Is it possible to file I-485 without I-693(Medical) ?
The reason I ask is that I cannot get a doctor's appointment in July. For some reason, if we are able to file in July, can I submit the 485 first and submit teh I-693 later.
Please advise

Absolutely. Assuming your I-140 is approved/approvable and will not be withdrawn, you will be able to AC21 to your new position after 180 days of I-485 pending. And the best thing, it will only depend on similarity of the job, and no ability to pay questions. Good luck!

H1B is a fallback in case I485 is denied. Kumar - you may need to check with your attorneys or an independant attorney on immigration law.

You are exactly right. Both H1 and L1 are dual intent visa so why would one be considered resident while the other one non-resident? I don't see how L1 can fulfil the requirement while H1s can't.
I was wondering how L1 can be allowed instate tuition while H1-B's have to pay out of state according to the Arizona list. What exactly is the fundamental difference between the 2 which results in L1's fulfilling the requirements?

Received the following RFE on H1B Extension.
1. copies of signed contracts between the petitioner and XXX (my name)
2. a complete itinery of services or engagements that specifies the dates of each service or engagement, the names and addresses of the actual employers, and the names and address of the establishment, venues, or locations where the services will be performed for the period of time request; and
3. copies of signed contractual agreements, statements of work, work orders, service agreements, and letter between the petitioner and the authorised officials of the ultimate end-client companies where the work will actually be performed that specifically list XXX (my name) on the contracts and provides a detailed description of the duties the beneficiary will perform, the qualifications that are required to perform the job duties, salary or wage paid, hours worked, benefits, a brief description of who will supervise the beneficiary and their duties, and any other related evidence.
NOTE: The evidence must show speciality occupation work for the beneficiary with the actual end-client company where the work will ultimately be performed. Merely providing contracts between the petitioner, through any other consultaants or staffing agencies, to an ultimate end-client.
My employer is a small consulting company for whom I work on corp-to-corp positions. Now my employer is saying that he cannot reply this RFE and asked me to work on EAD. I would like him to atleast reply the RFE. Any advise in this direction would be highly appreciated. Need to reply by Jan 29.

my employment is terminated a month ago. I still need to file h1 transfer to the GC sponser. I am single
I am told that H1 can be transferred only with in 10 days-20 days or so. which means that it is already a month. so in case if I dont get the h1 or if I have an issue in the H1 transfer, is that the end of my being H1.
If I were to be on H1 again is it going to come under the cap along with those new H1 filers? I still have one and half years to complete 6 years.
I have a fall back to EAD though based an approved 140 and 180 days past 485.
But how do I get the spouse then???

This is a Tricky situation.you need Medical leave for your child but 4 months is a bit too long. Pls.contact your Attorney about the consequences of taking 4 Months leave on H1B visa.make sure your HR provides you with all the Paper work that your Attorney might ask to substantiate your leave.

My new born son is sick and he needs total attention for next 4 months. I have used up all my vacation and planning to apply for medical leave. Pediatrician recommends me getting medical leave and support my wife.
I work in a very big hardware company. I have completed 3.5yrs in H1B so far.f I apply for medical leave, I may get a pay cut (like 20 to 30%). Will I be affected because of this medical leave? Are H1B's allowed to take medical leave (upto 4 months)..

I was finally able to get a doctors appointment on July 24th.
Now comes the tricky part:
Is the varicella vaccine required ? I have not had chicken pox as a child. The blood work showed that I need a chicken pox vaccine.
I went to the county health department today , and they gave me shots for tetanus, MMR, PPD, and one shot for varicella. They said that I have to come back in 30 days for another shot of varicella.
I am not sure what my doctor will say to this when I meet him on July 24th. Also, is it possible for the doctor to provide an I-693 with a statement that the varicella shot will be completed later ?
