Can we do something about this.
Maybe we can go to a federal court saying it is discriminatory and get a ruling to that effect. This would stop "any" state from coming up with such legislation.

We have too many items to worry about. DL should not be one of those.
In this country one cannot work without a driver's license. It is a matter of human rights. When USCIS gives us work authorization that has only 4 months remaining on it, a state ( Texas ) cannot say that I am not eligible to drive in this 4 months.

Last year I had already filed for married filing jointly before stimulus check thing was in discussion. From what I understand once you file married filing jointly you cannot amend to married filing separately. You can amend otherwise.
Anyhow this year if I do my taxes separately I end up owing to IRS. Does anyone know where to look for info for amendment?

Folks i got a LUD on my AP 7 days back and again LUD 5 days back. But the status didn't change nor i get any letter of so far.
Does this means i'm on my way to a RFE :) If they send RFE does that gets reflected on the Online Status ??

I had the exact same RFE. I'm on H1 since 1998, and you can imagine how many times I have left and entered USA. I have about 8 H1B extensions. Here's what I sent...
1). Cover Letter stating list of document to show evidence of law ful status in US.
2). I-94 card issued by CBP at the last port of entry.
3). ALL the H1B extension notices issued by USCIS. Its important that there are no gaps in dates on the extension/change of status notices.
4). passport copy containing all US visas and entry and exit stamps.
5). A document explaining the entry and exit dates matching the stamps in the passport.
6). Few pay stubs from the current H1B/green card employer that you are currently working.
7). Few W-2s for last few years.
Usually the I-94 that is on the extension of stay issued by USCIS is the same number thats issued by CBP at the Port of Entry. So, USCIS should be able to match the entry and exit information and extension of stay notices
I'm sure they know that one surrenders the white I-94 card when they leave US.

You need to have your old I-140 approved to port PD to your new I-140. If the old 140 is not approved by the time you file you new 140...thats fine. At a later stage when your old 140 gets approved have your lawyer send a letter to the processing center with PD porting request for the new one. At that time your new 140 can be in processing stage.

I agree 100%. Anything that affects business and competitiveness of the US will be always more important than sob stories of individuals. Latter is collateral:)
just an idea, but the reporter should probably speak to the employers of people who have left, and highlight instances where they have found it difficult to replace the departing employee.
USCs are probably more impressed by effect on the US than the hardships faced by us

Wow, I am really excited about all the support!
I know that with the weather up north (yep, I am in the deep south) it may seem impossible to train/run/walk now, but you can run indoors on a treadmill, cross train on the elliptical machine and even use indoor running tracks. At my gym, I manage to do 8 mile training runs on the indoor track, guys that is 81 laps around this itty bitty track! :) Nutty? yes; but when you are motivated, you can find a way.
The three national events we pick can be for later in the year, but each Team IV member can run local events (weather permitting) accross the country. The fundraising can be 3 events per Team IV member per year. That would be in keeping with the 3 national events we pick.
My idea is for Team IV members to host a targetted fund raising campaign - which is divided into 3 events over the span of 1 year. I have a host of ideas to present on activities you can do and you only have to choose 3 of them for the year. We can get into these details after I run my ideas by the Coordinator Group.
I am going to set up the Group this week, so those who have responded to me, look out for my e-mail from my yahoo account.
Let me just say this much for now. I have run several long distance races over the past 10 years in the US and each and everytime that I have run for a cause, I found myself more motivated to train and I had more fun throughout the process.
Another point I should have made earlier. America today is concerned about obesity and "which is the fatest or more obese state in the nation". We are constantly seeing news articles and polls about these topics. Let it be know that the legal immigrant community of IV promotes a healthy lifestyle by its Team IV campaign. Another positive spin-off for our community and IV.

It is 6 months before status expiry date (I-94). This is not linked with visa stamp expiry date. You are mixing visa status dates with visa dates.
2) Currently your status is H1 , if you use AP then ur status will becom Parolee and if you use EAD then "???"

I am sure others might have noticed that 485 processing dates at NSC (for example) have literally crawled from the beginning of the year to now. Here are the processing dates (per USCIS status).

For one thing - there would be thousands of applications between 07/19 and 07/28 (mine being one of those :D) and the other is that the USCIS doesnt pre-adjudicate. Since the PD has only moved recently, the processing dates didnt move that rapidly

What are the frustrations,hassles, issues in doing this.
I have heard that during work commute hours the cars kleep moving fast and officials doint delay if you have proper papers, but on weekends its a nightmare (so wont affect us).
Any real experiences you can share will be appreciated.

It certainly seems like the RFE rate for supportive evidence has increased recently. Certainly for the 140 cases but also for other petitions as well. I had never received an RFE before, but recently got 2 for different petitions. An RFE always makes you a little antsy no matter how routine it is.
We are also hearing about PERM audits higher and denials also more frequently.
So far the RFEs seem to be for the common issues, like ability to pay, education qualifications etc.
It might be a good idea for someone to compile a list of typical RFEs at various stages. The rest of us can start adding for the benefit of those who get one in the future. In fact it might have been done already. I remember Logiclife putting something together during that 485 filing time in July/Aug.

You can enquire with the Canadian authorities if they will collect it and pass it on the US post. If not you can take a U turn once you enter Canada and go back to US to give them the I-94 and take a U turn again to re-enter Canada.

I have a quick question for everyone who has filed online. The I765 that is generated and appended at the end of the receipt pdf is an older version for me. The top left corner header is U.S. Department of Homeland Security,
Bureau of Citizenship and Immigration Service and the top right header is some OMB# and Expires 04-30-05. The bottom right footer reads Form I-765 (Rev. 5/09/02)Y

I never demanded permanent residence in the US as my right. But I have the right to have my LCA adjudicated in a reasonable time (months, not years) by the US administration. Months, not years! I am here legally, I work hard for this country, pay honestly my taxes and I am entitled to get a quick reply to my application. If it is rejected, OK! Fair enough, I will look for other opportunities.
A company invites you for an interview. You meet them over the course of a few hours and expect an offer. But they don't get back to you. So do you keep waiting forever for that phone call? Or do you assume that you didn't get the job and move on?
We HAVE a choice of going back to our home country: if some of us (me included) choose not to take it, it's because we think the GC will more than compensate for the opportunities we are losing currently.
Don't get me wrong: the US government should fix the broken immigration system. American citizens would never tolerate the tardy service we suffer at the hands of the DOL/USCIS. But in not "voting with our feet" we are part of the problem. Just imagine, if a substantial fraction of H1 visa holders left the US tomorrow (and quoted the backlogs as the cause) wouldn't that get more attention than all our efforts so far?
