As far as I know if the old I-140 is revoked or withdrawn before new I-140 approval one can not port PD.
My old I-140 is still active so it was safe while porting. I am not sure what happens if the old I-140 is revoked, sorry i don't have answer for this..

rsk73, your job decides if you can get in to EB2 or not. if you are working for MNC and apply for PERM, the current market is bad and they will ask you to wait for 6 more months. so, I don't believe this is a right time for PERM application - my 2 cents
P.S: normally, these kinds of EB3 to EB2 porting questions are a little sensitive in the forums but 12th year H1B.. damn.. you are surely qualified for EB2, problem is, your job should. All the best...

Agree...although "Posted" date is indicated as July 16th 2009, the "As of Date" says May 31,2009. This NOT upto date info. does put all TSC June 2009 EAD renewal waiters in distress/chaos/panic mode....
EAD applicants need not be in panic. They take around 50-60 days. There is clear note that if you don't get it in time you can get something on priority basis from a local center. It is a hassle of course.
Difference betwen "As of ..." and "Posted on ..." dates suggests that someone is reviewing the data before it is posted. Govt reviews, you know, are not very quick. Bosses may be on vacation, checking, asking questioins, getting explanations, all on paper/emails between offices all over the US, etc. etc. Inside information suggests USCIS is working hard, but beurocracy has limits, and changes over the years (most to provide interim benefits to us), and very long ques are not efficiently handled by the systems developed prior to these changes. For example, systems are not designed for managing severely retrogressed PD's, or someone waiting several years for GC, etc.

I was in a similar, but slightly different, situation. I got my 3 year extension while my previous extension was still valid (a couple of days left).
So at the POE, the officer gave me on the I-94 a date that was 3 years from the date of entry (that's the max their system was designed to handle) and said that since I have the visa on the passport, the next time I reenter I would get the later date on the I-94.

Can any one tell me is it necessary to Get medical done by Dr. only around ur location.
Reason for asking is I live in NJ. And i got an appointemt with DR. Kim in NY as i know him through somebody else.
He is also more reasonable asking around 190/-

I am also in similar situation although no RFE yet. I have submitted a non-availability of birth certificate letter and affadivit of parents. I have the following questions
(1) Do we get the letter from the muncipal office from the place of birth or we can get from the muncipal office that we are presently residing. (birth was in UP , residing in TN)
(2)What is the letter for , is it for birth certificate or for non availability of birth certificate.

if you sent it between july 17 and august 17 there should be no problem,, uscis was accepting i 485 forms without medical exams due to the july 2nd trouble.

Hello,
So yesterday (Saturday) was another surprize, a pleasant one again! I got a call from the same IO who told me that he got all the documents that I had sent and has cleared my case for approval, but now my fingerprints have expired.
He asked if I could come right away to his office and he could give me an instant fingerprinting appointment in the nearby INS office. When I told him that I'm currently out of country on business trip and won't be back in US till April, he said he will send me an appointment near April 15th.
I thanked him for his follow-up and he said he was just doing his job. I know this might be an exception than a rule, but just wanted to acknowledge this particular IO and hope there are more like him.

I got RFE through attorney. It is asking following details
1. Emloyment verification letter with present and intended permanent employer
2. Last two months pay slips
3. "Although your I 140 petitioner indicated in your initial I485 filing that you were employed by company A at that time, your Form G325 indicated that you were employed by company B and you were authorized by B at that time, please explain discrepancy"
I am bit worried about question 3. I worked for company A and labor, I140 applied when I was with A.
But during I485 filing I was with company B and in G325 I mentioned that.
It looks like company A by mistake mentioned that I was still with them.
I called my attorney he said its upto me decide which company I should work for.
But I am not sure company A provides an employment letter for me because I am working for comapny B now.
If B provides employment letter since it is >180 days since I 485 applied, will there be any issues?

From what I understand, you changed employers before filing I-485 and used the same Labor/I-140 from the old employer to file I-485 while working for the new employer? Wow!!! And your new attorney filed your I-485? Your attorney should have known better....
From what I know, it doesn't work that way, the 180 day rule applies to change of employment after filing I-485, not before you file it. You should have started a new LC/I-140 with company B and filed I-485 using the PD of the old approved I-140 from company A...But your case is not lost as long as you can provide an offer of employment from company A saying that they will hire you once the GC is approved...
Obviously, this is my opinion and others can comment on this as well....
