    Hi nixstor,

    Looks like you had done some research in this matter . Can you advise me . i am also in the same situation like yours .

    My current H1 is going to expire on june 07 along with my wife's H4. I applied today for my extension along with the H4 in premium processing. Shall i go ahead with the new H1 for my wife on April 1 in regular processing even without waiting for the extension or wait for the approval?
    Any issues with that approach?

    Your H1 and her H4 should be approved by Apr 1st as you did PP. Even if its not approved she is still fine as she has status until Jun 7th. Even if her H4 is not approved and only your H1 gets approved with PP and if USCIS happens to process her H1 before H4 they will issue an RFE asking to prove her status (which is pending approval). Once her H4 is approved, you can answer their RFE and then her H1 will be approved. This is what the lawyer told me.

    I still see a lot of people who are not approved in Dec. USCIS processing times say they are doing 1/13/07. Damn!

    this organization is strong and growing everyday because of the efforts of volunteers like you. thank you from all of us for your enthusiasm and motivation. iv does not seek to represent any one nationality, group or skillset. Once you start dividing there is no end. india vs row? EB2 vs EB3? STEM vs other? US degree vs Foreign Degree? BEC vs new filers? we have seen all these food fights take place. will it ever stop?

    the goal is to end retrogression for all. if this happens incremental steps then the movement will continue until the whole goal is achieved. we, as a community of skilled immigrants cannot afford to be fractured. if we are not speaking with one voice, we will be ignored and those that oppose us will easily block our measures from going forward. among other things we learnt from this rally is that there are still those that seek to pursue narrow and divisive agendas within our movement. this will lead to sure failure, and each one of us will suffer for it.

    as i have reminded folks here on numerous occasions, iv is not a brick and mortar structure. we are iv, and there is no iv but us. we determine it's strength and weakness and we shall determine its (and therefore our) success and failure.

    some here fear what will happen when the current leadership get green cards. will iv go the way of skilled immigrant organizations of the past?
    the answer to that too lies within us. a turnover of leadership is but natural over time. if new people are unwilling to step up and be active volunteers, start state chapters, create new initiatives and bring renewed vigor to this movement it shall die out. if new volunteers will not come forward in a fresh stream then maybe we don't deserve this. we are the arbitrators of our destiny.

    i believe though we are more worthy than that.
    the rally has also shown us (especially me- given that i took upon myself the task of working with state chapters) that there are very dedicated and highly motivated members in this organization that will work selflessly and give up much to ensure success. my grateful thanks to the many who made my life so much easier these past few months.

    wonderlust, if you have initiatives to take the message out to the community, iv will surely help you in every which way possible. please pm pappu with your idea!

    Thanks for sharing the link, I will go through this.

    It is not about money. I have absolutely no problem giving even 100$s per month for the cause if I know how my hard earned money is being spend. Actions like deleting threads, banning users just for asking reports, makes people uncomfortable. Have you seen the financial report at Eb3 Chinese Financial Report - ��›-�‰�-��Œ�š秿�-‘�•�-‹信�‰˜�Ÿ��‡‘ (http://www.eb3chinese.org/5.html).

    Salary should not be drastically different, but -20-30% should not be a red flag. Can you construct a more complicated compensation agreement that would include defined compensation (salary) and your share in profits or equity of the company? On one hand, it may be a good idea overall (and will protect your friendship), on the other hand, it is a lot harder for USCIS to cause trouble if they can't clearly understand what your total compansation compared to old job would be.

    Yep - putting a "confundus charm" on compensation agreement could work. Good idea. Thank you Hermione.

    Cool...I didnt give any sign. autho..I just sent docs yesterday...
    so keeping my fingers crossed until they file (without asking me to sign G-28 in between) :D


    Did you fill the actual I-485 forms or just the questionnaire that employers usually send? in case you've filled actual forms that they will send, did you check the box on the right bottom where it asks if you'll be represented by an attorney...

    In case of a questionnaire, you might get those forms filled by them for your signatures.

    Thank you guys for the good wishes :)

    Here is what we learned from my case, please feel wordsmith it and put it on wiki -

    Some History:
    My PD - Feb 2003 EB3 (140 was marked for CP)
    May 2007: EB3 dates move to May 2003 - my lawyer prepared for June 1st filing of 485
    June 2007: My wife's PD of April 2004 EB2 (140 was marked for AOS) becomes current - her lawyer starts preparing to file for 485.

    We discussed the situation with our lawyers (but we were sure we would go with what my lawyer advices, she always gave good advice - both the law firms are very reputed and well known)

    My Lawyers advice: Do not file both 485's at the same time, if the files get assigned with different alien #'s it will be very difficult to get the cases merged. Files could land up in two different physical locations etc... basically huge possibility of delays

    Her Lawyers advice: We have not come across such situation, we think we should file anyways.

    Our decision: File my set of 485 as we could do that on 1st June itself and apply for EAD for some relief! and not wait for July 1st (at that time we thought with was the best - better file what's current)

    Interim efforts: Again discussed the situation with my lawyer as things were not moving, we discussed possibility of changing my wife's AOS application to CP - since dates became unavailable, we though we could probably capitalize on switching to CP with the hope that the files will get transferred to India, and as soon as visa #s are available we will get assigned one and called for the interview.

    So we filed i824 - change request on exiting application, the request was pending all this while, we made several service requests in between. Basically it was a wasted effort, seems like USCIS officers didn't know what to do with the request.

    Sept 2009: My wife's PD became current, we again prepared for filing 485 (took medical again etc).

    Checked with my lawyer what needs to be done... her advice (this time both lawyers had the same advice), file 485 MAKE SURE they use the same Alien # that we got from my application.

    Files on Sept 1st > Finger Printing 1st week Oct > my set of 485 files moved from Nebraska to Texas early November > 2nd set of 485's approved late November > 1st set of 485's denied based on 2nd set approval

    HI Ivar,

    So in your case, did your older employer cancel or withdraw the I - 140 or it was active. Do you know if you can still port the priorty date if the I140 is withdrawn by the older employer. I have looked at most of the forums and haven't found a concrete answer to this question.

    Besides not signing this so called contract

    If you are H1 - as long as you are an employee - the employer has to pay the salary as per H1 papers, whatever be the business issues. If that be the case they can be reported as a violator.

    Non solicitation clause should state a time frame - but otherwise most contracts have them

    And as long as this is a new or potential employer - its a nice red flag to stay out

    Yes, I am in concensus too of the above statements.

    They might want to know if you are maintaining your status. for that they might ask the latest pay stub. It happened to me. Once I sent my pay stubs, it was approved. If you dont have the paystub, then you are in trouble.

    sometime's if they need to do some background-investigation to get more info on your visa status / educational background / name check or what-ever for no-reason etc , they just place you in this status. the tricky thing is do never know how long the wait is. ive heard / read some people have to wait in months for no reason. you should be happy that you received it in 2 weeks.

    I know that if you don't have H1 stamping you need AP to reenter. But if you have AP why do you need H1 stamping if you are working for the same H1 employer after reentery? Is H1 stamping a backup to AP?

    If you have a 3 year H1 extension (like I do now) you can get a stamping for 3 years and wont get tied up in AP extension filing etc. With the flood of applicants in July I think USCIS is going to take much longer to process AP/EAD and I am expecting periods between APs where I would be stuck, unable to travel. With a 3 year H1 stamp all those issues go away.
    Traveling on AP also has the funny effect that your I-94 would be stamped to the expiry of the AP (1 year) rather than H1 (3 years) and I dont know what happens when that I-94 expires... H1 travel is simpler once you have a long lasting H1 stamp. Main advantage of AP is I can renew without leaving the country and if my I-485 ever gets approved when I am outside the country, I can re-enter (my H1 would be invalid at that point)

    Please share more info on what steps you undertook to utilize your sopouse EB-2 PD from your already filled 485 as EB-3 primary.

    It will help others too.
