Laid off 6weeks back. Attended 4 interviews. Outof luck.
I used to get many calls from desi consultants. But not now. I do not know whether it is because of economy or my EAD status.
Here are my excuses to not to get job.
1.New Father (I was little confused about how every thing goes. Thank god no set backs here)
2.Functions(I was occupied to celebrate his 21st day).
3.Taking care of new born( He needs to be feed once in every two hours. Mother got tired of this.)
4.Holiday season.
5.Economy.
6.I am good at supporting my situation :) .
Hopefully I will land some where by Jan Mid.

in the last 2 weeks itself, I have heard layoffs for 15 people ..so it is happening maybe slowly but surely. IT are one of the big cost savers ..most of the time, IT job is first on the block because of instant cost savings ..actually there is a different trend too (too small to notice now) ...highly paid people are being laid off and those who agree for lower salary with similar skills are being hired.

NO, it is not normal. My lawyers recieved the denial notice in a weeks time and they had told me that they would contact USCIS if they did not get the notice in 14 days.
Even my AP got approved on april 22nd and it was mentioned in status that the approval notice was sent on april 22nd. But again they updated the same info on May 1st.Still i havent recd the approval notice.

not true. Irrespective of whether your 485 is filed or not, if your PD is not current, you can get a 3 year extension of your H1 if your I-140 is filed.
Saying this based on personal experience, and this has also been clarified by USCIS in its FAQ. Your attorney needs to mention that and ask for 3 years when the extension request is made. If they request one, they'll get one.

Hello Gurus,
My I-140 was recently approved. 140-485 filed concurently in July 2007. I have a new job offer and plan to use AC21. However I am worried because the wages at new job would be significantly higher than the old job. There are two reasons for the big difference
1-Desi employer v/s corporate employer
2-Dallas v/s New York
Any comments from people who have faced similar situation will be highly appreciated.

usually wage difference is not something on which your GC can be denied, but very large descripancy can raise questions.

Got the status update email from USCIS stating a card has been issued for my 485 application.
I am not married yet. What are the implications if I get married to a citizen of india residing in India.
Kindly refer me to appropriate material if you know of any.

Surprised to see that you were unware of this. Getting GC is painful process as we all know. There are three situations
1) Don't file I-485 till you get married. Risk, you might have already used 6 years on H1.
2) File your I-485 and get quickly married , then you can add your spouse. Do a court marriage in US and later you can do a marriage ceremony in India.
3) File your I-485 and get green card with out having chance to add your spouse
Since you fall in category 3, your situation may be worst.
Couple of options
1) If the girl(or guy :)) is in US, absolutely no problem. Only thing is if girl is already in US, you will get lot of family pressure from girl side.Have to compromise on lots of things. May be will become a house husband.
2) Girl from India, now you have to find a really smart girl who can get admission to universities or pass TOFEL GRE etc with flying colors. Then long distance affair starts. Girl in city X studying guy in city Y. Meeting once in a month. Lossing lot of money on commute and mental peace.The girl will have now her own friend circle and over period of time she might start liking someone else. Based on real situations.
3) Move to Canada and apply for Canadian citizenship. That's easier to get and easier to bring spouse there. But again you won't be able to bring her to US
4) Wait for 5 years. Who will want to wait for you 5 years.
Best Option
Return to your home country and enjoy life there. Believe me you won't have never any regret in life. It's just not worth for all the pains and miseries it bring in one's life. GC : Grievance Card.
Good luck with whatever you decide.

IRS does not use the same terminology as USCIS. If you are working in the US on an H1B visa, you are a "US Resident Alien" according to IRS. Those who pass a "substantial presence" test in the US can be claimed as dependents if they do not have significant income in another country, and are not claimed as dependents by anyone else. IRS will take your tax dollars whether you have a SSN or not ;-) That's why they issue Individual Tax Identification Numbers. Dependent visa holders use the ITIN to uniquely identify themselves in tax filings.

My 6th year H1B is expiring on April 28, 2008. I applied labor through PERM on October 2, 2007. I got the audit letter on December 3, 07. This audit letter does not state anything about the issue of the audit letter. However, the sentence �The job duties and/ or requirements are beyond those defined for the job by SOC/ O*Net code an Occupation Title provided by the State Workforce Agency� is highlighted in this letter. The letter also request for Business Necessity Letter and Recruitment Report. My case is the EB2 case for a Project Manager position with a minimum of 2 years working experience. A couple of programs and knowledge in the field are also required for this position. At the recruitment times, there are no applicants applied to this position. The company has approximately 16 employees including me.
I�m very confused and not sure what to do because my lawyer refused to answer any question. In my case that the Labor Certification is still pending (under audit) and my H1B is expiring in April, I wonder if I should start taking vacation now or go to work in another country for approximately 6-7 months and come back later to use the rest of my H1B until October 2, 08 to meet 365 days period? After October 2, 08, I can then start filing the H1B Extension for 1 year. Or should I wait until my I-140 approved and come back around October 2, 08 and do the H1B Extension for another 3 years? Or should I stay in US until April, 08 and take vacation until October, 08 and then comeback around October, 08 to file H1B extension? Same here. I saw another soft LUD today 6/14 after a LUD yesterday 6/13. Wonder if USCIS works on Sat or it's just some regular database update.

I came back via Frankfurt last month. AP no prob. But be aware of Lufthansa. It was worst trip of my life. Bugger airline had cancelled flight from FRA to Mumbai without notifying. They gave me two options after I landed at FRA. 1. Wait at airport for 27 HOURS for next days flight (as they don't give Indians visa @ airport for hotel stay) or 2. Wait for another 6 hours at airport, then take flight from FRA to zurich, wait at zurich for 3 hrs, then zurich to Dubai, wait at dubai for 3 hrs and then dubai to Mumbai. Unwillingly I had to accept 2nd option.
Staff is damn rude, had to wait in long line for 3 hours to talk to cust service.
Never in my life will I travel with Lufthansa :mad: :mad: :mad:
That's terrible and it could happen to anybody and I can imagine how helpless we feel at that time. I have utter contempt for those airlines. Please send emails to as many as possible to the airline and highlight your plight. Whether they hear it or not, they should know at least how you were mistreated.

While its a good idea to write to the president, Obama himself says he gets 40,000 letters per day, so its a rain drop in the ocean, no offense intended.
We need to do a coordinated strike by all members of the IV
1.Everyone send an email or calls the Congressman's office on a particular date
2.Call or email their senator on a particular date.
3.Write letters to popular TV talk show hosts on a particular week saying legal immigration is ignored in the immigration debate.
4.Send an email to the president on a particular date
5.Organize peaceful rallies in their respective cities on a particular date. This way no one has to pay for traveling in terms of flight tickets or pay for hotels
This has to be organized by PAPPU and TEAM as everyone respects their work and commitment.
PS Don't start of the donate campaign thread now, people will donate once they see action and not just words. Only #5 needs donation for flags, posters etc( even that content can be brought by folks themselves)
For a start, can we all just do one thing: Take an appointment with our local congressman/woman's office and do a presentation. No need to do it on one particular day. Just do it in the next month.

Also you need to have your A#.
This way you will atleast know if FBI sent the results back to USCIS.
FYI, LUD changed twice, the day we gave fingerprint and the day after.

USCIS needs to work with paper files for review/approval. RD as on your receipt is the mailroom receive date. Real receive date of a processing center is when they actually opened your file and entered in the system, which is what you see online as, "...your case was received on...". Processing centers prefer to treat this date as RD as this suites them better. In your case your true RD should be a couple of days prior to your ND. Who is responsible for the 4 months period in between when several thousand applications may have been received and entered in the system (and placed ahead of you)? Nobody.

USCIS makes a simple claim, they process cases in order they receive them. Perhaps they are talking about the paper files, which are placed in sequence on shelves as they arrive.
