Simple. If it wasn't for that ceiling the vast majority of the visas will go to applicants from the oversubscribed countries. Now this is not a bad thing if the visas are in unlimited supply. But since that's not the case, the country ceiling ensures that even people from smaller nations will get an equal oportunity to claim a visa before all the visa are grabbed by their BIG brothers and sisters. And what's more what ever is left is given back to the oversubscribed countries.
How can you call that unfair? Is it fair to deprive a person from a smaller country, equal chance to have go at his GC?
"equal chance to have go at his GC"
I don't have an issue with equal chance...thats exactly what i am asking for.

To be honest, you are the kind of people, with the right attitude and qualifications, who deserve the GC and should not be subject to these mindless wait times. I am truly sorry for you. Hope the best for you
Who defines what "right" qualifications are? Will IIT Kanpur make the cut and not IIT Guwahati? In the US, especially Sillicon Valley the best people from all over the world come for work. People from the best colleges in their countries come to work in addition to people from "normal" colleges from their countries. Where does India's top colleges stand compared to the best colleges around the world? IITs according to some rankings are not even in the top 200 colleges. Does that mean we exclude them altogether? Where does that leave BITS Pilani? Stop harping on that qualifications theme. I know people from both Bombay University and IIT kanpur Eb2 2003 waiting still for their GCs in the same company and same department. Workwise both are similarly capable.
I would suggest you to think hard before you do your MBA. An MBA does not teach you that 1+1=2 all the time unlike an engineering field.

Matthew Oh has been known in the past to be a BIT of a sensationalist.
Yes, there's no doubt about that. Although Mr Oh must be credited for providing us with valuable "insider" AILA information, he needs to tone down the manner in which he sometimes presents this information. This particular information is flashed as a "Special Red Alert", with very grim language on his blog. He should also have provided details on how AILA's liasion is working with USCIS to correct the situation, which is clearly a violation of regulation on the part of USCIS. Given the clear outrage over the lack of transparency in the case of the "other worker" category, what are the chances that USCIS will do this again, esp when it is against regulation?
I won't be surprised if OH gets kicked out of AILA...for leaking AILA insider info (good for us), and for his sensationalism (bad for everyone).

Guys
On the sameline, I think no one is crazy about anything but material wealth for self.
Take my example, GOV of India spent lot of money on me so that I get a degree from IIT and here I am in USA salivating over GC dreams.
If I would be kicked out of USA, I may move to Canada, if I kicked out of Canada then to Australia and it would continue............
Aptly quoted fot this situation ( sorry for hindi language)

I don't think anything like that will happen ..first of all it is not easy at all ..definitely many will leave (especially lot of people who just crossed the borders are moving back and the joke is that they are building a wall to prevent people from leaving :)).
but I do think that one way or the other something will happen in terms of faster immigration in the next year ..or else I don't know from where will they find so many buyers of houses ..look at this article about Georgia ,..which people kept saying -- that there is no bubble .
(look at the print in bold ..I am still wondering if it is a misprint or real ..117 months supply of homes !!! ..the other funny point is that bankers are running after builders with hot rods :D).
----------
The housing market is so bad that some banks and builders that had been business partners are now adversaries, and experts are using the dreaded D word.
In northeast Georgia were not in a housing recession, were in a housing depression, Jim Williams, president of Southern Highlands Mortgage in Blairsville, told state lawmakers at a daylong hearing Wednesday. The retiree market, the secondary market has all but dried up. There are no homes being built.
Your guide to metro Atlanta foreclosures
BUSINESS
Likewise, Eugene James, head of the Atlanta division of the research company Metrostudy, said the 22 metro counties it covers are in a housing depression right now.
James said sales closings were down 44 percent for the third quarter, compared to the same period last year, and housing starts had plunged 67 percent. The metro area also has about 148,000 lots with infrastructure but no homes a 117-month supply, he said.
Legislators are trying to figure out what they can do to encourage home buying and rescue residential builders. The General Assembly convenes next month, and new bills might be introduced calling for tax incentives, expanded down payment assistance or reductions in home building regulations.
A down payment assistance obviously would be very, very beneficial to citizens, Lt. Gov. Casey Cagle said after speaking to the joint economic development committee.
A federal down payment assistance program ended last fall and the current state down payment assistance program, Georgia Dream, is limited.
Sen. Chip Pearson (R-Dawsonville), co-chairman of the meeting, was intrigued by a California rescue plan that Chuck Fuhr, Ryland Homes Atlanta division president, described.
In the 1990s, the California Public Employees Retirement System began making loans to home builders and investing in residential projects in order to turn around that states faltering housing market, Fuhr said. The CalPERS program was so successful, it expanded out of state, he said.
Almost every small builder I know today has his bank knocking on the door, trying to collect his loan and put him out of business, Fuhr said. If builders continue to fold, competition will lessen and home prices will escalate, he said.
Kurt Cannon, president of Rabun Builders and the Home Builders Association of Georgia, said at the hearing that worried bankers have turned on builders, even those with good credit, by calling in loans and threatening to sue.
Cannon presented several pages of e-mails hes received. A Paulding County builder wrote: The president of the bank replied back that five of the seven bank presidents in the county had lost their jobs and he was not going to lose his. I am going to foreclose on the property you have here. Then I am going to come after you personally and sue you for the money you owe me and everything else you have.
Maybe you are right. But I think that the main problem is not housing. It is the export/import imbalance, manufacturing jobs(maybe other jobs) leaving US etc. The housing boom, which was selling and buying to each other at higher and higher prices, masked the real problem in the economy. Government can do all it can to stop the house price sliding, but then what? We cannot generate economy again by buying and selling house to each other. People are asking 'where are the real jobs?'

Discrimination in employment based on nationality is not allowed. However, can we extend the argument to the employment based immigration? We can always choose to take that promotion though we will lose our place in the queue.
Leaving the question of fairness aside, under the current legal framework my guess is we do not have a case.
Then fight for changing that constitutinality. Who made it? Why did they make it the way the made it? Slavery was supported legally way back.. If black community might have thought " They do not have a case" as somebody has created the constitution to suit their own need and "within the framework of that legality" "they do not have a case"... then still we may be seeing slaves around.
I understand your point that we are not yet "citizens"... but for many fair practices society must not differentiate.

As a person you are offended that I made comment based on what you said in one post without considering your whole lifestory. India's history is out there for everybody to see and most educated indians know pretty well what kind of a nation India is.
However, you managed to compare India with Nazi Germany. Great job. Based on 1 incident, you managed to slam a great nation like India. But when it comes to you you want many factors considered. Why the double standard?
Then there are some wacko job politician from TN that says if Prabhakaran is hurt , they will separate from India. All they need is read back to early years of post independence India and a person named Vallabh Bhai Patel. There are still people with similar capacity in India, that will bring such wacko jobs and their supporters in control.
Remember, same goes true for the wacko jobs from Maharashtra too who say Maharashtra is for Marathi's.
Don't compare 1971 Bangladesh with current day Srilanka, if you can think straight.
Flag burnig is a criminal offense in India, just FYI.
Technically I can change my country of citizenship any number of times in my life (cannot, if struck like this GC limbo) or even religion but I cannot change my ethnicity even once because I'm born into it.
I agree Sri Lanka is a sovereign country but why did India poke its nose on the pre-1971 Pakistan and created a new country Bangladesh. Is there a different standard for different people with the Indian govt policies?
Even If I had not got the opportunity to come this great nation United States of America, land of free and country of brave, I would have done whatever I could in India to help the beleaguered Sri Lankan Tamils and protested against the policies of Govt of India toward this issue.
Im upfront about showing my resentment towards my country of birth and I dont show false patriotism/nationalism towards India like other Pseudo-Nationalists, who internally betray India at any moment and ready to change their nationality at the next opportunity but externally portray that they are the guardian of India and it is their soul. I currently live in a country, where even burning the national flag is considered a form of protest, if someone thinks that expressing resentment to India or protesting against her policy is unpatriotic, grow up guys.
You can say whatever you want and judge me in your point of view, Im not going to argue about it because you dont live a life of a Indian Tamil with hands tied of being called a terrorist, when you support Sri Lankan Tamil cause, and you cannot understand the relationship we (Tamils from India) have with the Sri Lankan Tamils, besides the people (including small babies and even some in the womb), who are getting killed in Sri Lanka by the Sri Lankan government are not your kith and kin.
You dont know me, and you dont know what positive things me and my family has done and doing to the people of India, particularly to the farming community and you dont know what Im doing to rectifying issues (whatever Im working on)..you should be careful when making these kind of statements on person you dont know anything about except one comment on this thread.

I dont know what this means. He said previously EB3 backlog is massive. So assuming40 percent of indians would give 160,000. Out of those assuming 50 percent for EB2 would give 80,000. Question: Is eb2:eb3 ration 50% ??
"I think that the numbers are generally accurate, but I disagree with the conclusion. In large part, I rely on what I was told in a conversation with the State Department officer responsible for calculating cutoff dates. He told me that the Indian E2 cutoff date is going to retrogress back to late 2002 or early 2003 in October. He said that the Indian E2 backlog is MASSIVE.
Looking at the total number of people who have filed AOS applications, or who have been reported as documentarily qualified to consular posts, we see a group of at least 400,000. This was as of a couple of months ago, after much of this year's quota had been used. I'm told that between 40% and 45% of the people in the known backlog are chargeable to India - and most of those are E2".
IMO, "MASSIVE" is a relative term. Even if there are 400,000 applicants and 45% of them are India and 60% of those are E2, the total is just 108,000. Not that bad if we look at the calculations and E2 numbers India gets this year and next year. I think it is sensible to say the actual number would be lower than 108K.
Having said that, before horizontal spill over, all these numbers (spill overs) were going to E3 ROW. Why is E3 ROW still severely retrogressed? Apart from calculations, I am attempting to do all reality checks. Is the volume of E3 ROW so heavy that around 50k + additional visas are not helping to bring E3 ROW to current. Read some where about amnesty causing this back log. Any one knows this for sure?

An Indian has glorified Indians. How do you use this glorification to explain the behavior of 80+% IV Indian members and 60+% Indians in EB retrogression who have no interest in joining IV?
The best looking answer looks like there is no correlation between the two. Indians remain glorified.

riends need ur suggestion/help regarding the following matter:
filed my I-485 in july 07. submitted my G325A form. didnt filed for my wifes AOS. since she was in india and we were mutually drifting apart. only mentioned her name in the G325A form, since she was still legally my wife.
Now the official relief came as divorce this month.
my question is do i need to send USCIS an updated G325A mentioning about my divorce? (along with a divorce certificate)
will it create any problem when I try to include my next better half in future.

I have
EB2 140 Approved Feb 2006
EB3 140 approved June 2004
My Lawyer says that when they filed my 485 in July 2007, they sent both 140 petitions. IS THAT POSSIBLE ?
Now that the dates got current in Aug 2008 bulletin , I asked them to proceed further so that my case could be adjudicated.
They suggested me to wait and see since ,now, my original EB2 is current anyways.
My question is, Is there any way to find out which category (EB2 OR EB3)will USCIS consider my 485 case to be ?
Should I request lawyer to send a petiton now or wait ? PLease suggest a course of action

Can someone tell me if this is right?
- Total number of EB-2 visas = 40,000
- 7% of 40,000 are allocated for India = 2,800
- Number of EB-2 I I-485 apps pending = 30,000
So if there is no spillover from other categories it will take north of 10 years for all the people who applied for I-485 in the July 2007 fiasco to get Green Cards. The only caveat to this would be attrition or legislation.
WRONG
Mr. Oppenheim has set the cutoff date for EB2 India at January 1, 2000. According to current estimates, out of the approximately 200,000 I-485 applications currently pending with USCIS, 120,000 of them are chargeable to India, with the cases divided evenly between EB2 and EB3. This means that EB2 and EB3 India applicants count for 60 percent of the I-485 cases currently pending with the USCIS.
- Number of EB-2 I I-485 apps pending = 60,000
so with no trickle it will be 20+ years
- Total number of EB-2 visas = 40,000
- 7% of 40,000 are allocated for India = 2,800
- Number of EB-2 I I-485 apps pending = 30,000

Hi there,
Here is my situation, any help to resolve this is appreciated.
- My self (primary) & my wife's(derivative) I-485's (PD June 2002) were filed in March 2007.
- My I-485 was approved in July 2007, my wife's was pending due to NC.
- My wife's employer filed PERM (PD June 2007) & then filed I-140 in March 2008.
- We recently contacted NSC regarding my wife's case status, we received a letter from them stating that, her I485 is waiting for I-140 to get approved.
They linked her new I-140 to her pending I-485 that was filed as derivative. Is this USCIS error?.How to correct this error and have them consider her I-485 application as a derivative application?.
Thanks for your help.
[COLOR="Blue"]Your attorney should get in touch with the USCIS.This situation can be sorted out with informing the USCIS. In case you require any assistance please get in touch with me.
Thanks for your response. My attorney sent a letter explaining the situation along with relevant documents. How long does it take to get updated?.It's been 3 week s and i still don't see any updates to the case.
How can i get your contact info?.
Thanks

Thanks

Lot of Amway guys are hiding among us.
There are lot of Amway guys on this thread making fun of Amway because they fear being ridiculed. But in their real lives they are actually doing Amway business and catching other desis in Walmarts.
This explains why I got so many reds and bad comments after starting this thread.
here you go..this dude is back ranting again..

I remember reading last year a kid who posted something about why he doesn't like Saino was nabbed by cyber crime team near Delhi.Don't know what happened to him after that.
Also I read about Chetan Kunte in the NDTV-Mumbai issue.
CEC Gopalaswami said that Navin Chawla one of the EC always runs to loo breaks when they are in the middle of important decision making which may have not so good effect on a certain party and by the time Navin Chawla came back from loo break there would be a call from Congress party trying to pressurize the decision of Election commission.
I read somewhere Rahul Gandhi during Boston arrest was rescued by Saino men in Vajpayee govt.
Navin Chawla will most probably succeed Gopala Swami when he retires this month.
Of course we all know about our honorable president (with due respect to her ,her body language looks like I'm sorry madam I'm sitting on a sofa in front of you when I should be by your feet ,when she's around Sonia Gandhi)
Looks like this family has bought men all over the place. Now makes sense where all the scam money (be it oil scam or missile scam) goes.
No wonder Varun Gandhi's issue was made such a big controversy even when nothing was proved.
Kapil Sibal wanted to pull a Varun Gandhi stunt with Modi and Modi's response is hilarious.
"To Union Minister Kapil Sibal’s remarks that Mr. Modi should be arrested for his rabid remarks, he said: “You have my address and you are free to arrest me anytime, if you have the guts.” “The jail that could keep me in is yet to be built in India,” he said.

I agree with you. This guy applied his GC in 2001 and got it in 2003. In just 2 years. He made a stupid decision to leave MSFT and then lost 3 jobs in a short span. He is some nut mental case who is happy seeing others getting screwed. Maybe he works his way up by pushing others down.
I dont understand as to why you are so enamoured about MSFT ? Is leaving MSFT a stupid decision ? Why do you jump to conclusions in a public forum without understanding the facts behind a decision ? Let me give you some facts about MSFT and my decision to leave. Draw your conclusions accordingly. As a techie, atleast then, MSFT was among the top notch companies to work for. The work was satisfying and not to mention the pay was rewarding too (atleast in 1994). Back then MSFT's core cash cow products were MS Office and Windows. That is the case even today. MS Office's 2000 release and Windows NT releases were path breakers. In my opinion, if you are in any group other than these 2 groups within MSFT, I dont think the work is truly satisfying. If your concern is a stable paycheck then ignore my opinion.
Back in late 2000, the labor queue in WA, CA, NY and TX states was way too huge and the processing times were long. I surveyed the land for labor certification times and chose to move to MN or IA inorder to get thru this process faster. I chose a dot com company in MN and my labor and I140 flew fast before the 9/11 disaster struck. Oh BTW I was millionaire "on paper" for about 28 days :-). You may think that I went thru the entire GC for just 2 years. You need to check with people who had been GC during that time of the times we were in. In those days, in the immediate aftermath of 9/11, every immigrant in the midwest was scorned with hatred. Google immigrant tales and you will know. I had planned hard, gave up a stable paycheck and went thru 3 layoffs to get my GC. I believe that the long queues atleast in labor and I140 are due to a large number of people applying from NY and CA. I hope you would realize that people think through issues before making decisions. If you have not done the same dont scoff at people who do so.
One last tid bit - MSFT is not the greatest of organizations that you think it is. As I said, if a stable paycheck is all you care for then you are right. If you are looking for real exciting action on the prfessional front, just in my humble opinion, think Hedge funds.
