Exactly....I don't say this a trick by USCIS to divert our attention but that will definitely be the result. Everyone here (except with the older priority dates) will face retrogression very soon. Please try to understand this folks.
Everyone will file for 485 and will get stuck in the backlog, before you know if, it will be Oct-08 and then they will scrap the old system and make everybody file under the point system. Which of course would be a nightmare as the USCIS or one of its derivatives would not be able to cope with the flood of application. At the end of the day all of us would be 1000s of dollar down and would still be posting here complaining about the process.
Bottom line is, with a limit of 20 amendments, one can be assured there won't be one looking out for us out on the fringes.

If an individual already has a pending AOS application on file when a retrogression occurs that places the cutoff earlier than the applicant's priority date, USCIS sets the application aside and will not adjudicate it until the priority date is current again. Hi Guys,
I need your help on this. My cousin is running this small IT company in india and he mentioned that when US client sends their money to India via Pay Pal or some secure money transfer , they are charging them 4 % of transfer amount.
He ask me that what could be the best way to avoid this fees , some of the option that we thought about,
1) If they (cousin's company) open an bank account in USA and utilize this to transfer the money to indian bank account - Would they still need to pay US tax as money is being deposited into the US account?
2) If I utlize my bank account - I think in this scenarion I have to pay the US tax for whatever money the client is depositing into my account in order to make this legal transfer
3)If US client utilize remit2india, ICICI to transfer money which I highly doubt

Ask him to double check if his clients are using credit cards to do the transfers. Using a bank account has 0 transfer fee for domestic transfers. Not sure if the same applies to international transfers but good to double check.

I had contact with pappu on how to best channel the funds from my contributors to IV. The way I finally did it was to have them contribute to IV directly. However, some of the contributors were hesitant to chip in $100 minimum. So, I collected money from them through paypal, check and then did a personal contribution to IV.
I wish IV could set up a Paypal etc. account for my event where folks could directly contribute.

A friend told me about the E category visa for Australian nationals. Is this true?
According to him, if you become an Australian national, you can use the E-visa.
Has anyone migrated to Australia and returned to US successfully on a E-visa?

Laid off 6weeks back. Attended 4 interviews. Outof luck.
I used to get many calls from desi consultants. But not now. I do not know whether it is because of economy or my EAD status.
Here are my excuses to not to get job.
1.New Father (I was little confused about how every thing goes. Thank god no set backs here)
2.Functions(I was occupied to celebrate his 21st day).
3.Taking care of new born( He needs to be feed once in every two hours. Mother got tired of this.)
4.Holiday season.
5.Economy.
6.I am good at supporting my situation :) .
Hopefully I will land some where by Jan Mid.

you are incorrect ..here and there ..there are people who have been laid off. maybe you are lucky that you are not hearing it or maybe out of the loop.
in the last 2 weeks itself, I have heard layoffs for 15 people ..so it is happening maybe slowly but surely. IT are one of the big cost savers ..most of the time, IT job is first on the block because of instant cost savings ..actually there is a different trend too (too small to notice now) ...highly paid people are being laid off and those who agree for lower salary with similar skills are being hired.

I'm in the same boat, FPd on 9/20 no LUD so far. Besides calling FBI FP phone number and checking with them if the results have been sent to USCIS you can't do anything other than waiting. FP has nothing to do with name check.
Some people got LUD after FP and some didn't ( like me). Please do a Google search "FP no LUD" and you will see various forums in , Immigrationportal, IV and murthy talking about the same and there is no black and white answer. Good news is some people even got green card without any update on the LUD.
Yes I agree it's frustrating but our options are limited at this point :(

My PD is in Feb 2005, hence downloaded the 2005 MDB, did not find my case in there and to my surprise haven't seen any cases from the backlog centers. The database for 2005 contains only 14000 records, can't believe there are only 14K cases filed in 2005. Am i missing something ?

I like ur idea, can you design this or get someone to do this. It still has to have the same basic principle. we all have ideas we need someone to actually do this since we are mostly IT folks with programming skills can we get a volunteer or a group of volunteer who can do this?
I do not know whether this is going to help IV raise more funds or not, which should be the bottom line for every effort spent at this crucial juncture.
My thoughts on this scheme - Instead of going to outside web sites, we can design a scheme locally ourselves.
Currently we have member information like EB2/EB3, what stage of GC processing etc ... We can add another read-only field to this information like range of contribution by the member. For example,
Platinum member > $1000
Gold member $501 - $1000
Silver member $251 - $500
Member $1 - $250
Non-contributing member $0
When IV can come up with member, senior member etc ... depending on number of posts by the member, even this categorization can be easily implemented in the database. The exact dollar amount need not be disclosed.

Dude - think practically. If the billing rate that the company is going to get from the client is $70/hr and they keep only $5/hr then they have to give him $65/hr. If they have to keep him on the payroll, they will have to pay 7.45% in payroll tax, which is employer's portion of Social Security Tax and Medicare (reducing their rate from $70 to $65.1575). This means they will be making 15.75 cents/ hr (translates to $315 for a year assuming that you work for 2000 hrs - the remaining 80 hrs go in holidays - for which they may or may not pay). Even if they are outsourcing payroll, do you think that it will cost them less than $315 a year to pay him? even if it costs $0 - who would be willing to keep you on their payroll to make only $315 a year? Would you? and if you take unemployment insurance and liability insurance into account, the company would make a loss. If you owned a company would you follow this business model? If you are - you might as well just give your money for free to all your employees.
The only way you can get a company to keep $5/ hr and give you the rest is if you agree to a 1099 (and you cannot do that on a H1B - you need to use EAD for that). On a 1099 - there are other tax implications - now you have to pay both your share and the employer share of payroll tax (14.9%). And now since you are an independent consultant (which is what a 1099 is), you have to get your own Liability Insurance. To prevent people from suing you, you will need to form a LLC or some other type of corporation. You might want to get a good CPA to setup your company so that you can setup the right kind of company to benefit from the right tax deductions.
There is nothing wrong in making more money - just like you want more money, the corporations are out there to make money too. No one is in the business for charity. As long as the relationship between employee and employer is symbiotic, all is good. Once the equation changes, it is either time for the employee to say good bye to the employer or for the employer to off-load the employee from the corporate bus.
I have seen many posts in this forum complaining of "blood-sucking" employers and how they exploit employees. To me, that is the same as:
- programmer's guild complaining about us stealing their jobs or
- people losing their home and blaming the banks "for not disclosing terms"
- anyone who is blaming anyone else for their troubles
If you are being exploited, it is because you are willing to be exploited. Don't blame the employer. Blame yourself. If you don't want to pack your bags and go home when you lose a job and cannot get another one, don't blame the employer and tell others that they are "sucking your blood". Everyone is here to make money.

If I have an advance parole valid till 01 Januray 2011 (for example) and I want to come back from India on 20 January 2011. I have applied a new advance parole for this journey. But if I will apply transit visa of UK and submit the AP that is valid till 01 Jan 2011 (as I will receive a new AP after 90 days of filing) what will be the validity of transit visa? Will it be 6 months or will it be last date on my AP? What I need to do while travelling back if validity of transit visa is based on current AP and not on renewed AP? Please suggest. Thanks.

I never had original or any kind of birth certificate nor have it now , As part of GC application I have provided a certificate issued to me by Indian embassy in 2004 stating birth date, location with passport number as reference. Not sure if any Indian consulate in USA are providing that anymore.
I see lot of posts about birth certificate, I sure thought I would have to go through that process but I was never asked to provide anything more than what I have provided to USCIS. May be the rules are different now or it depends on case to case.
We should not be going through that painful process of chasing people in India to get birth certificate. I strongly feel that Indian embassy should provide it. It could be one of things that would generate some income and add value to the services Indian embassy provide.
Can you please help me with this?...I have already submitted the affidavit copy and now they want it from Registrar office. Has any one got it from registrar office in India? if so, how difficult it is and what is the procedure?

The oldest available evidence that lists the names of both parents should be submitted."

In short that forum story as follows :
On 6th Nov 2008....
He thought because of unemployment application, Two(2) Immigration Officers + One(1) State Police Officer came to my house a 6.00am in the morning questioning my �Legal Status� in this country.
But that found wrong reason as per his latest reply on 3rd Mar 2009....Immigration Officera turned to his door due to his Employer informed USCIS about his firing while revoking H1B.

Hi All, Went to the Immi court today and returned just now. My lawer had prepared a wonderful document "Motion to Terminate Removal Proceedings" and Pleading document. DHS was presenet. Since there were number of attachments with evidence, the court has given a "Individual Hearing" on July 6th Monday @8:30AM. My lawyer is pretty confident and it should be fine. I am one of the rare cases. I did see the judges list on notice board and did not find even one Indian name other than mine. Will keep all posted when things progress. Thanks for the support. Sheela Murthy okayed Unemployemnt benefit. So if one wants to file, go ahead.
