on all of cases. but only the contents differences were appeared on two 485 cases. It said that "we transferred this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS to our LINCOLN, NE location for processing because they now have jurisdiction over the case.".
That is what I got so far. May God with us all!!!

If it was EB2, you have better chance of winning lotto than get EB2 approved with 3 year degree. I had 3yrs + PG Diploma + 6 Years of Indian Experience + 13 Years of US experience and I was never able to cross the labor certification hurdle. BTW, I tried 2 times.
There is a little chance if you had 3+2 years degree and the labor was looking for Bachelor�s and would accept equalent foreign degree as evaluated by reputed firm. I believe your diploma was the hurdle.

- A person is on his 5th Year of H1 and his I-485 gets rejected - he can go back to H1 (Since he has 1 year left).
- A person has exhausted his 6 years (May be in his 7th year). Now his I-485 gets rejected - he cannot go back to H1 (Since he has exhausted his 6 years on H1).

That is correct, scenario 1, atleast to me, seems like a smarter choice, and that is what I have chosen to do.
You can go back on the H-1B if your 485 were to get denied and your appeals (assuming you made any) were to fail, although I am not sure if you need to leave the country and re-enter or if you can adjust status to H-1B without leaving the country.

However I don't understand how your wife and kids got depedendant visa. I don' think one can get a H4 or L2 visas with out marriage certificate first place, unless your wife came here on F1 visa here.

Friends I think a great injustice is being done to NSC filers , their applications are taking months for ead and ap, while TSC filers are getting ead adn AP as soon as they get receipt, do you think this will improve for NSC in future, at this time looks like august NSC filers will haveto wait till the end of the year for EAD,ap, which is sad.
You didn't say any where in your message that TSC applicants are getting RN very late. Sorry to say but it seems you are very mean and selfish person. But looking at only NSC your concern is currect.
