My F1 visa was rejected for no good reason long back, before i even came on H1B. So its kind of scary every time I have to go for visa stamping. Its very random. Guess its just the fear inside me.
So I guess its all about the risk, if or not I want to get my H1B visa stamped or just wait for the freaking AP.
I was in the same boat as you and came here subsequently on H1. I do not think your F1 reject has any bearing on your H1 stamping both are different. If your stay in the US has been lawful, no gaps, out of status etc then you should be good be in good shape. You know the drill on the documents to carry etc if needed to get the stamping out of country.

IRS can go back 3 years unless they have evidence that you understated your income by more than 20%. There are some depreciation issues that may allow them to go back further.
As far as I know, IRS and INS (USCIS) do not share information with each other. USCIS is under the Dept of Homeland Security and IRS is under Department of the Treasury.
I actually read a newscoverage in California couple of years ago where INS sued the IRS for not providing information about the illegal immigrants. INS claimed that they failed to obtain information from the IRS about the illegal immigrants who were filing tax returns using TIN numbers. If I remember correctly, INS lost the lawsuit and IRS was ordered not to release information on people to the INS.
Just to clarify a little more about TIN and SSN is that you cannot get a SSN unlress you have some sort of work authorization (Such as H-1, EAD or even F-1 working/willing to work on-campus) where you can get TIN numbers from IRS and they don't want to know your visa/residency status. So, if you are living illegally in the U.S., you can still get TIN number and file tax returns.

We gave our FP. LUD changed twice :once on the day of FP and then on the next day.

3 options
1) file H1 on Apr 1st and if H4 is not approved by then withdraw pending H4
2) file H1 on Apr 1st before the current H4 expires and hope that H4 is approved before H1. H1 should be approved after H4 to have the H1 status. If H4 is approved later, H1 status will be lost
3) Request PP of extension and 99.9% of time 539 is approved along with 129.
I will add more info as I find.

It could take anywhere from a few days to a couple of weeks. For me - it was around 2.5 weeks from the time the status changed to "we received your response....". Plus with the Thanksgiving break - it might take a bit longer. The best thing to do here is just not to worry about it and just wait...since its no longer in your hands.

My wife worked as a full time employee and resigned after the delivery from Oct'08. She was paid the sick pay through a third party insurance and these wages are missing in the W-2. I tried contacting her employer and also wrote emails saying I would complain to IRS if they fail to provide a corrected W2. Today is 02/14 and we still didn't receive a new W2 for the sick pay or a corrected W2.
1) What consequences the employer would have to face if they fail to report correct wages on W2?
2) Does IRS is concerned about missing wages that are 1-2K?
3) Do you think I should complain to IRS?
I am planning to lodge an official complaint on Monday 02/16. I suppose it was a deadline date for all employers to provide W2 or a corrected one.

The names on the two I-94s do not match because you used the old name when entering the country. <-- your fault. DMV is not an authority on immigration. My best guess is that the newer I-94 prevails.

As per AC21 rule, it is from Receipt. However, let's put some practicality into the matter. Some IO's interpret the rule wrongly and used Notice Date instead. So what will happen? Your GC denied for wrong reasons and you file for MTR because it was USCIS mistake. If you're willing to take the chance, then go. If not, better use Notice Date for practicality purposes and to avoid all the hassle of MTR, etc.

There is a very clear distinction b/n Legal and illegal immigrants. He loves chinese food, indian food. He never says he does not like other cultures. What he says is that others come into this country and try to claim that it is their own country and start doing things the way they want to do. But legal immigrants for the most part are different they come here and play by the rules. they speak english, they love america and that is the reason they stay here. I think it is very important to talk to him and see what his stand is on this. It does not hurt. It is tough to get thru' to talk to him and hence I posted the message here so that others can also try and may be one of us will get to talk to the guy. If we just stick to the IV talking points and tell him we love america and of course are english speaking ( we are definitely not lying) he will be fine.
