You do not have to be single unless you have already decided on marrying someone who is not in the country at this time.
my employment is terminated a month ago. I still need to file h1 transfer to the GC sponser. I am single
I am told that H1 can be transferred only with in 10 days-20 days or so. which means that it is already a month. so in case if I dont get the h1 or if I have an issue in the H1 transfer, is that the end of my being H1.
If I were to be on H1 again is it going to come under the cap along with those new H1 filers? I still have one and half years to complete 6 years.
I have a fall back to EAD though based an approved 140 and 180 days past 485.
But how do I get the spouse then???

Initially my case status was like whatever you said..but I got the FP and done. Now the case status says bit more like
On September 18, 2007, a fingerprint fee biling notice for this case I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS was mailed to you stating the reasons for the billing and the instructions to follow to submit the necessary payment. Therefore, processing of your case is suspended until we receive the necessary payment along with the billing notice we mailed to you. If you have not received this notice within 30 days of the September 18, 2007, please call Customer Service at 1-800-375-5283 for further assistance.
Does anyone know in the same boat?
My wife also in the same boat. Her FP is done and now the status is showing sameway like you.I have informed the same to my lawyer and awaiting response from them.

Thank you Krishna. The question really is whether my Labor/I-140 approvals as Indian citizen can be used to continue the GC (to file the I-485) after I change my citizenship. Would you know about that?
Or, if a new GC process is restarted with a new employer, can the old priority date be re-used in the new GC process after citizenship has changed?
Thanks.
1. Ans 1 - Yes, Labor/I-140 approvals as Indian citizen can be used to continue the GC. Like i said USCIS considers Country Of Birth of Foreign Nationals and not their Citizenship
2. Ans 2- Old PD can be used with new employer as long as 140 is approved and not revoked.
refer to below links
1.
Copy paste this link " .com/greencard/employmentbasedimmigration/i-140-premium-processing.html "
And " murthy.com/chatlogs/ch121905_P.html "
Chat User : How do I know whether my previous employer revoked my LC or not? I want to use my previous employer’s priority date if that is not revoked.
Attorney Murthy : A person is not allowed to use the earlier employer's LC priority date filing with a new LC case filed with a new employer unless the earlier I-140 had been approved with that earlier employer. If the I-140 petition had not been approved, then each time a person changes employers, a person will start with a new PD. The only exception was for 245(i) cases where the petition or application had to be approvable when filed, but that only applies to the ability to file the I-485 and not to carry over that PD for a new case.
Thanks.[/QUOTE]

Guys got my FP and AP last nite. Check signature for more details.
The status of my Travel document on USCIS site has been following for a while -:
Application Type: I131, APPLICATION FOR USCIS TRAVEL DOCUMENT
Current Status: Document mailed to applicant.
On September 20, 2007 we mailed the document to the address we have on file. You should receive the new document within 30 days. If you do not, or if you move before you get it, call customer service.
How long does it take for it to actually arrive??? Any idea??

call ur airport, I remember a friend got his I94 extended based on new I797 at the airport.
BTW- if u have an approved I797 and an expired I94, u are not out of status....when u travel next time out of country...keep current docs with u and when u reenter...the POE officer will give u i94 based on ur latest I797..
What I dont understand is when u entered US in may 06, with a I797 of 2010
, why didnt the POE officer give u i94 until 2010?
That's because my current 797 was valid till Jun 2007 and he said he can only stamp the date that is on the current 797. I guess it depends on the POE officer and in my case its unfortunate that it got messed up. Someone in the forum mentioned that he got it for 3 years. I think its very very YMMV

If you are talking about the discussion. then am referring to the items and not the discussions.Have I missed these items some where that are like the above. Then we are good to go. Can you let me know if the action items already there tries to encompass all thes issues and possible solutions. Ofcourse I know every one is talking and discussing but didn't see a concrete list except a description on the front page saying we are fighting for the cause of GC aspirants and some smaller descriptions.

The mission of Immigration Voice is to organize grassroots efforts and resources to solve several problems in the employment based green card process including (a) delays due to Retrogression (visa number unavailability for certain employment-based categories) (b) delays due to USCIS processing backlogs and (c) delays due to Labor Certification backlogs. We will work to remove these and other flaws by supporting changes to immigration law for high-skilled legal employment-based immigrants. High-skilled legal immigrants strengthen the United States' economy and help maintain American technological superiority

Any number lesser than 800,000 is good for us.. doesnt mean all is well.. we have to continue in our efforts with IV and we could have a better breakthrough..
Anything less than 800,000 is good... even a few hundred thousand less :) There's still a lot of work and patience required but a good news is a good news nevertheless.

NIW is tricky. As you have PhD, you can apply yourself (w/o sponser) in EB1 Researcher catagory, if you do that kind of job.
The only self-sponsoring category are: EB2-NIW and EB1-EA (Extra Ordinary). EB1-EA is harder but EB2-NIW is not easy either. NIW will have to argue why labor certification should be waived. Talk to a lawyer. You will have to show YOUR work not just the field you work in has merit and in national interest. And you bring unique abilities to the US. Your past achievements and not future potential counts more.

I do know a friend who fits the bill - EB2(ROW)
I have asked him for his permission to share contact information with you. He is not a member of IV.
A top national reporter wants to speak with someone in EB
community who may have recently lost his/her job due to current
economic situation. I think it would be best for our cause for someone
who was offered a new job possibly in the 'same or similar' area
immediately after losing their job. It would help to highlight that
the highly-skilled immigrants are in demand because of their skills
even when the economic situation is not doing well, but, there is no
reason to keep us in limbo for over a decade, merely to test our skill
level. There are better ways to test our skill level. If you or
someone you know fits this profile, kindly email your information and contact details to info at immigrationvoice.org
immediately.
The reporter will also highlight the housing angle and that we can
start new ventures that could potentially create new jobs to uplift
the economy.
This is a big opportunity as the interview from this reporter will be published in most big newspapers and on news websites. We need someone urgently today if possible.

I had a copy of approved I-140 (EB2) with PD Mar 06. I had to file for new labor in Apr 09, after i got my labor my lawyer filed for new I-140 with a copy of earlier approved I-140. I remember she was saying that they will also write a cover letter to recapture earlier priority date (I don't have a copy of that). So i believe porting can be done easily when filing new I-140 rather than after I-140 approval (i am not saying you cannot do after new I-140 approval but it takes extra effort, time and energy ).
In the interest of others in a similar situation can you post the exact process that you or your lawyer finally followed to get a successful porting of PD?

I am not of Indian origin but I participate in this forum, contribute and support the basic goals of IV. I do that because I feel that these people are doing the right thing which would benefit all "legals". The more "other legals" join the IV, the better... and nobody stops them... And if some of the "other legals" desire to join the core team and to share time and energy for this couse I am sure he/she would be accepted and his/her efforts appreciated. Let's not just criticise the lack of diversity but do something in this regard. Reality is that Indians got together and started this fight.
And note - I personally do not believe too much that we will achieve our goals in relatively short time and I have my "plan B". But I believe that it worth trying, therefore I support. Several hundreds dollars wasted and some time spent in this forum is not too much for such cause and may turn to be a "profitable investment" (visa-wise) :-) Let's appreciate what the Indians are doing and help their noble fight with some dollars and time - everyone will benefit...

nmdial I dont think the registrar will issue a birth certificate based on affidavit from the parents.
Usually for people who dont have birth registered at birth or hospital records we have to obtain a non-availibility certificate from the local authority. Along with this certificate we submit a notarized affidavit signed by one/both the parents. Now we have learnt that this affidavit has to be signed in the presence of the registrar. Hopefully that should be ok then.
My parents had submitted a notarized affidavit to the registrar (death and birth) of the local municipality and obtained my birth certificate. That was in 2006, the rules may have changed by now.
