I used to be client of Gowda couple of years back and I did not like the experience at all.
My situation was little different. Gowda's firm was the de-facto firm used by my employer although I used to pay all attorney fees out of my pocket. In spite of me paying for his fees the firm always put my employer's interests ahead of mine. My employer then was a typical blood sucking desi consultancy shop and used pending GC as one of their leverage to make employees stuck with them in spite of poor pay scale. As far as my own experience goes Gowda's firm happily played along with my employer in the grand scheme. They denied me any update regarding whether my labor was cleared as well as didn't send me any original approval notices/receipts etc. at my employer's request. When I raised lot of noise I was finally told I can no longer have direct access to the attorneys and have to route my requests through my employer! I wised up, cut short my losses and ditched both of them to join a big respectable company loosing my earlier PD and approved labor in the process (which I'm sure my employer must have sold back when LC substitution was legal). I finally received my GC in September.
Your experience maybe different if you directly retain Gowda without involving your employer. Competency is not an issue here, conflict of interest is.
I agree with SSA. I retained Gowda without employer interference and still I did not get proper service and guidance. Further I found that Gowda is not keen to handle EB cases, compared to Investor categoy cases and the rates are exorbitant if there are any RFEs or representations for smaller persons. I moved away to Ron Gotcher and found his fees are dead cheap and his services are thousands of time worth, compared to the fees I paid.

Another interesting report is on increasing aging population in US. While India, China & other emerging markets have a lot of younger population (productive age).
America, Europe and Japan's aging population Time Bomb (http://www.d-transition.info/western-demographic-winter-2/america-europe-japans-aging-population-time-bomb-382/)
Module 2: Demographics of An Aging Population (http://www.ageworks.com/course_demo/200/module2/module2.htm)
What it would mean?
Well the younger workforce is ready to contribute towards bottom line of the economy thru SS, Income taxes etc. and offset the liability side of the budget... Another ammunition point!!!
India has a much younger demographic profile today, as well as a higher birth rate, which infers that India will have an advantage over many other countries with regard to demographic burdens from an aging population at least until the latter stages of the 21st century.

Bummer is a word used to express disappointment.
He was not name calling. It takes a while to pick up the slang but it sure helps you to assimilate better.
And, if you were already familiar, before you go on a tirade on me, please hold your horses..
Thanks lskreddy.

Changing citizenship does not affect how Priority Dates are recaptured (aka pd porting).
Once you are Canadian citizen, you can also avail TN visa (in addition to H-1B) to work for US employer.

Please do not mix social issues with immigration, this is not a forum about one particular country or its social manifestations (like how do I marry?, should I stay single forever? How am I going to find a girl?). These questions are absurd from American / immigration standpoint. If you already have a spouse and have immigration issues related to those situations then yes that is valid to ask here but otherwise (But how do I get the spouse then???) is purely a social / cultural issue. Please stick to immigration issues.
Thank you.
Thank you.

Not really, broadly speaking lack of information can never be a benefit to consumer. (Read: hidden clauses in agreements). It might be that they have been doing that and we don't know. You will ONLY know if you apply for another H1B transfer or any other application say I-140/I-485 with new employer and then USCIS MIGHT tell you that your I-140 is revoked on MM/DD/YYYY and you are no longer in valid H1B status since then. That would be too late and it is not retroactive. Remember that onus is on you to maintain valid H1B status all the time during the period of H1B. Once again I am not saying what I mention above is the correct interpretation of law, but in the absence of any clarify it can be one of the implication.
well...The history is that USCIS did release the proposed regulation dealing with all these back in 2002 if I remember correctly..Then there was a comment period...They got so many comments...that after that they did not even bother to publish the regulations in the federal register...That was the last heard of it....Now the only time when the issue of these regulations can possibliy come up is when there is a leadership change in USCIS...Any our fate would depend on who is in control of USCIS at that particular instance...
But this sword would fall some day..I donot know when..I donot know if it would fall on us....or we would just steer clear....The thing is that there is a lot of resistance to changes in status quo both inside USCIS and AILA...
Well AILA would want the status quo to continue....Them lawyers are making money of us anyway.....
I am in US last 7 years...The career is stagnant..No sign of GC anywhere....I am very despondent...But then what else is new ???

No one is 100% perfeect, it does not mean we should not work, If anyone feels we can do better than why you are talking rather than working what you believe is.
At least some one is trying to voice issue at some level at their best knowledge and efforts, so we have to encourage people to do better by providing means of moral support.

You have already violated your F1 status. You can not have a company apply for PERM & i140 while on F1 status, period. All that stuff of "it’s for a future position" or "you did not authorize the company to apply for I 140" is B.S. The only thing that matters is that F1 is not a dual intent visa, and initiating a immigrant process in your name (yes the PERM and I140 applications have your name on it meaning you authorized it) means you violated F1 status. You need to consult an attorney before you file for H1.
USCIS has F1 file. If it illegal to apply for PERM while on F1, why did USCIS not reject PERM?
If they did not catch it at PERM, why did they not catch it at the I-140 stage?

We submitted our EAD application in June first week and we got our card this week, effective from last week of July for the next one year.
Our priority date is October 2006- EB2 and we are not current. So shouldnt we have been issued a 2 year EAD?
Also we gave our finger prints last year (July 2007 filer) but this time too both the EAD cards shows no FP available .
The EAD card of my spouse (he is the primary applicant says signature waived) I still have signature on my EAD card. Anyone else with the card that says signature waived. Previous card had his signature in there.
I heard that's the way it should be from Aug 1st...
Someone advise...

Man you gotta shove it in your a$$ - that's the safest place pal.
See I am still regretting not doing it, lost my GC and had start all over again in July 07
Thats not a nice reply.
Congrats for getting your GC!
I hope EB3 Guys do not treat EB2 guys with such a hatred behaviour
We will make it too sooner or later.
I am sure next bulletin will be a surprise for everybody

In Kansas there is a strangely different rule. They give in-state but show the balance amount between in-state and out of state as scholarship given to the individual in a separate 1098 T tax form. This increases your taxes slightly and the individual cannot claim education credits in the tax return.

This is my understanding. Please cross check with a lawyer.
Once I-140 is approved, the PD is yours to keep for life unless it is revoked by USCIS for fraud reasons.
Here are posts from Ron Gotcher:
Does approval of I140 change your status in anyway? (http://www.immigration-information.com/forums/i-140-petitions/46-does-approval-of-i140-change-your-status-in-anyway-2.html#post5136)

Following intresting info is listed on the immigration-law, wish it is true :)
"There has been going around a rumor lately that the USCIS was internally discussing retreat from the 485 rejection decision. It appears that this rumor probably started from the USCIS HQ order over the Texas Service Center to hold all the July 2007 EB-485 applications abeyanbce and not to return the applications to applicants. Unconfirmed sources indicate that because of the order, the Texas Service Center is not returning the EB-485 applications which have been received since July 2, 2007. However, there is no evidence that the decision is necessarily related to its potential decision to withdraw the rejection decision. At this point, its reasons are completion unknown. Please stay tuned. "
Hi,
If it is going to be true, then that is the most happiest news for everyone over here!Hope this happens!!!
