Before EB2 moves faster, every EB3 guy will get a new LC and jump in to EB2 line. Then EB3 line will be little lighter and moves a little faster. Then people will start asking like this - "Can we go back to EB3 line ? Can we have 3rd EB3 LC ( like LC sells in walmart) and another 485 ?" . Pretty much everyone wants to have 2 LC , 2 I-140 and 2 I-485 at any time. That way whichever category moves faster they will beat the system.
Then we come to this forum and wonder why there is so much backlog or why USCIS is so slow ( my favorite one).

I made it very clear even in past. I am more rational kinda guy. I want to know where my money is spent at high level - no details. I know its against IV policy. So I admire what IV is doing, I appreciate donor only forum but not contributing yet. May be I am wrong being too hard to be convinced. I will think over.

Opened my email this morning to see the card production ordered email (time stamp in my inbox reads 2:15 am PST 4/23/08); the approval date was 4/23/08.
Been in meetings all day so not even a chance to call anyone about it.

no comments on the above ?? I do support the FOIA .but when you think about it ..what is the point in knowing that our GC's are 3-4 years away ...we should also focus on something getting passed during lame duck session ..at the very least we should be prepared for something incase it is suddenly announced that there will be lame duck session after elections ...any thoughts ??

Very interesting. When we applied for 485/EAD/AP, our lawyer specifically asked for color passport copies of the first few pages. I went ahead and made copies of all pages. Am I in trouble?
That was exactly my thought! I think people who say it's illegal to make a copy and provide it for other than personal use should give us a reference to the applicable law, I am not aware of the specific law regarding this. If anybody could point out the source of information, that would be great.

BTW, this is the best we have got so far. If anyone can improve on this, please let me know. I will look into this in detail later. An online tool that shows a person how screwed up they are (or are not) due to retrogression should also be helpful.
I had posted this statistics last year on IV. I had done good research to arrive at these figures. I hope the figures will open eyes of people who are bestowed with 'blissful ignorance'.

I went to India for vacation in Dec end, 2008 and came back on Jan end, 2009.
This was my 4th trip in 8 years.
POE: Atlanta with my wife and 2 kids.
process was lengthy but lady officer was very nice, usual questions, no issue at all.
I renewed my H1b stamp in India also. same. usual questions about my job and visa. some questions to my wife also for H4 renewal. No issue at all.
I hope this helps (in calming down) guys who are visiting india. No need to panic if your documents are ok.

We need to run a media drive from tomorrow with full speed so that we can communicate this absurd action by DOS and USCIS.
How can they give 18K greencards in one day? and 60K greencards in one month. Where was the lack of manpower and heavy workload excuses?
Why did they make the dates current in the first place when they knew they cannot handle so many applications? There are so many questions that need answers.
This system is broken and needs to be fixed. Let us communicate to all our friends who are affected with this tragedy today so that we can all unite and make efforts to have our voices heard.

Cantwell is a Democrat though. If Republicans only get a limited number of amendments would they not try to push this over to Democrat side and ask that it become one of the Democrat's amendment? If they do that it will pretty much be shoved under the table, seeing how democrats feel about High-Skilled immigrants.

this bill would allow to adjust status to GC, if you lived for the last 5 years continuously except for casual absence. It does not eliminate H1B, but makes it tougher at advertisement stage for EB.
Where did you read that "except for casual absence". Because that might make it go or nogo for many people.
There would be many people who might have gone outside US to India or so for a month or so for maybe twice in last 5 years. Will that count as casual absence and forgiven ?
eg. my wife will be in US for 5 years in August'09, but she has been to India atleast twice for 2 months and 1 month respectively during these 5 years.

Folks, as someone with a background in public policy, permit me to remind us all that the MAJORITY of the lawmakers' inputs and influence comes from their staffers. Most lawmakers have dedicated staffers who focus on immigration. I would urge EVERYONE who reads this to send a message addressed to:
Staffers and Aides on Immigration Policy
c/o Office of the {Insert respective lawmaker's name and address}
with a PROFESSIONAL, easy to ready, point-by-point, clear outlining of TOP MYTHS promoted around high skilled legal immigration.
In order to be effective, we should have an efficient and sustained mechanism in messaging out.
Also, in speaking with a few lawmakers' aides (and former aides), a repeated refrain was a suggestion that we NOT PREACH to them, because many of them are well aware of the facts and circumstances. What they ask for is easy to read and digest FACTS, *not* our opinions and emotions on how to fix the problem. They get paid to address matters of public policy.
So, I will ask everyone if they can take a few moments to send such a note and eventually build a relation with each of their respective immigration aides so that they can get to send them such factual information.
EMPATHIZE with those who lose jobs in the US, but RECOGNIZE that outsourcing etc is a function of Wall Street, not immigrants squatting on Main Street!

I-485: EB2 India with PD June 2003
I was wondering why I am I getting a LUD in Feb 08? (since EB2 India is 'U').
Now I know why :) it seems USCIS is getting ready for the deluge in April 08' :D
Lord almighty people are getting really carried away. :) This cutoff setting guy hadn't even made up his mind as of Feb 13. Also read my entire post, he won't set the date till he sees the estimate from USCIS.
Btw, my PD is Jan 03 and my LUD is still back in November 07 (when my attorney changed).

I'm one of those who say with pride that I can create jobs and buy houses. Then why will not congress or policy makers not touch this. As some here said it depends upon what we think about ourselves. I know many people who like to work under someone even after 10-15 years, my brother is like that, and I know many more like me who want to start companies, employ many people, and do bigger things. Both may be right in their own ways, but if you project yourself like me, then the doors will open.. Show enterprise..
Definitely enterprising candidates do have the perfect carved out visa category for this purpose EB5. Show them a plan to create jobs and get bank to approve of your plan as being profitable and feasible, to extend you a line of credit and you'll get ur GC in 1 year.
Its pure politics here..the current bill is an attempt to garner more ethnic votes...e.g.
UPA never initiates action to press hard for deportation of bangla immigrats (undocumented aliens) in India because those aliens are from a particular community and UPA wants to capitalize on the valid votes that Indian citizen from the same community provide them.

I know , More than 50% of IV members who can not file I 485 due to retrogression will be happy to pay this nominal amount of $10 to fax letter to USCIS for rule change

I had checked the status earlier this morning (as every other day) and as every other day there was no LUD. When I got home this evening saw the following email (got one for my wife's application too)
I still remember very vividly the day I handed my papers to our HR in Sept 2002. It took our HR nine months to complete recruiting and send it to DoL. I am sure I will remember today and the day we get the physical cards better :)

Current Status: Notice mailed welcoming the new permanent resident.

Each Year un-used FB (Family based) visas are given to EB (Employment based) in coming year. Last year CIS did not use 22704 FB visa which is added to 140K EB count for 2008.
that means Eb2 india has more than 40k visa available ... that explains it why EB2 India and China has moved from June to August 2006.
