Hi Attorney,
My friend has an I-140 EB3 priority date oct 2005 approved and he had filed for 485 during july 2007.
He also has another approved LC under EB2 category and he has to file I-140 now.
In August 2008, the EB2 priority date becomes current for him since if he interfiles he would get oct 2005 on his new I-140.
Since he would be porting his EB3 PD to EB2 I-140, is it allowed that now in august he can file both I-140 & I-485 along with porting PD request.
or should he only file I-140 with porting request alone.
Does USCIS still allow concurrent filing and in this scenario can he file concurrently.
What happens to his earlier 485, does he need to withdraw it or how does it work. He is still working on his h1b now.
What will happen to the EAD which was recieved but not yet used. For the new 485 will he get a new EAD or how does EAD depend on changes to 485.
Please clarify.
Thanks.

Is IV fighting for all of us on this?
People are just discussing and discussing but nobody is doing anything. Are any lawyers doing anything?
You step up do something...rather than wasting time.

I couldn't agree more with you. The limited number of GC is definitely a critical factor. But we have contributed to this mess ourselves. Look what happened with EB2 India. Did India started producing EB2 talents overnight? No; rather we started polishing our resumes with inflated years of experience and job description so that we can apply to EB2. The system is too liberal and based on trust. If employers start scrutinizing resumes and certificates a lot of applicants will simply drop off from the GC queue.
Totally disagree with you. People do not inflate their resumes and apply for EB2. There is no need for that for many of us in the profession for more than 10 years already. Besides, it comes under immigration fraud and leads to deportation.
EB2 India is clogged up because people who applied for EB3 five or six years ago switched to EB2 by applying with newly promoted positions and transferring old EB3 priority date.
It all comes down to USCIS/DOL/SWA/BEC processing paper-based cases at tortoise pace and making loads of money for their employees and their pensions. Had they processed cases quickly with electronic processing, EB2 India would not be backlogged like this.

Stick to the point, on YSR. Or open a thread on your favorite topics.
AP has seen an unprecedented political killings, govt and personal land grabbing, corruption, and opportunistic politics just for one man thirst YSR.
Its better to have none than these factionist gonads. As for my id, yes just for this and more and it should not matter you. If you have point, talk about it, otherwise just shut up and dont preach like YSRs family member that Someone or something is better than none
I cannot agrue with you based on how you personally attack someone who has a different point of view.
If you do not know how to debate objectively, no one can help
Your reputation from just 6 posts says it all and I'll end this here... Good luck with your Politics.

I don't know who is real " waste of resources" here ? People who are concerned about their mother country's future or people who call them "waster of resources" !!!

You are worried about your mother country's future but want USA's Green card(And probably eventual citizenship) so that you don't have to go back to your home country..

What is treason here, did I betray India? did I sold India's secrets to some other country?
For me it is personal, my kith and kin are getting killed (talking about innocent civilians and not the LTTE) in Sri Lanka and India is actively supporting the Govt of Sri Lanka with weapons and other things, India can leverage its power to stop Sri Lanka to fight until Tamil civilians are cleared from the war zone but deliberately India is not doing that.
I abide by the constitution of India but at the same time I cannot be silent when the country leadership is pursuing a wrong policy, that I wouldn't have protested if India never involved in the issue ever but India used to be actively involved in the issue and has stake in it.
In my case, I came here to study and got an opportunity to work and decided that US is the best place for my career and applied for GC, eventually I might apply for citizenship but with this issue I have another strong reason to pursue my GC.
Just for argument sake, If one believes that their country of birth is pursuing a wrong policy, they can choose to move to a different country rather than living there and blaming it at every opportunity . What is wrong with it?
History is full of so many examples
Jews from Nazi Germany
Oppressed from communist soviet union
Cubans from Fidel Castro regime
Sikhs from India
and so on and so forth
If you or some one is curious, just to introduce me. I'm member of IV from Feb 2006, I participated in all the IV initiatives, besides check my entire forum history to see any where i had showed dissent towards India or for that matter any thing desperate except for free riders in the forum. This issue is personal to me and I have strong opinion on this.
It's not about showing resentment. Being able to protest is a fundamental right in a democracy, unlike a dictatorship which essentially the LTTE is. We do that everyday in India, America and other democratic setups. It's quite clear that you don't understand the basic concept of a pluralistic democracy that India and America stand for. To see what's wrong with what you said, let me quote you back :
Now if you don't see anything wrong with that, fair enough. But I do. I don't see resentment there. I see treason. In fact, I'll probably come over and party with you when you become a USC. That day will be as happy a time for Indians to not have you around as I'm sure it'll be for you.

From Zhang (http://www.hooyou.com/news/news011307bulletin.html):
We suspect that the large number of approved cases in BEC have a big impact on the progress of Visa Bulletins. Department of Labor announced on December 11 that the BEC then had 142,418 cases pending, while in September, the pending case number was 176,000. In the past three months, about 33,600 cases have been removed, with a pace of 11,000/month. Then, the number of I-140 & I-485 petitions soared up in the past several months. This fact stalls visa bulletins in department of state. We predict that it is hard to see a big progress in visa bulletin, given the hope that BEC will keep its current pace of processing cases. However, we dont expect to see a big retrogression of visa bulletin in the next a few months either. Things may change in the second half of 2007.

Guys, we will know the exact truth in 3 weeks. Until then we have to do what we can do and not worry about things that are not in our control.
I know it is easy to say and tough to do but what other option do we have ??

vdlrao,
There could be one problem with the above interpretation of overflow from FB category. I think the numbers shown in the document are from last year- end of Sep 07, not sure this applies to what is available for 2008. what do you think?
These Unused Family Based Visas are from 2007. These Unused Family Based Visas of 2007 would be added to the following year (2008) Employment Based Visas.
The Unused Family Based VISAS from a perticular fiscal year made available to the Employment Based VISAS of the Follwing Fiscal Year. And the Unused EB4 and EB5 VISAS of a perticular fiscal year would be made available to the same year's
EB1 category.

Hello VDLRAO ,
People from June 2006 are geting GC means that USCIS enough visa so they started to give gc to 2006 candidates.. is my belief true. What will be date in new year's first quater for eb2 india ?
I don't think USCIS has any idea as to how much "enough" visa they have....They function randomly...so plz dont draw any conclusions from who is getting a GC now. It could be the last person filed with latest PD while everyone else waits for their GC!
Just wait and watch. Sept dates will throw some light as to how much of the available visas have they used. (if all, PD will be U, If most/majority: PD will stay same, if less than half: PD will move forward--may be C:p)

You also know what I am stating. You already have heard the word"Pre-adjudication" which means "To assign number" based on monthly bulletin based EB table dates and then put a file on shelf to eat dust till USCIS can "approve 485" /"Send Physical greencard" based on Prority date becomes active based on "country specific limit"
If assigning number is almost equivalent to granting visa in a few days then there should not be hundreds of applicants waiting in "pre-adjudication" queue. We all know that many people have been pre-adjudicated and now they are just waiting for their physical GCs.
Bharatpremi,
I don't think pre-adjudicated cases get visa numbers. These cases are just waiting for visa numbers and they get visa number when dates are current. Getting a visa number is same as an approval.

Are you 'high skilled'?
Your logic suggests otherwise!
There is no word as high-skilled in the law. We all are in the skilled category. High is probably added by the media. Maybe because most people are computer programmers and it seems tough to an average Joe.

It is sad to lose a leader who got elected democratically.
It was also sad that few people who could support SRK (does that related to our immigration issue ) but comfortably felt that missing YSR is not as important as SRK.

Hi,
My wife's first name is blank in Passport and we have her anme as "FNU Last Name" in passport, H4/I-94, EAD, 485 forms. Basically her last name is now Last Name + First name.
I was learnt that we need to split the name and get a new passport.
My question is, how can we change on 485 document?
Do I need to take infopass appointment after getting new passport? or Do I need to write a letter to USCIS about name split. or we have to live like this till we get GC?
Please help me.
Thanks

Can we let him go then...? is there any guarantee they will not recruit more and massacre more? If its Israel already mosat would have taken the preparators. If its US, Pak would have been reduced to rubble.
But India is only good to serve the mutton briyani...God save India.
US knows that Pakistan is the mother of Terrorism, doesn't look like with all the aid flowing in, that it is being reduced to rubble. Terrorism is a deeper debate, and it borders on uneven economics, social structures, global imbalance to name a few. We have quite a few terrorists in India too, just look up Sikh riots of 1984 and Gujrat riots of 2002, the culprits walk scott free. You talk about Israel, how safe is Israel? Would you settle in Israel given a chance? The same is with the US, in the pretext of 9/11 the residual racism is now emerging in these situations.
Whether we like it or not, Kasab will be hung to death. He is definitely a criminal, and it shines on our judicial system and independent media (both are screwed in their own ways) that we can tell that a terrorist hasn't been reduced to a weakling to not demand the food of his choice.
