Thanks Arihant. Yes it is strange and I am trying to find their ulterior motive behind this. All the while I thought my employer is not one of the typical desi employers (read blood sucking) we hear about in this forum. Hope I am right.
By the way, my question was related to AC21 (after 180 days of filing 485). If I quit my current employer and join another company, how would I let USCIS know to forward all their RFEs to my new employer/lawyer and not to the old one. Am asking this because I heard the I-9 form we fill while changing employment is only for the employer and he doesn't forward it to anybody. Does my query make any sense at all or am I just blabbering BS :o
The stuff in bold is something I am trying to figure out. How will we answer RFE's after 180 days if we file our selves? Company lawyer and employer will not be even willing to talk to us as we have moved away. What are the chances that USCIS will ask stuff related to your old employer? More than anything else, it all depends on your perspective. You simply want to focus on the things that appear to be wrong to you, like mere focus on the -ve comments. You did not list any +ve comments. Maybe you did not see them. Now you can continue to harp and complain about the -ve around you, or you can have a +ve approach and look at things that are good, maybe the comments there are commending and admiring you. Its your choice. Instead of asking others to change something, did you look at the mirror when you got up in the morning. Maybe a change is required in that guy you saw in the mirror.
Stop complaining that the boys are picking on you. Behave like a grown up and don't act as if you are melting because of crticism or -ve comments.
Hope this is the last complain about red/green dots.

you are assuming he has applied for 485. If he has not, (ie. started labor in 2004) then until atleast July he would be in the same boat. If his LC is still in BEC (remember 30K are still stuck there); then all of this applies to him even after July VB fiasco!

My PD is Nov 2004.
I do not have any dreams of my 485 being cleared this month as my I140 is pending at TSC since April 2007. Just last week we got an RFE and the attroney is working on the response.

Can some attorney help us ? This seems to be a very valid speculation. Indeed I always thought that there is something wrong going on behind the scenes. How can the PD move 7 days in 9 months ? If it moves at this pace only, my turn to file 485 will come in 47 years. ( I will be 87 years old).

This question was explictly asked by AILA to CIS in one of their monthly calls and CIS said they would get back on this. In other words, at that time, their position on this was not even clear to them.
This is why we see conflicting opinions on this topic from different attorneys. Some say the H-1 is gone and some say it is not.
Personally, I think it is possible to use both simultaneously and I think some people are already doing it.

I want to bring out the plight of legal immigrant community that has been silently suffering the consequences of a broken immigration system. It really baffles me that all the focus in immigration debate is on ILLEGALS when highly educated LEGAL immigrants who play by the rules, pay taxes and follow the law are left in the lurch. Attending to legal immigrants plight will also send a positive signal to the ILLEGAL community to see the perks of being LEGAL. Right now, it seems more rewarding to be ILLEGAL than pursue the LEGAL route towards immigration. What an irony!
The country based quotas imposed on Employment Based green cards are not only unfair but self defeating because the benchmark is country of origin and not qualification! Since these EB category based green cards are awarded for professional skills, imposing a country based quota just does not make any sense. I urge you to work with Congress and change this discriminatory policy and reinforce that America is truly a society that celebrates meritocracy.
The immigrant community is really looking at President Obama to deliver on his promise of CHANGE - Change that we can believe in.

FYI, I got my RFE today too and it is for the same exact thing as my wife's, which I shared yesterday below.
I got LUD 2/17 and 2/18, same for my wife, 2/17 was RFE message, got my wife's RFE in mail today it was for a serological HIV test which was supposedly required but was not done.
Have yet to receive my RFE yet, hopefully tomorrow.

Service industry is not always based on labor cost differentials. Many services are value added services. For example, stock brokers used to charge $200 and above for stock trades; however, electronic brokers came and made the industry efficient and hence can profit more by charging only $10 or even less. So don't assume that R&D investments are always good for a company.

I have been on H4 since 2000. I once got an H1-B in the year 01, but did not get to work. Meanwhile my H4 got extended till now.
With the recent changes of de-coupling H1 & H4.......
My question is can I use the previous H1-B issued in 01 and apply for COS without any cap restrictions ? And can this be used by a new Employer ?
