Yes, at this point, my fear is that my file is missing or just sitting somewhere and collecting dust. I have not seen a status update since September 2007 on my case. I filed AC 21 last year, and did not see any LUD at that time. The only LUD after September 2007 that I had was this year, this was when I applied for AP and EAD renewal.
I am going to be asking my attorney to send an email to TSC streamline procedure, and will also submit a problem with CIS Ombudsman. That is what my plan is for the next 13 days.
Other than that, I am not sure what can be done. Will writing to the first lady help? I dont want to get the same standard answer that we got when the local senator send an inquiry.
I agree, I think EB2 will retrogess when October bulletin comes out. We will then have to wait until September 2010.
Come september 2010, we will start from scratch again and will hear the same thing - wait 30 days, 60 days, 90 days, etc....
Hang in there, is all I can say!!

Two important exceptions to the per-country ceilings have been enacted in the
past decade. Foremost is an exception for certain family-sponsored immigrants.
More specifically, the INA states that 75% of the visas allocated to spouses and
children of LPRs (2ndA family preference) are not subject to the per-country ceiling.18
Prior to FY2001, employment-based preference immigrants were also held to percountry
ceilings. The American Competitiveness in the Twenty-First Century Act
of 2000 (P.L. 106-313) enabled the per-country ceilings for employment-based
immigrants to be surpassed for individual countries that are oversubscribed as long
as visas are available within the worldwide limit for employment-based preferences.
The impact of these revisions to the per-country ceilings is discussed later in this
report......................

There were about 600,000 AOS applications including the July and August filers. So that number less 60,000...roughly about 540,000 applications still pending with USCIS....
And 540000 @ 140000 per year is approx. 4 years!
Going by PD, 2001-2003 may get their GC by Dec 2008
PD 2003-2005 by March 2010
PD 2005-2007 by Sep 2011
Again, my assumption is even distribution which is not a reality. Every year, last quarter would be busy as USCIS would try to use up all the VISA numbers for FY and during that period it could be open for all atleast for 3-4 years; like June 2008 they may make it current for PD 2005 and June 2009 for PD 2007 .... And, come October dates would retrogress.

I guess EB3 will finally cross 2001 barrier in the next bulletin.
For Eb2, it will be like the new EB3. Just too many cases were filed in EB2 after 2005.
Good luck to everyone.:)
What is the use? EB3 had crossed into 2003 last year. Then they moved it back to 2001. Which means that they have a lot of applications pending from 2001, 2002.

Filed with VT service center in early Dec '07. RFE issued 4/14/08. Lawyer should have already responded to RFE. Hopefully approval is a few days away.

Long time ago when I inquired at the University of Houston, they said that any person who has lived in Texas for more than a year will be considered as an in-state student. Bear in mind that this was some time in 2001-2002.

I agree 100%. Anything that affects business and competitiveness of the US will be always more important than sob stories of individuals. Latter is collateral:)
just an idea, but the reporter should probably speak to the employers of people who have left, and highlight instances where they have found it difficult to replace the departing employee.
USCs are probably more impressed by effect on the US than the hardships faced by us

I got my first 'job' like a month ago (I'm 14) and the guy was fine with my age.
Two tips:
-You should tell the person how old you are before you start anything (the person might not want some 14 year old making him a site/movie/graphic).
-Not that you CAN'T speak slang, it's just better not to. I mean do what ever you want, it's just a suggestion.

1) Degrees from non-accredited colleges cannot be used for any immigration purpose (or for any other purpose for that matter)
2) A Post Graduate diploma is not enough for EB 2. You will need to do a Masters from a accredited US University. Remember, many online universities (including Phoenix) are accredited too.

It's just a caution. Some people would like to take it slowly but surely, some people love to run fast with a risk of stumbling in the middle. Whichever you go, the finish line is always the same.
All I am saying is if you wish the fast route with the risk of stumbling, then go for it. If not, try the slow but sure route.

Here is my guess on who will be in Conference from Senate side.
Sen.Specter, Sen.Cornyn, Sen.Kyl, Sen.Sessions, Sen.Brownback, Sen.Graham, Sen.Grassley, Sen.Kennedy, Sen.Durbin, Sen.Feinstein, Sen.Leahy, Sen.Feingold
---
See below for Frist's ( Rep. Senate leader) comment:
Frist said the Senate will send 14 Republicans and 12 Democrats to negotiate with the House, with seven of the Republicans and five Democrats coming from the Judiciary Committee. The remaining seven Republicans will be chosen by Frist and remaining seven Democrats chosen by Reid.
At least one oppoenent of the compromise measure, Sen. John Cornyn, R-Texas, will be among the remaining seven Republicans appointed to the committee, spokesman Don Stewart said.

primary care physician....so that insurance covers it.
It makes me so mad regular insurance doesn't cover the immigration physical. It's almost like any other physical, in fact it's not even as detailed as that-the uscis site mentions "disrobing" I had to do no such thing.
