You are right. They do not tell you likely because employers enjoy the idea that people visa dependent many times turn out to be "more productive" for the company. This is just a nuance, but I can speak from my own experience that I used to work longer hours and demand less when I was on H1B. It is a fact.
Only time will tell. There is no lawsuit angle to be explored against this as far as I know.
It is interesting what other members reported about people being in denial, even when you clarify about the difficulties about the greencard process. I had my own brother coming here and his employer talked big about greencard, etc and he started making plans to bring his wife. I told him everything we have been through and he didn't pay attention to it. In the end it turned out that his profession was not even eligible for H visas.

My lawyer sent a letter of interfiling to NSC but I do not think that they have taken any action on that. I have never seen any LUD on my pending 485. However, your case is stronger than me as your PDs based on sub labor is current so if you can aggresively try interfiling , you will succeed. Is your older PD I-140 approved ?

Increasing of visa number will help every one including who are waiting for I 485. More visa number will make priority date move. How come they are not interested?
Suppose IV decides not to focus on I-485 filing but some other issue. By this analogy, all members with interest in I-485 will leave.

Guys,
I took an info pass last week to check the status of my case. Specifically to check whether the interfile is success or not. IO at USCIS office mentioned that she cannot check whether my case is in EB2 or EB3. I am surprised to hear that. Gurus any has this kind of experience?
Also, She mentioned that my case is assigned to an Officer on August 13th. Do any one has any info how many days(on average), an Office will take to approve a case. Any info. is helpful to me and all.
Overall the Field Office people were polite.

I filed I-765 in January and got 1-year EAD last week. I called USCIS today and explained the error. It took a while to explain this to agent but he got it that this is a renewal application on the basis of pending I-485 without available visa number.
He filed service request for the error. As far as he knew, USCIS will send another EAD and send further instruction about 1-year EAD.
I filed EAD/AP together but the EAD I got is not a "Combo Card" (USCIS Term for combined EAD/AP)
I shall keep you posted.

If one changes from EB3 to EB2, then priority date is lost!

(I am not expert) but I believe , you have to refile (New application) under EB2 catagory and port the EB3 date to EB2.

(C) The travel outside of the United States by an applicant for adjustment of status who is not under exclusion, deportation, or removal proceeding and who is in lawful H-1 or L-1 status shall not be deemed an abandonment of the application if, upon returning to this country, the alien remains eligible for H or L status, is coming to resume employment with the same employer for whom he or she had previously been authorized to work as an H-1 or L-1 nonimmigrant, and, is in possession of a valid H or L visa (if required) and the original I-797 receipt notice for the application for adjustment of status.
Looks like we can ask for a receipt notice in case we are travelling out of the country. Atleast ask!

Had some colleagues who worked in Detroit and lived in or around Windsor. Took them around 45 minutes to an hour each way to work. One of them had his wife's entire family living in Ontario (they were Vietnamese immigrants). He had a US citizenship so there was no immigration issues. His wife did not want to live in the US and there were no jobs in Windsor so he had to commute. I think one of these colleagues was on a H1 but not sure. The big problem is that there aren't enough jobs in Windsor so chances are that your wife won't get a decent paying job. Then you have to pay high taxes I think as much as 10-15% more. Due to exchange rate fluctuations you can see your living expenses shoot up and down. Just a few more things to keep in mind. Overall yes I think this is plausible and depending on what you want *Canadian citizenship/GC" this could be a choice for you. I would suggest contacting your branch in Detroit and talk to people who live in Canada.

I hope IV does push for the 485 measure but if for whatever reason they change there mind and dont push for 485, I would be disappointed but that will in no way affect my attitude towards IV. Over the past year or so I have seen enough of core tem to say they take a decision in the best intrest of IV.
I have not filed for I-485 and neither am I close. I feel I-485 is much more controversial interim relief then most members think. This is explained in a post (from a law firm) in another forum. Another reason for my feeling is that AILA is not supporting I-485 filing for health care: they are supporting a temporary 25K-75K increase in GCs. It is possible that health care GC does not have I-485.
You have to choose an issue that has a chance of getting through rather then an issue that most persons want or is logical. I will be surprised if I-485 filing as interim interim relief reaches the bill state and/or the bill gets approved in Senate + Congress.
I do not consider this to be a reason to move away from IV. I agree with some requests that require IV to explain their finances and dis-agree with some IV decisions. In particular, I very strongly dis-agree with some topics + language + tone allowed in the forums. As we are seeing, it is turning people away from IV.
However, based on the big picture and the attitude of core, I will roll with them on any issue they decide to pursue.

We are talking two different things here. You are saying about AC-21. The OP is asking about retaining PD. The way you can retain your PD after I-140 approval is :-
You file a new labor with the new employer - once it is approved - you need to file a new I-140 application and attach the old approved application with it - this would ensure that your PD will become the PD from the old case.
Difference with AC21 is - in the case of AC21, you just switch jobs and your current GC process continues - you do not have to file a new labor,140 etc.

whatever be the issue about the debate (doesn't everyone come to this forum to gain something or ask a favor) Past couple of days I have being confused if my my decision about using the AC21 was the right thing to do as many peers advised me against using the AC21 and maintaining the H1. My 485, EAD and AP application received in NSC on AUG 2nd. My personal checks are not redeemed yet. I haven't received receipt numbers or EAD or FP.
But the USCIS receipting times states NSC is processing receipt notice for AUG 8th.
I don't know what's going on....
Do they transfer my case to TSC??? Because I am living in TX???
My employer office is in Illinois and my lawyer office is in Michigan.

if u can create a fairly intuitive JavaScript client update tool... will u ever need my sql or ne of that stuff? ( i mean i no its good to hav on ur resume etc but...)
im 17 and have my first "job" or request as its gonna b for free to giv me sum experience.. plus i work for them!! (part time as im in my penultimate year at school with no intentions of goin to uni)
i tell u theyr gonna be the coolest farm on the web!! lol
i thout itd b a good idea to at least get 1 example of wat i can do on the web b4 i start askin ne1 for money... just to let them no im serious uno?

If any continuing recurring IV contributor (Donor member) gets a 1 year EAD/AP document, let IV know. We will try to help you get a 2 year document from USCIS.
